Translation / modern text
In the name of Christ, amen. In the year from the Nativity of the same Lord one thousand five hundred and seventy-first, in the fourteenth indiction, on Thursday, the fifteenth day of the month of March, in Borgo Valsugana [In Burgo Ausugano] in the district of the castle of Telvana [Castri Telvani], in the living room of the noble lord Martin de Buffis, notary. In the presence of Gaspar, son of the late Giovanni Brusamolino of Castelnuovo, a resident of the aforementioned Borgo, and Martin, son of the late Pietro Dirima [?] of Telve di Sotto, residents of Telve, specially summoned, requested, and called. There appeared personally Giovanni, son of the late Simone the miller from the village of Carzano, knowing that to him and his heirs by civil law of ownership – with the reservation of the direct right [superior ownership] belonging to Lord Giacomo de Franchi from the late Lord Martin Giovanni, to whom each year from the vineyard described below a rent is paid in the amount of one medennius [?] of wine [...] of the public Lombard rite sufficiently, with his consent and not otherwise or in any other way [...] – he sold to the noble lord Giovanni Battista, son of the late Lord Gaspar Buffa of Tesino, a resident of Telve di Sotto, present there, buying for himself and his heirs, into full and legal ownership of his and his successors, namely: one piece of arable land, partially wooded [?] on the surface, with an area of about two working days of land [operarum duarum vel circa], located within the borders and in the territory of the aforementioned village of Carzano in a place called al prato [in the meadow], which is bordered on the east by the aforementioned buying lord, on the south by the sons of the late Lord Giovanni Battista de Zonghis and Lord Giovanni Battista, son of the late Lorenzo the miller, on the west by the late Lord Wido d'Amphis and the late Bartolomeo Foiermari [?], and on the north by the heirs of Bartolomeo Foiermari. Furthermore, by his own right forever, as free and released from any other debt, he sold and transferred a piece of vineyard with an area of about half a quarter [medij quarti vel circa] together with four small plots of land, partially arable, lying in the same community and place, which is bordered on the east by the same buying lord, on the south by Lord Paolo Bradani, on the west by the widow d'Amphis, and on the north by Battista, son of the late Lorenzo the miller, with the reservation of other, truer boundaries and appurtenances. With all power and authority, right, claim, and entry, and the right to take possession, which Giovanni as seller had or could have had, to possess, hold, and hence to rule, and to do all that which to the same buying lord, his brothers, and his successors from now on shall please and seem appropriate, with all and individual things that are written below and however now and actually are sold contained within these boundaries, or others, if they were truer, with their accesses and exits and with all their other rights, without claim of the seller up to the public boundaries [...] with all other and individual their rights and claims, which any of these sold things has above itself, below itself, or in itself, in whole, with all right, reason, use, and benefit, without any claims on the part of the seller in any way owed and belonging. And this was bargained [...] and the contract was concluded for the price of twelve and a half gold florins at fifty lire of good currency [...] for each florin, and as they declared, estimated by Lord Sebastiano Foimari as a resident of the aforementioned [...], and Nicola of Telvame of Carzano, common friends, by reason of a free and own thing, without any burden, and after deduction of [...] the due burden and three lire by way of payment written below [...] six lire four and six kreuzers [cruciferorum], which price the aforementioned Giovanni the seller now [...] through me, the notary [...] written above, satisfied with the declaration of me, the notary signed below, confessed and declared that he had and received from the same buying lord, received before this contract in cash and counted money, of which he acknowledged himself to be fully paid and satisfied in time, and so declared, renouncing the objection of non-receipt and non-collection and incomplete payment of the aforementioned price in the above manner, as well as the hope of future completion of counting, and the objection of fraud, bad intent, undue payment, unjust enrichment, claim based on the factual state, and any other of his right, privilege, and legal aid in any way belonging to him and which could belong. Which sold things the aforementioned Giovanni the seller decided to hold and possess in the name of the aforementioned Giovanni Battista the buyer, until he takes possession and bodily holding of the same sold things, to which taking by his own authority and retention from now on he granted and gave to the same buying lord all, broad and fullest, as above, permission of any kind. And the aforementioned Giovanni the seller promised for himself and his heirs to the aforementioned Lord Giovanni Battista the buyer, present and accepting the obligation for himself and his heirs and in the name as above, a warranty against eviction and legal defense of the aforementioned sold things against any person and community, in court and out of court. And to keep all conditions, payment of the price, and all and individual above-mentioned provisions forever, to observe them, fulfill them, and not to violate them or act against them personally or through others for any reason, cause, or fraud by law or by fact, under the penalty of double the aforementioned price, solemnly promised, together with the coverage of all damages, expenses, and judicial and extrajudicial interest, and under the pledge of all his present and future goods; and regardless of whether the penalty is paid or not, all and individual aforementioned provisions shall remain valid and permanent.
