Decree of King Sigismund II Augustus in the dispute over the jurisdiction of Hołosko and Brzuchowice

SIGISMUND AUGUSTUS by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, etc., Lord and Heir. We hereby announce to all whom it may concern. That we recently issued, while staying in Piotrków, a verdict in the case and trial between the honest Anna, widow of the late Marcin Hanel, Marcin, Michał, Szymon, Stanisław, Jadwiga wife of Theobald Aelmiger, Anna the maiden, and Theobald Aelmiger, heirs and successors of the late Marcin Hanel, plaintiffs on one side, and the famous mayor and councilors and the entire community of the city of Lwów, defendants on the other, regarding the jurisdiction over the estates of Hołosko Wielkie and Brzuchowice – whether they are subject to municipal or land jurisdiction, and whether they are located within the hundred hides granted to the city of Lwów by our predecessors. In this verdict, we decided that both parties should appoint commissioners who, having gone to the site, would examine and investigate this, as they were chosen by both parties, and that they themselves should proceed to execute our decree. On the present date, resulting from the appeal and hitherto deferred, when the parties submitted conflicting rulings of the commissioners in their favor and presented different acts of the commissioners, we, having rejected the acts of the commissioners separately due to their discrepancies, decided to hear the case ourselves and resolve it. Having therefore heard the dispute of the parties in council with the advisors and lawyers of our court, having examined the privilege of Casimir regarding the hundred hides and another privilege of the kings Władysław [and] Władysław regarding all wastelands lying around the city of Lwów, extending to the borders of villages both our royal, as well as ecclesiastical and secular, granted to the same city, and also having considered what we learned from the testimony of witnesses, that no estates lie between Hołosko Wielkie and Brzuchowice and the city of Lwów, but the entire municipal land stretches continuously up to their forest Kozimlay mentioned in the privilege of Władysław – we have determined that the aforementioned Hołosko and Brzuchowice are located on the land of the city of Lwów and that from ancient times they were subject to municipal jurisdiction and are subject to it also at present. Ruling that Hołosko Wielkie and Brzuchowice for all time should not be subject to any other jurisdiction than municipal, which the mayor and councilors of the city of Lwów themselves shall possess and exercise in the same way as they possess and exercise it over other properties lying on municipal land, by virtue of this our final verdict.
