Confirmation of the privileges of the St. John's Church jurisdiction in Lwów by King Sigismund II Augustus
King Sigismund II Augustus confirms to Jan Krowicki and the inhabitants of the jurisdiction of the Church of St. John the Baptist in the suburbs of Lwów the ancient privileges of kings and officials regarding Armenian law and exemptions from castle burdens. SIGISMUND AUGUSTUS, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, etc., lord and heir. We hereby announce by this our letter to all together and to each one individually, present and future, whom this concerns and who shall receive knowledge of this. That there has been shown to us by certain of our advisors a letter of privilege of the once Most Serene Casimir, King, our predecessor, strengthened by the seal of the same, intact and free from any stain of suspicion, containing within itself certain liberties, rights, and prerogatives granted to the Armenians settled outside the walls of our city of Lwów on the land of the Church of St. John. And a request was brought to us that we might deign to renew, approve, ratify, and confirm this same letter of privilege with our royal authority. The words of this letter are as follows:
IN THE NAME OF THE LORD, AMEN. In eternal memory of the matter. Since the majesty of rulers is accustomed to entrust to writing individual acts of deeds performed by the authority of their highness, whether for the sake of establishing something worthy [!], or for the reason of deeming it right to confirm and renew ancient grants, so that in this way, through eternal durability, they may be free in the future from the error of oblivion and confusion. Therefore We, Casimir, by the grace of God, King of Poland, and also of the lands of Kraków, Sandomierz, Sieradz, Łęczyca, Kuyavia, Grand Duke of Lithuania, lord and heir of Ruthenia, Prussia, and the land of Chełmno, Elbląg, and Pomerania. We announce by the tenor of this writing to all whom this serves, present and future, who are to receive knowledge of this. That when the venerable Jan Krowicki, Dean and Canon of Lwów and parish priest in Sambor, our notary, sincerely beloved by us, represented to us that formerly our predecessors left the goods and subjects or Armenians belonging to his deanery free from the burdens and labor services of ours and our castles of Lwów, although according to the custom of these our predecessors the same goods of his and the Armenians were always preserved in these customs and privileges, however, because his predecessors obtained over time certain letters of our dignitaries and officials concerning their liberties, to which royal power was not added, therefore he humbly begged us that we might deign to renew, confirm, approve, and ratify the same letters of his, issued in the name of both the once divine King Władysław and our dignitaries and officials. The contents of which follow:
IN THE NAME OF THE LORD, AMEN. In eternal memory of the matter. That we prudently prevent the inconveniences of certain and doubtful matters when we immortalize the deeds of our age with writing and the testimony of credible men. Therefore we, WŁADYSŁAW, by the grace of God, King of Poland, and also of the lands of Kraków, Sandomierz, Sieradz, Łęczyca, Kuyavia, Supreme Duke of Lithuania, lord and heir of Pomerania and Ruthenia, etc. We announce by the tenor of this writing to all whom this serves, present and future, who are to receive knowledge of this. That at the earnest requests of the venerable Zygmunt, Canon and Prebendary of St. John outside the walls of our city of Lwów, our sincerely beloved, we transfer forever the Armenians, gardeners, and inhabitants long belonging to the said Church of St. John, who live in the gardens and places around this same said Church of St. John, from Ruthenian law to Armenian law, which other Armenians located in our city of Lwów use. Urging and removing therein all Ruthenian laws, customs, and all habits that were accustomed to disturb that Armenian law most often. We furthermore remove and forever release all and individual Armenians, gardeners, and inhabitants of the said places from all jurisdiction and power of all and individual voivodes, castellans, starosta, judges, and sub-judges of our Kingdom and any of their officials and servants, so that summoned before them or any of them in matters both great and small, namely theft, arson, blood, murder, mutilation of limbs, and any heavy crimes, they shall by no means be obliged to answer or pay any penalties, but only the Armenians, gardeners, and inhabitants of the suburb and the place in any way belonging to the mentioned prebend of the Church of St. John before their wójt (reeve) serving there at the given time. The wójt, however, before the mentioned Zygmunt, Canon of the said prebend of the Church of St. John, or before his successor, or before us or our general court – under the condition, however, that he shall be summoned by our letter sealed with our seal. And only then, if he proves negligent and sluggish in administering justice, and then he is to answer before the complainants no otherwise than only according to his Armenian law. In criminal and capital matters expressed above, to the said wójt of the mentioned suburb, gardeners, and