Confirmation by Sigismund I of the royal commission's ordinance on customs duties in Ruthenia and Podolia
King Sigismund I the Old confirms the settlement ruling of a royal commission regulating the rates and collection principles for customs, bridge tolls, causeway tolls, and market fees on the route from Lviv to Wallachia. The privilege protects Lviv burghers and merchants from arbitrary and burdensome charges by defining tariffs for specific localities in Ruthenia and Podolia.

[f. 1r]
Sigismund, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, etc., Lord and Heir. We make known by the tenor of this letter to all and each individually, present and future, who shall receive notice of this. That having learned that in the Ruthenian and Podolian lands and their transit districts, and especially on the public road leading from Lviv to Wallachia, customs duties have greatly increased, being burdensome and never before applied, and wishing to remedy this so that it does not happen to the detriment of the city of Lviv and our other subjects and to the harm of the Commonwealth, we commissioned the most reverend father in Christ, Lord Bernard, Archbishop of Lviv, and the magnificent and noble: Otto of Chodecz, Voivode of Ruthenia, General and Starosta of Halych and Kolomyia, Stanisław Lanckoroński of Brzezie, Cupbearer of Sandomierz and Starosta of Kamianets, Stanisław Małorzyk of Chodywańce, Standard-bearer of Lviv and Starosta of Drohobych, and Andrzej Herburt of Felsztyn, Standard-bearer of Sambir, that having gathered together, and having summoned the nobility whom the Lviv burghers themselves or the instigator of our office indicated to them, they should revise their rights and documents which they claim to possess under the pretext of their customs duties and by the power of which they enforce them, having also summoned merchants and former customs officers and other worthy men who knew the entire arrangement of said customs, the old manner and custom, as well as the amount of their payment, so that what seems just and fair to these commissioners in the above matters – having no regard for anyone, casting aside favor, hatred, and all partial inclination – they should judge and establish. They, duly and diligently executing our commission at the request of the instigator of our office, after conducting a mature investigation into said customs and after observing the legal procedure that by law should be observed and followed in this, on the basis of this their investigation and the testimony of the nobility written below regarding customs, bridge tolls, causeway tolls, and other things listed below, in the places specially noted below, established, ordered, and decreed as follows:
First, in the town of Żuków, they decreed that [f. 1v] Jan, wójt of Kolomyia, tenant of the Żuków estates, from a wagon passing through there and from oxen, should freely collect half a grosz each; but because the witnesses presented by the parties proved various things, the commissioners could not discern what should be collected and enforced from sturgeon and carp, and they referred this to us and our disposition. We, occupied with other greater cares, appointed other commissioners here, by whom it was established that from every wagon of sturgeon and carp, seven and a half grosz shall be collected as a customs duty, which collection shall last until said tenant is bought out of these our Żuków estates. Those exceeding this customs duty shall be punished with one wiardunek for each wagon.
In Tłumacz. The noble Jan Koła of Dalejów, Castellan of Halych, in his own name and that of the noble Małgorzata, his wife, the main tenant of said estates, having her insufficient power of attorney, presented before said commissioners our letter in which he showed that we had pledged the customs duty in Tłumacz to said Małgorzata for the repayment of a certain debt for our courtier called Wrzona, and proved that in said Tłumacz estates, the customs duty had long been established by his predecessors, but was not defined quantitatively. The same Jan Koła acknowledged that now and for all time, the burghers, merchants, shopkeepers, carters, and all inhabitants of said city of Lviv possessing city rights are not obliged to pay any customs duty on goods or tolls from carters, except for a bridge toll of half a grosz per wagon, whether it is transported by oxen or horses, and whether it is a cask with sturgeon or other fish. Also, from every horse driven for sale and from every trade ox driven loose, they shall pay one ternar as a bridge toll and shall have free pasture for twenty-four hours in the fields, however, without damage to meadows and crops. At fairs, they shall have free pasture after paying a ternar as long as the fairs last. After this statement by said Jan Koła, our commissioners decreed that the current tenants, namely said Małgorzata together with her said husband and their successors, should not collect any customs duties, even supported by documents, nor tolls from carters, but only a bridge toll of half a grosz from a large and small wagon, and from a cask of fish and sturgeon – whether the wagon is pulled by [f. 2r] oxen or horses – also half a grosz, and from every ox and horse driven loose, one ternar; and they shall have free pasture for one natural day as long as the town of Tłumacz itself remains in our hands. In case of bypassing the bridge toll, no more than twelve grosz of penalty should be collected from Catholic, Armenian, and Ruthenian Lviv burghers, excluding Jews.
