IN THE NAME OF THE LORD, AMEN. Since human affairs, as they say, hang by a thin thread and easily escape human memory if they are not confirmed by writing, therefore we, the Chapter of the Holy Metropolitan Church of Lviv, namely Adam Miński, provost of the Holy Spirit Hospital, Stanisław Starzechowski, Jan of Tuchola, Master of Arts, Klemens Pomiatowski, Zygmunt Grotowski, Stanisław Albin, Bachelor of Arts, and Stanisław Król, then official, canons gathered at the general chapter on Monday after Reminiscere Sunday in Lent in the Year of Our Lord one thousand five hundred and fifty-six, in Lviv in our chapter house, WE SIGNIFY by the power of this letter to all whom it concerns, both present and future, who shall receive knowledge of this: That among statutes and eminent men, due consideration should take first place, as the venerable Mr. Jan Arundinensis, Master of Arts and Bachelor of Sacred Theology, then being a senior fellow of the College and our confrere, wishing primarily to care for the salvation of his soul and wishing to increase the income of some worthy person in the future, and especially one appointed to the ecclesiastical office for the people of Lviv, promoted in arts, laws, and sacred theology from the University of Krakow, and to endow them worthily so that anniversary services for his soul and a mass in honor of God could be celebrated, and that divine worship might grow more abundantly for all time, turned to us with a request that he might redeem and recover from their hands our hereditary goods, namely the third measure of all income in our capitular mill, called Olszowy, in the Lviv suburb called Krakowskie, falling to us, which has long been called the mill of the Blessed Virgin Mary, located on the Pełtew River, together with all appurtenances of the same mill, that is, the house, garden, orchard, meadows, fish ponds, from the hands of the honest Elizabeth, widow of Stanisław Bargier, a Lviv councilor, which mill was ceded to her by us for sixteen years by right of redemption for thirty marks, as our acts and her privilege testify; and also one homestead (garden) located in the aforementioned Krakowskie Suburb in Lviv, long called Bałuszyńska, together with gardens and orchards, lying between the properties of the famous Mr. Stanisław Rychter on one side, and on the other of the noble Mr. Marcin Herburt and Bernard, deputy voivode, and Iwan Arkuszicz, surrounded on all sides by a public road, which homestead we sold two years ago by right of redemption to the prudent Albert Bacciota for twelve marks. We, recognizing this as a most useful thing and seeing that his request is just, and especially so that our goods would not be destroyed in the hands of strangers, as they already seemed to be decaying and declining, by unanimous consent and voice allowed, as we hereby allow, that the aforementioned venerable Mr. Jan Arundinensis, preacher, redeem these goods, namely the third measure of the Olszowy Mill and all profits together with houses, gardens, meadows, fish ponds, in accordance with the wording of our privileges, as well as the above-named Bałuszyńska homestead. In connection with this, at the same chapter meeting, the aforementioned Mr. Jan, preacher and our brother, arrived and counted out in cash the payment to both parties, namely thirty marks to the honest Mrs. Elizabeth, widow Bargierowa, and her sons and friends then present, as well as twelve marks for the homestead to the prudent Albert Bacciota and his wife, and paid it in full and completely. The mentioned parties, after receiving and counting the money, resigned from their right and the goods pledged and registered to them until that time into the hands of the aforementioned Mr. Jan Arundinensis, the then preacher, and the chapter resigns [them] into his hands, as has been clearly entered into our acts. These goods, thus liberated and redeemed by the venerable Mr. Jan, we assign, attach, and incorporate to the same Mr. Jan, our preacher, together with his successors legally appointed and established by us to this office, to the aforementioned Mr. Preacher and his successors, for holding, possessing, using, and collecting profits together with all benefits and income flowing from them; with the reservation, however, of our right to two measures in the above-mentioned Olszowy Mill, perpetually reserved for us, and the rent of three marks from the above-mentioned homestead [...] giving the same possessor and his successors the right to locate, lease, improve, and grant these goods in emphyteusis, however with our consent and that of our successors, but without the right to sell, alienate, or exchange them without our knowledge. In these goods, namely in the Olszowy Mill, we lease our two measures, falling to us and our successors perpetually, to the same venerable Mr. Jan the preacher exclusively for the time of his life for thirty marks of common count and for ten bushels of rye flour and four modii, that is, half-measures of wheat, under the condition that when he is summoned by the house provisor, he himself or his lessee will transport the flour to our house with his own horses, and will deposit thirty marks for the benefit of the chapter [...] on Reminiscere Sunday to our provisor, as well as three marks from the homestead. Furthermore, the mentioned mill goods, as long as he holds this lease from us, he is obliged to renovate at his own expense, that is: fences around the homesteads by the river, the mill, houses, repair all obstacles belonging to the mill, provide iron fittings, stones, and everything necessary; from our forests and goods we will provide oak and piles for construction and repair, so that he will be free to cut wood, especially in the Basiówka estate. Furthermore, he will have full power to manage his lessee and servants and to administer justice to outside parties; in the event that he proves negligent in these matters or evades them, then it will be permissible for the parties to appeal to us as the lords. Therefore, we do not renounce the rights of sovereignty in these matters together with the right of ownership for all time. And if it should happen that the mentioned mill goods are destroyed as a result of some fire (from which may God preserve) or decay from old age, or are burned as a result of an enemy invasion, or are completely knocked down due to a windstorm, then for their re-erection and rebuilding we and our successors will be obliged to give two parts of the money, and the preacher himself and his successors the third part, that is, the third penny. But because human wills are often flawed and some have the habit of sometimes appropriating what is meant for a good purpose and the honor of God, therefore the aforementioned Master Jan Arundinensis, fearing and looking to the future, so that his last will might not be violated by his successors and wishing that this regulation of his remain intact forever, and also so that we and our successors might have greater certainty regarding our goods, voluntarily and after reflection asked us that we, as lords of the soil having sovereignty, should be the guardians and curators of the mentioned goods. If, therefore, any preacher, his legally established successor, should prove arrogant and recalcitrant, and should not satisfy the will of the founder and his predecessors, appropriating everything for himself, and neglecting the repair and renovation of the buildings and fences themselves, and would not want to build and improve this anew, and warned by the chapter would not improve in accordance with these warnings, then obedient to the warnings of the predecessors, just as we are obliged as defenders of the goods and guardians of his last will, appointed against him with his removal, so that these goods would not fall into a worse, but turn into a better state, we could improve these goods of ours and take his share into our possession, just as he has now entrusted the care to us [...] and has granted perpetual management in advance, satisfying however his successor preachers according to his will for the anniversary and mass for the priest's servant, fulfilling his last regulation, as will appear in the act of erection, under the threat of the Last Judgment, promising them this provision and binding us and our successors so that the testator's will is not diminished. For greater credibility and testimony, our seal has been suspended. Done and given in Lviv in our chapter in the year and day as above, in the presence of witnesses: the famous councilors Grzegorz Kołaczek and Szymon Brzotin, Master of Arts, as well as Stanisław Kuzak, tailor, and Albert Karim, suburbanites, and me, Paweł of Kalisz, notary of the same chapter and public notary.