inhabitants serving at the given time, we give full and all power of higher and lower jurisdiction (merum et mixtum imperium) by this writing: of judging, punishing, correcting, whipping, and condemning, just as the Armenian law itself, which the Armenians of our city of Lwów possess, as mentioned, in all its points, articles, conditions, judgments, and clauses requires and demands. Always, however, without prejudice in its entirety to our royal rights. In testimony of which the seal of our Majesty has been affixed to this letter. Done in Lwów on the nearest Wednesday after the feast of Easter, in the Year of the Lord one thousand four hundred and fifteenth [1415-04-03]. In the presence of the fathers in Christ, the lords: Jan, Archbishop of the holy Church of Lwów, Maciej, Bishop of Przemyśl, the brave and noble: Mościc of Stęszew, Castellan of Poznań, Iwon of Obiechów, Castellan of Sieradz, Jan of Krzyżanów, Spytek of Tarnów, and many other credible witnesses. Given by the hands of the venerable father in Christ, the lord Wojciech, by the grace of God Bishop of Kraków, Chancellor of the Kingdom of Poland, and the venerable man, the lord Protonotary of the Apostolic See, Dean of Kraków, Provost of St. Florian, Canon of the churches of Gniezno, Kraków, and Kruszwica, sincerely beloved by us. By the relation of the venerable father in Christ, the mentioned lord Jan, by the grace of God Archbishop of the holy Church of Lwów.
We, PIOTR ODROWĄŻ of Sprowa, Voivode and Starosta General of the Ruthenian land. We announce by the tenor of this writing to all generally whom this serves, who are to receive knowledge of this. That having considered the laws and documents strengthened by royal authority with the greater seal, by virtue of which the prudent and famous Armenians and inhabitants settled in the suburb outside the walls of Lwów, belonging to the venerable lord Franciszek of Orzeg [or: of Rzegów], Provost of St. Florian of Kraków and Dean of the Church of Lwów, are released from all and individual payments, tributes, taxes, and castle and city labor services, from where having reviewed such immovable and intact laws, we preserve the said people of the Dean, his Armenians, in these royal rights, as we ought, and have left them free from all tributes, payments, and labor services and exempted, releasing them by means of this writing. Therefore, to you, sub-starostas, burgraves, and our officials serving at the given time, we strictly command and order that you do not dare to compel, summon, or force the Armenians and those people of the said lord Dean to payments, tributes, and labor services under any pretext, under penalty of the loss of our grace. Given in Lwów on Tuesday before the feast of St. Martin the Bishop, in the Year of the Lord one thousand four hundred and forty-fifth [1445-11-09]. Under our seal.
JAN of Czyżów, Castellan and Starosta of Kraków and Deputy of the Royal Majesty in the Kingdom of Poland. We announce to all whom this serves. That having appeared before our and the councilors' presence, the venerable Chapter of Lwów, and in particular the venerable lord Franciszek, Provost of St. Florian outside the walls of the city of Kraków and Dean of the holy Church of Lwów, presented with a complaint that the managers of their villages, and especially the Armenians, Ruthenians, and peasants belonging to the deanery of Lwów, are oppressed by the Voivode Szekani [?] and by the remaining officials of the castle of Lwów and are most often forced to payments and unusual labor services; who presented before us and the councilors present at our side the laws, privileges, liberties, and documents once given and granted eternally to the said Church of Lwów by our Most Serene lord, the most gracious King, at the original foundation and erection of the same, strengthened by the seals of Majesty, and confirmed and reinforced by our present King. From which we became convinced that these same inhabitants of the villages, and especially the Armenians, Ruthenians, and inhabitants in the suburb, in the goods belonging to the same deanery, are released and completely exempted from any labor services and payments. Which having heard and duly and fully understood, we have preserved the said [people] in their rights, privileges, and liberties intact. Since indeed no one has the power to violate and invalidate such great liberties and rights of the said church, granted and confirmed by letters of Majesty, because undoubted justice should be given and measured to everyone. Therefore, to you and to each of you, namely the noble Spytek of Jarosław, heir, Starosta of Lwów, we command by the power of the Royal Majesty granted to us in this regard, ordering most strictly that you should and absolutely must preserve the said church in its liberties and rights, and not oppress the inhabitants of the village of the mentioned chapter, especially the Armenians, Ruthenians belonging to the same deanery of Lwów, under any pretext to labor services, levies, and any payments of tributes, nor draw them into burdens, nor allow your officials to do so. By no means doing otherwise. Done and given at the Lower Castle in Lwów on Ash Wednesday, in the Year of the Lord one thousand four hundred and forty-second [1442-02-14].
