[f. 1r] STEFAN, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Kiev, Volhynia, Podlachia, Livonia etc., and also Prince of Transylvania. We hereby announce by this our letter to all and each to whom it may concern, that a case [process] of certain commissioners of ours, specially appointed to carry out the redemption of the third share of our mill called Zimna Woda, located in the Lwów suburb, has been presented before us, concerning the release [redemption] of our said mill, the valuation of the income of the same mill, the establishment and decree regarding the deposit of the sum, the actual redemption and the deposit of the same sum, resulting from the commission's tax and valuation, by the well-born Andrzej Dembowski, Castellan of Sieradz and our Starosta of Łęczyca – to whom we granted this possibility somewhat earlier, at the recently concluded Sejm in Toruń, by our diploma issued in this regard – to the former possessors, the well-born Hynks, and also containing a receipt from them for the received sum of money. And we have been requested with great urgency on behalf of the aforementioned well-born Andrzej Dembowski, Castellan of Sieradz, that we deign to approve and strengthen this commission act with our royal authority. The wording of which [act] follows word for word and is as follows: THIS TOOK PLACE in Lwów at the mill called Zimna Woda, located in the Kraków suburb, before the well-born Joachim Siarzniski called Sęp, Podstoli, and Baltazar Ozga, Vice-Starosta of Lwów, commissioners given and appointed by H[is] R[oyal] M[ajesty] for the release [redemption] of the third mill share from the hands of the well-born Jan Hynek, the then possessor, as well as other successors of the late Kazimierz Hynek, on the Friday next after the feast of Saint Agnes, in the Year of Our Lord one thousand five hundred and seventy-seven, in the presence of the well-born and noble Jan Brzozdowski, Judge, and Jan Rychłowski, Deputy Judge of the Lwów land court, Stanisław Zochorski, Clerk of the Lwów castle court, Marcin Łoplański, Vice-Starosta of the Horodło castle office, Stanisław Wroniecki, Jakub Sęp, and the prudent Hryćko of Lwów, land bailiff of Lwów, and many other credible witnesses of the above. And before this office and the aforementioned commissioners, the well-born Andrzej Dembowski, Castellan of Sieradz and Starosta of Łęczyca, by virtue of the consent of H[is] R[oyal] M[ajesty] and before the commissioners of the same Royal Majesty, demanded from the commission office that they establish their jurisdiction and declare themselves the proper judges; yielding to which demand, the commission office, by virtue of the commission of H[is] Royal Majesty, established the commission jurisdiction, declared themselves the proper judges, and ordered the prudent Hryćko of Lwów, bailiff, to announce it. Which said prudent Hryćko of Lwów, land bailiff of Lwów, testified that by the order and decree of the lords commissioners, he announced the establishment of the jurisdiction and informed both parties to proceed according to the law. [f. 1v] And there immediately, complying with our publication, the well-born Andrzej Dembowski, Castellan of Sieradz and Starosta of Łęczyca, presented the consent of H[is] Royal Majesty for the redemption of the same mill, as well as the commission, the wording of which is as follows: STEFAN, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Livonia etc., Prince of Transylvania. To the Illustrious and well-born: Andrzej of Tęczyn, Voivode of Bełz, Jan Liszniowski, Starosta of Horodło and Cupbearer, Joachim Siarzniski, Podstoli, Baltazar Ozga, Vice-Starosta of Lwów, sincerely and faithfully dear to us, our royal grace. Illustrious and well-born, sincerely and faithfully dear to us! We have permitted and agreed that the well-born Andrzej Dembowski, Castellan of Sieradz and our Starosta of Łęczyca, redeem the third share of the mill located in the Lwów suburb from the hands of the well-born Jan Hynek and the successors of Kazimierz Hynek and any other persons claiming any right and any interest in the said share, whose names and surnames we wish to be considered expressed here; and so that this may be accomplished more easily and quickly, we deemed it proper to entrust and commit this matter to Your Graces, whose fidelity and skill in conducting affairs is highly recommended to us, as we also entrust and commit by this our letter. Ordering that, having set a certain term among themselves, they meet in one place, summon the above-mentioned Jan Hynek and the successors of Kazimierz Hynek, diligently examine and consider the privileges and documents by virtue of which they possess our said goods, and having thus learned the due sum written therein, award it to them and cause it to be deducted and deposited by the well-born Andrzej Dembowski, to whom the possibility of redemption was given. When this is done, let them order them to withdraw from possession and transfer it to the purchaser. Let them also do everything else that is customary to do in similar matters, and ensure that what they decide is strictly observed, whereby the absence of one of them does not constitute an obstacle. Otherwise, do not act against our grace and the duty of your office. Given in Toruń, at the general assembly of our Kingdom, on the first day of the month of December, in the Year of Our Lord one thousand five hundred and seventy-six, and the first year of our reign. By the personal order of H[is] Royal Majesty. The wording of the announcement [innotescentia] is as follows: Andrzej Count of Tęczyn, Voivode of Bełz and Starosta of Rubieszów, Jan Liszcznowski of Zimna Woda, Cupbearer of Lwów and Starosta of Horodło and Dolina, Joachim Siarziński, Podstoli, Baltazar Ozga, Vice-Starosta of Lwów, commissioners given and appointed by H[is] Royal Majesty. To you, the well-born Jan