In Tyśmienica. The noble Jerzy of Paniów, one of the brothers, the defendant, having appeared with sufficient power of attorney in the name of his other brothers, namely Jan and Jakub, at the request of our instigator, said and in his own name and that of his brothers acknowledged that the Lviv burghers and inhabitants, merchants, shopkeepers, and carters: Catholics, Armenians, and Ruthenians, except for Jews, are not obliged to pay them customs duty according to their Tyśmienica privilege granted to them by us, but only from a wagon – whether pulled by oxen or horses – they shall pay no more than half a grosz as a bridge toll. Also, from every trade ox and horse driven loose, without a wagon, one ternar, and they shall have free pasture for a natural day, however, without prejudice to crops and meadows. Furthermore, he acknowledged that Lviv carters carrying others' goods of Lviv burghers are not obliged to pay customs duty in Tyśmienica according to their privilege; and that he and his said brothers and their successors should not collect customs duties, justum, czomiensium, or any market fees in Chodorostaw, and if any of the burghers would like to go to Chodorostaw through our royal village of Grodzisko, then passing through the causeway of the pond, he shall pay six denarii from each wagon as a causeway toll, whether pulled by oxen or horses, one, two, or more. Similarly, on the return from Chodorostaw to Lviv, whether they go [...], without paying the causeway toll through Grodzisko, the mentioned Lviv burghers. In case one of them arrives from the side from some other place to Chodorostaw and from Chodorostaw passes through Grodzisko, he shall be obliged to pay a causeway toll of six denarii from each wagon, because passing to Chodorostaw he did not pay this causeway toll. Furthermore, a merchant, shopkeeper, burgher, or Lviv carter not having the seal or sign of the city, both in Tyśmienica and in Grodzisko, will not be recognized as a Lviv burgher and will pay customs duty [f. 2v] according to the privilege of the heirs of Tyśmienica. After this statement of these heirs of Tyśmienica, our commissioners decreed that for all time in Tyśmienica and in Grodzisko, according to the statement of said heirs of Tyśmienica, by these heirs of the Tyśmienica estates and the tenants and starosta of Żydaczów, present and being at the given time, the bridge and causeway toll shall be collected and levied in this way and no other for all time. For bypassing said bridge and causeway tolls, as a penalty for the offense, no more than one wiardunek shall be paid.
Also in Wasiuczyn. Regarding the personal statement of the noble Ścibor, heir of said Wasiuczyn, saying that in his hereditary estates of the town of Wasiuczyn he does not possess any privileged customs duty, but the Lviv councilors and merchants for the repair of roads and bridges, well known to them, voluntarily used to pay his grandfather and father a customs duty of one ternar from individual horses and oxen driven loose, and half a grosz from each wagon, to whom free grazing was allowed for one natural day in these Wasiuczyn estates – our said commissioners, with the express consent of these Lviv burghers and merchants, acknowledging that the roads and bridges around said Wasiuczyn estates require great repair, approved and confirmed that customs duty, just as they approved and confirmed it in its entirety, to the payment of which said Lviv burghers and merchants submitted of their own free will under the condition that said Ścibor and his successors, possessors of the Wasiuczyn estates at the given time, shall be obliged and perpetually bound to repair said roads and bridges.
Also in Buczacz. The noble Prokop of Gołogórki, asked by our instigator about customs rights and privileges, answered in his own name and that of his wife that in Buczacz there are no established bridge tolls or customs duties, except that the Lviv councilors and burghers voluntarily gave his predecessors a bridge toll for the support of the repair [f. 3r] of the bridge located on the Strypa river, requiring constant repair, namely from a wagon – whether pulled by oxen or horses – half a grosz. Also, from every ox and horse driven freely, one ternar, and they had free grazing for one natural day. Furthermore, said Prokop acknowledged that these Lviv burghers and merchants during fairs are obliged to pay no more than one grosz from individual places where they set up their goods for sale, and they should not pay any other levies or market fees during the fairs; all of which the Lviv councilors also acknowledged as truth and asked that such a bridge toll be approved by the commissioners, who approved all of this.
Also in Gołogóry. The noble Jan of Sienna, Castellan of Kamianets and heir of Gołogóry, asked before the commissioners by our instigator about rights and documents concerning customs duty, answered that he does not possess any documents for a bridge toll in Gołogóry, as it was not established, but stated that he collected and levied it by virtue of an agreement concluded by Lviv councilors and merchants with his predecessors and voluntarily paid for the repair of bridges and roads, namely half a grosz from each wagon, whether pulled by oxen or horses. Also, from every trade ox and horse, passing loose without a wagon, one ternar. Furthermore, said Jan of Sienna acknowledged that these Lviv merchants and burghers should not pay any market fees, but only one grosz from each place where they set up their goods. And because the Lviv councilors, after seeking mutual advice and consultation with their fellow citizens, acknowledged that in said estates, repair of roads and bridges is needed for their safer passage, therefore our commissioners approved said customs duty with their consent, and bound Jan of Sienna himself, heir of the Gołogóry estates, and his successors to repair the roads and bridges. The parish priest present and every one at the given time there in Gołogóry, because he collects a part of this bridge toll, should, according to the obligation made in the acts of the local ordinary, on every holiday deliver an exhortation to the people during the sermon to recite one Hail Mary for the prosperous state of the city of Lviv.