We, RAFAŁ of Jarosław, Marshal of the Kingdom of Poland and Starosta of Lwów. We announce by the tenor of this writing to all whom this serves, who are to receive knowledge of this. That when in past years by the order of the Most Serene Ruler, the lord Casimir, King of Poland, etc., we were building a forewall, that is, a fence, around the Upper Castle of Lwów through these same people, peasants, and subjects subordinate to the same castle, and also from individual villages of the local nobility and royal [villages], obliged to help these same peasants, then also we compelled the people, that is, the inhabitants in the suburb of Lwów, to this work; among whom we also wanted to draw in the people of the lord Dean of Lwów, who are endowed for the said deanery by kings and princes; who, together with their lord Dean, namely the lord Michał of Głuchowiec, having come to us, showed the laws and documents by which they are clearly and explicitly excluded from all labor services and any burdensome duties. We, therefore, having viewed the letters of the same Dean, sound, intact, and completely free from any defect, let them go free from this kind of labor service and by this writing release them, nor do we wish to draw them in the future to any labor services of the same castle, by whatever name it may be called. In testimony of which our seal has been affixed. Done and given in Lwów on Thursday after Reminiscere, in the Year of the Lord one thousand four hundred and seventy-eighth [1478-02-26].
We finally, recognizing the above-written letters, both royal and of our officials, as proper and just, and Jan himself, the Dean, and his predecessors as constantly and currently enjoying the use of these same letters and prerogatives, exemptions, and liberties described in them, acceding to the request, we deemed it right to renew, confirm, strengthen, approve, accept with satisfaction, and ratify all and individual above-written letters. And we renew, confirm, strengthen, approve, and ratify, deciding that they are to possess such power of durability as they are accustomed to have by our grant, and his Armenians are to use and enjoy the same liberties and prerogatives as the Armenians of the city of Lwów are accustomed to use and enjoy, according to the tenor and content of the above-written letters forever by means of this writing. In testimony of which the seal has been affixed to this. Done at the Radom assembly on Friday after the feast of St. Agnes [in the text: Giles, erroneously], in the Year of the Lord one thousand four hundred and ninety-first [1491-01-23]. In the presence there of the venerable princes [...] and the [most reverend] father in Christ, the lord Fryderyk, confirmed elect of Kraków, our dearest son, Andrzej, Archbishop of Gniezno, [...] coadjutor of Lwów, Piotr of Włocławek, Maciej of Chełm, bishops of the churches; the magnificent, noble, and venerable: Spytek of Jarosław of Kraków, Maciej of Bnin of Poznań, Jan of Ostroróg of Włocławek, Jan of Pilcza [Tylicz] of Ruthenia, voivodes; Jan of [...], Andrzej of Tęczyn of Wojnicz, Stanisław of Szydłowiec of Radom, castellans; Krzesław of Kurozwęki, Chancellor, Jerzy of Samborzec, Vice-Chancellor, and Piotr of Prażmów [...] Treasurer of the court of our Kingdom, Starosta of Kraków, and many other credible witnesses to the above. Given by the hands of the mentioned Krzesław of Kurozwęki, Chancellor of the Kingdom of Poland, sincerely beloved by us. Krzesław, Chancellor. By the relation of the same Krzesław of Kurozwęki, Chancellor of the Kingdom of Poland.