Hynek, and all other successors and sons of the late well-born Kazimierz Hynek, possessor or possessors of the third share of the mill in the Kraków suburb, we announce that a letter of H[is] Royal Majesty has been presented to us on behalf of the well-born Andrzej Dembowski, Castellan of Sieradz and Starosta of Łęczyca, by which H[is] Royal Majesty, by virtue of the consent and life interest granted to him, ordered to redeem the third share of the same mill and deigned to entrust us to choose a suitable day and time, meet in one place, summon the possessors of the same mill, examine the letters and privileges, bring this commission to effect, and according to the privileges order the sum to be accepted, or – if it was not described in the documents – proceed according to custom and valuation. [f. 2r] Therefore, by royal power and our commission authority, we order that you appear before us and our commission office in Lwów on the Friday next after the feast of Saint Agnes the Virgin, where our jurisdiction in Lwów will be established, at the request of the aforementioned Andrzej Dembowski, Castellan of Sieradz, the plaintiff. Who sues you before our office for the payment and receipt of sums of money for the third part of the share of the royal mill located in the Lwów suburb, by virtue of the consent and commission of H[is] R[oyal] M[ajesty], about which he will explain more extensively to you at the upcoming term; and to see and hear how the sums – if any appear in the documents – will be deposited to you, or if they were not expressed, estimated by us by virtue of the consent, and for the deprivation of possession of the same mill and the surrender of possession to the plaintiff's side, as well as to hear and accept other customary actions by the office against you. Given in Horodło, on the Monday next after the feast of Saint Nicholas the Bishop, in the Year of Our Lord one thousand five hundred and seventy-six. The consent on parchment, under the title and seal of the Royal Majesty, with the signature of the Royal Majesty's own hand for the redemption of the said mill, given to the same plaintiff and presented by him, which he wished to have included here, reads in its content [as above]. The defendant side: the well-born Andrzej, Stanisław, Jan, Zofia, and Jadwiga, through their brother, the possessor, the well-born Jan Hynek, having preserved all legal remedies intact, after viewing these letters of consent and commission of H[is] R[oyal] M[ajesty], raised and argued a certain dispute with the plaintiff side, claiming that it is beyond doubt for anyone that the city and councilors of Lwów, by virtue of a certain incorporation, are litigating with the defendant side due to the redemption of the same mill. And they already seem to be subject to redemption and execution by virtue of the decree of H[is] R[oyal] M[ajesty]. They have no obligation to answer to two plaintiffs in one matter, nor to yield before two in one matter, and they demand to be recognized as free or for the case to be suspended until the parties themselves prove the validity of the rights between themselves, preserving all other benefits of the law in force. The plaintiff argued that the redemption of these goods is subject to the will of the Royal Majesty and these goods are always subject to redemption, and the plaintiff enjoys royal law and argues that the alleged incorporation smacks of alienation of the goods of the Royal Majesty's table, and the plaintiff's right is better, and according to common law, the goods of the Royal Majesty do not suffer any delay. Therefore, the defendant side can be compelled to further proceedings, with all benefits of the law remaining in force. But the commission office, having heard the proposals and responses, objections and arguments of the parties, adhering to common law and after viewing the consent of the Royal Majesty and the commission presented by the plaintiff side – from which it follows that the said plaintiff side seeks the redemption of the goods of the Royal Majesty by virtue of the consent, and the defendant side together with the townspeople resorts to evasions, alleging non-incorporation and alienation of royal goods – decreed that the defendant side is to proceed further in this case. From which decree the defendant side appealed to H[is] Royal Majesty within a period of six weeks, which appeal the commission office did not accept as being filed in a collateral matter and concerning the redemption of goods; and the defendant side protested before the aforementioned bailiff and nobility against the hardship, declaring readiness to proceed according to the law. Finally, the aforementioned well-born Jan Hynek, on behalf of himself and his brothers and sisters, not abandoning his appeal, since he was compelled by the decree, presented documents of his former possession of this mill; he always declared that in the letters of his predecessors in possession, the sum was not expressed, but as the plaintiff's consent and the commission act itself state, if the sum was not described, it should be estimated. Therefore, the aforementioned plaintiff demanded that the commission office calculate the profits of the same third share of the mill, the income of the same mill, both from mill rents, mill houses, and meadows, after proper and fair acceptance of testimonies and consideration of them according to the statutes, establish, tax, and calculate the sum, and deign to deposit it to them, with all other benefits of the law remaining in force. The plaintiff side [...] argued that according to the form of law they are ready to satisfy, but income cannot be derived from bare words, it must be shown and proven by witnesses, and only then make the valuation and collection of the sum from the income [...], preserving all other benefits of the law in force. [f. 2v] The