[f. 3v] Also in Jazłowiec. When the noble Mikołaj Lanckoroński, instigator of our office, appeared there against the noble Mikołaj of Sieniawa and his wife Katarzyna of Dalejów, formerly the wife of the noble Teodoryk Jazłowiecki, and against Jerzy, their minor son, possessors of the castle and town of Jazłowiec, to present rights and documents, if they possess any, for customs or bridge tolls, contrary to the documents by which said instigator proved that currently nor formerly in this Jazłowiec was there any customs duty. Finally, said Mikołaj of Sieniawa, in his own name and with sufficient power of attorney of his said wife and said Jerzy Jazłowiecki, acknowledged that there is absolutely no customs duty, nor toll, nor bridge toll in Jazłowiec, except for the time of fairs, when one grosz is paid from the place where a Lviv merchant or shopkeeper stands with his goods, and a ternar from an ox as a market fee, with free pasture as long as the fairs last, however, without damage to meadows and crops. Similarly, from a horse or mare loose, on which one does not ride nor which pulls a wagon, but is driven loose or led for sale, a ternar is given if it grazes, and is not fed in a stable; and it will be able to graze freely as long as the fairs last; from horses, however, on which Lviv merchants arrive at the fairs, and similarly from oxen and horses by which merchants' wagons loaded with goods are pulled, no passage fees are paid, but during the duration of the fairs there, pastures are to be free. After this statement, said commissioners decreed that no customs duty, toll, or bridge toll in Jazłowiec should be collected, but only market fees during the time of fairs, and not on other market days, from the Lviv burghers themselves: Catholics, Armenians, and Ruthenians, in the above-stated manner with the consent of the Lviv councilors and burghers, said possessors of the Jazłowiec estates and their successors shall collect for all time; and this judgment regarding market fees both said parties accepted.
Also in Pomorzany. When the commissioners heard witnesses, former carters and merchants as well as Lviv burghers, who acknowledged that there had long been a causeway toll there: four oboli [f. 4r] from each wagon, and from an individual ox one obol, with free pasture in these hereditary estates for twenty-four hours, and nothing more. When said carters together with the Lviv councilors and merchants also acknowledged that if a good and constant repair of the Pomorzany causeway is not carried out there in Pomorzany, in a short time this causeway and pond would be destroyed, and passage would become difficult, even impossible, they approved said causeway toll, binding the heirs of these Pomorzany estates to repair said causeway, and for its bypassing they ordered to pay one wiardunek.
Also in Złotniki. When the heirs and local customs collectors presented the privilege of the erection of the wójtostwo of our predecessors, in which the bridge toll is expressed, by virtue of which half a grosz should be paid from a wagon, and a ternar from every ox driven for sale and nothing more – the public road, however, according to the privilege, should be directed not through Sokołów Staw, but through said town of Złotniki towards Trembowla – the commissioners decreed that this bridge toll in this town of Złotniki is to be collected according to the tenor of the privilege, and from those crossing it, a wiardunek is to be paid. Finally, the Lviv councilors and merchants asked the commissioners to intercede with us so that we would deign to establish a bridge toll in the village of Żuków of the noble Zygmunt Kierdej on the Seret river: six denarii from a wagon, whether pulled by oxen or horses, and one denarius from every free ox driven for sale, so that in said village of Żuków across the Seret river there would be a good passage for those going from Złotniki to Trembowla, regardless of whether they would like to go through Spasów Most or through Żuków, and that said Zygmunt Kierdej would allow and be obliged to allow Lviv burghers and merchants: Catholics, Armenians, and Ruthenians, to pass freely without paying this bridge toll. And when said commissioners begged us to establish said bridge toll, we, caring for the benefit of these our Lviv burghers, allowed it to be so, and deemed it appropriate to establish, and we establish hereby, and we want and decree that it be considered established.
[f. 4v] Also in Kuropatniki. The noble Maciej, Standard-bearer of Żydaczów, was accused of collecting causeway tolls according to the tenor of the privilege granted to him by us for the repair of the causeway through which one travels from Lviv to Kamianets, so that four oboli would be paid to him from a wagon without distinction by all merchants, carters, and shopkeepers, and one obol from every ox only by Moldavian merchants and Jews, but not by Lviv merchants: Catholics, Armenians, and Ruthenians. Furthermore, said commissioners decreed that in case of bypassing his causeway tolls, no more than one wiardunek of penalty should be paid to said Maciej.