THEREFORE WE, SIGISMUND AUGUSTUS, KING, have deemed the above-written letters of privileges and everything contained in them, in the use and possession of which these same Armenians of the suburb of Lwów continue, as subject to renewal, approval, ratification, and confirmation by our royal authority, and we approve, ratify, and confirm by the tenor of this letter, deciding that these same letters of privileges in all conditions, clauses, and articles should gain the power of due and eternal durability. Adding furthermore that it shall be permitted for these same Armenian craftsmen of the suburb of Lwów according to ancient custom to have among themselves guilds [?] of any craft and to practice those crafts. In faith of which our seal has been affixed to this. Given at the general Sejm of the Kingdom in Piotrków on the nearest Tuesday before the feast of St. Agnes, in the Year of the Lord one thousand five hundred and fifty-ninth, and the twenty-ninth year of our reign. In the presence of the venerable fathers in Christ, the lords: Andrzej Zebrzydowski of Kraków, Jakub Uchański of Włocławek, Andrzej Noskowski of Płock, Jan Przerębski, nominee of Chełm, bishops of the churches and Vice-Chancellor of the Kingdom of Poland; and also the magnificent, born, and venerable: Jan of Tarnów, Castellan of Kraków, Grand Hetman of the Crown [exercituum Regni nostri supremo] and of Sandomierz and Lubaczów; Marcin of Zborów, of Kalisz and Bytom, Stopnica; Spytek Jordan of Zakliczyn, of Sandomierz, Grand Marshal of the Crown and of Sambor, Chmielnik, and Gródek; Andrzej Tęczyński of Tęczyn, Voivode of Rawa and Płock; Jan Krzysztof, Count of Tarnów, of Wojnicz and Sandomierz; Mikołaj Trzebuchowski, Chamberlain of Gniezno, Burgrave of the castle of Kraków and of Brześć, Lelów, and Rogoźno; Jan Lutomirski, of Rawa, Treasurer of our court; Wacław Dąbrowski, of Sącz, Chęciny; Stanisław of Tarnów, Crown Treasurer, of Sieradz, Krzeczów, and Ostrzeszów; Jan Sierakowski, of Ląd, Referendary of our court and of Brześć; Wojciech Starzechowski, castellans and starostas of Przemyśl; Jan of Ocieszyn [Ocieski], Chancellor of the Kingdom of Poland, General of Kraków, Starosta of Oświęcim, Zator, Sącz, and Olsztyn; Filip Padniewski, Archdeacon, Rafał Wargawski, Provost and Notary of our treasury, Piotr Myszkowski, Scholastic of Kraków, Jan Prowana [Permansak?], Chamberlain of Lwów, our secretaries, and many other dignitaries, officials, and our courtiers, credible witnesses to the above, sincerely and faithfully beloved. [Note 4:] On the nearest Saturday after Low Sunday [Conductus Paschae], in the Year of the Lord 1639. This confirmation of privileges contained in the acts was brought, accepted, and entered into the castle starosta acts of Lwów by oblatio. On the Saturday after the feast of the Visitation of the Blessed Virgin Mary, in the Year of the Lord 1640, after comparing the protocols, both the undoubted one and this original, it was most faithfully recorded, as it is contained in the protocol and the undoubted document, for the reason that the earlier annotation was entered erroneously, because it is contained not under the action of that same Tuesday after Low Sunday [Misericordia] of that same year 1639, but under the action written above, that is, Saturday after Low Sunday under the year 1639.

[Nota 4 - w prawym rogu, o oblatach i ingrosacjach:] Sabbatho post Dominicam Conductus Paschae proxima, Anno Domini 1639. Confirmatio praesens privilegiorum in actis contentorum ad acta Castren[sia] Capitanea[lia] Leopolien[sia] est per Oblatam porrecta, suscepta et ingrossata. Sabbatho vero post festum Translationis Beatissimae Virginis Mariae, Anno Domini 1640 ex confrontatione Protocollorum tum indubii tum huiusce originalis est fidelissime prout in Protocollo et indubio continetur connotata, ex ea ratione quia connotatio antiquior est erronee adnotata siquidem non sub actu feriae eadem post Dominicam Misericordia eiusdem anni 1639, verum sub actu suprascripto, id est Sabbathi post Dominicam Conductus Paschae sub Anno 1639 reperta continetur.
Parchment document in very good condition, with minor damage (tear/hole in the lower middle part of the text, not causing significant loss of legibility). At the bottom edge, on a silk green-white (or hemp with traces of green) cord, the royal wax seal of Sigismund II Augustus is preserved in a protective wax bowl. On the verso, old chancery regesta and entries regarding the oblatio of the document in the Lwów castle books from 1639 and 1640 are visible.