Also in Dunajów. The most reverend father in Christ, Lord Bernardyn, Archbishop of Lviv, presented our privilege, by which he proved that he possesses a locally privileged customs duty in the town of Dunajów, which is to be paid from every loaded wagon transported to any places and to fairs through Dunajów, half a Polish grosz, and from every wagon loaded with salt, one hundred logs of salt. Also, from an individual ox, three denarii should be collected and paid. Also, from empty wagons traveling through Dunajów, two denarii. Which privilege above the commissioners approved in its full power and ordered to pay one wiardunek for bypassing this customs duty.
Also in Czerwone. When the instigator of our office at the peremptory term demanded the presentation of the law, rights, and documents by virtue of which the noble Mikołaj, current tenant of the Czerwone castle, collects customs duty there in Czerwone, and he did not appear, the commissioners ordered the bailiff to summon him before their court three times by public announcement, and a fourth time in excess, at intervals of time; and when said tenant Mikołaj in this town of Czerwone did not appear even then, nor did he try to present personally or through someone else any documents for the customs duty in this place, nor any witnesses, at the request of this our instigator, for his non-appearance in the entire dispute [f. 5r] they sentenced him and decreed that never again can any customs duty be collected by him or his successors, the Czerwonogród starostas, in Czerwone.
Also in Śniatyn and Kolomyia. When the matter of the collection of customs duty in Śniatyn and Kolomyia was referred to us by said commissioners, and finally there appeared before us the magnificent Otto of Chodecz, Voivode of Ruthenia, General and Starosta of Halych, Śniatyn, and Kolomyia on one side, and the famous master Szojtaczko and Bernard Dzieczka, Lviv councilors, in the name of the entire commonalty of this city on the other side, and these councilors presented before us letters confirmed by us, by which they showed that the Śniatyn customs duty was limited, and the Kolomyia one abolished; while said magnificent Voivode of Ruthenia claimed the opposite, that he and his predecessors were always in the use and possession of said customs duties, offering to prove this with credible witnesses and claiming that said letters lost their power through non-use; wishing to settle this difference amicably between themselves before our ruling, both said parties asked for this matter to be sent back by us to Lviv for their mutual agreement and obtained it. However, in such a way that however both these parties settle and reconcile among themselves in the matter of said customs duties, it should not harm or infringe upon the rights of Lviv burghers when said customs duties return to our hands.
All this and the individual matters above, done before our said commissioners in the subject of these customs duties, bridge, causeway, and market tolls in the places expressed above and other matters mentioned above, ordered by them with the consent of the parties and at the request of these parties referred to us to obtain confirmation, We, recognizing as valid and desirable as consistent with equity and justice, have approved, confirm, and decree by the power of this letter in all articles and conditions, so that they may obtain the power of perpetual durability. Ordering all and individual starostas, tenants, heirs, nobility, customs officers, and guards of bridges and causeways in the towns and other places mentioned [f. 5v] and their deputies, that you strictly observe this kind of ordinance in the collection of customs, bridge, market, and other above-mentioned tolls, and otherwise than described and ordered above, do not dare to collect them in said places nor allow them to be collected, nor shall any of you dare or allow, under the penalties established in the common law of our Kingdom for this, and under the loss of our grace, not acting otherwise. In testimony of which, our seal has been hung to these letters. Given in Piotrków at the general assembly, on the nearest Friday on the eve of Saint Thomas the Apostle, in the Year of our Lord one thousand five hundred and twenty-one, the fifteenth year of our reign.

Insuper recognovit dictus Joannes de Gyenno, quod ipsi exercatores et Cives Leopolien[ses] nulla foxalia debent solvere carnismodo a quolibet loco in quo exponent suas merces unum grossum. [f. 3v] Item in Jasslowijecz.
Item in Pomijenata.
Item in Szlothnyki. Commissarij ipsa pontalia in dicto oppido Zlothnijky iuxta privilegi[i] tenorem exigenda, et a transgressoribus illorum fertonem solvendum decreverunt.
[f. 4v] Item in Kuropathnijki.
Item in Dunajow. Reverendissimus in Christo pater dominus Bernardinus Archiepiscopus Leopolien[sis] produxit privilegium nostrum, quo probavit se habere privilegatum theloneum localiter in oppido Dunajow, quod solvi debet a quolibet curru onerato, vecto ad quecunque loca et fora, per Dunajow medius grossus polonicalis, et a quolibet curru salis onerato centum colpe salis. Item a singulo bove tres denarij exigi et solvi debent.
Item in Czerwone.