commission office, relying on the commission and consent of H[is] R[oyal] M[ajesty], from which it follows that there are no sums in those originals, ruled and hereby rules that the income should be estimated in order to calculate the sum to be paid from the tax of income. But since such valuation usually takes place on the basis of testimonies and proof of income, therefore, proceeding to the valuation, they decided that the under-miller of the same Zimna Woda mill, the reputable Walenty, and Mikołaj, manager of the court [factor curiae] of the same defendant side and the same third share of the mill, as well as the noble Klemens Olchowski, superintendent [superintendens], having first taken a corporal oath, present the type and amount of income, count them, and derive them from the registers. And there immediately the aforementioned Walenty, under-miller of the same mill, the aforementioned Mikołaj, factor of the said defendant side, the noble Klemens Olchowski, and Fedko Tyrwon of Sroki appeared, from whom a corporal oath was taken according to the oath formula, that they will truthfully give testimony and certify the type and amount of annual income from the said mill, from the millers' rents and the meadows belonging to it. Which witnesses mentioned above, having first taken a corporal oath on this formula, that they will not speak about the income derived from this mill out of hatred, fear, or favor – so help them God and the Holy Cross – which oath the aforementioned Walenty took before us regarding the annual income from the malt derived from it and its sale, as to sixteen 'wary' [brasca] in the current year, each of which 'war' is sold for twenty-two florins in the current year. In the previous year, it was sold for a higher sum, namely thirty-six florins for each 'war', and somewhat earlier the malt measure itself was leased for five hundred florins of currency. Likewise, the prudent Mikołaj, factor of the same defendant side, having first taken a corporal oath, presented a register of the annual rent from the houses belonging to the said mill and derived from the register the sum of the annual rent: thirty-four florins and twelve groschen. Also, the prudent Fedko Tyrwon before the same office, having first taken a corporal oath, gave a true testimony, just as all those mentioned above did. That they will speak and certify all income of the same mill confirmed by oath, neither subtracting nor adding anything, not testifying out of hatred, fear, or love – so help them God and the Holy Cross. Which they and each of them performed before the same office. [f. 3r] To whom the prudent Hryćko, the aforementioned bailiff, read the oath formula, which they also took as above. Then the aforementioned Fedko Tyrwon from the village of Sroki, having taken an oath, testified and certified, and they all certified that he purchased four stacks of hay on the said mill meadows, and each stack of hay was formerly and once sold for eleven florins, and finally and later these four stacks of hay were sold by him for thirty-four florins; which the above-mentioned witnesses, having first taken a corporal oath with two fingers raised, according to the formula and legal custom, confirmed with an oath their testimonies and arguments regarding the type and amount of income. WE THEREFORE, having primarily God and holy justice before our eyes, having duly considered everything that is described in the commission and consent of H[is] Royal Majesty, and having weighed the testimonies of the aforementioned witnesses: Walenty the under-miller, Mikołaj the manager, Klemens Olchowski, Fedko Tyrwon of Sroki from the defendant side, both as to the measures of the third part of the mill's malt, and those derived from the houses and meadow belonging to the third share of the mill, as well as other credible people, and also considering that there is no other mill in the city of Lwów for grinding malt except [the mills] of the Lwów canons and the venerable Lwów chapter – complying both with the consent and commission of the Royal Majesty, and with the statutes of the Kingdom sanctified in this regard – we estimate the profit from the malt derived from the said mill from the third share each year at sixteen measures of malt [brasea] annually, from year to year of the Lwów measure, each 'war' of the Lwów measure separately valuing and taxing at twenty-five florins, both in times of harvest and times of high prices of Polish currency. Which sum for sixteen 'wary' of malt makes and constitutes the sum of four hundred florins of annual income of Polish currency and count. This aforementioned sum of four hundred florins of money according to the statutes of the Kingdom, taxing every ten florins at one hundred florins, constitutes the sum of four thousand florins of Polish count. Also the annual rent, usually paid from the houses standing on the ground of the said mill: thirty-four florins and twelve groschen, [is capitalized] to the sum of three hundred and forty-four florins of Polish currency. Also four stacks of hay derived from the goods and ground or meadow of the same mill each year, counting from year to year, the same stacks of hay at eight florins and fifteen groschen make and constitute the sum of three hundred and forty florins. Which aforementioned sum, resulting from a fair valuation according to the statutes of the Kingdom, collected into one – both from the income from malt, and from rent and for stacks of hay – constituting the sum of four thousand six hundred and eighty-four florins of money, by royal power and our commission authority we have established and decreed that it should be paid by the plaintiff side to the defendants for the said third part of the mill, and the plaintiff is to enter into possession, and the defendant side is to actually surrender possession and withdraw from these goods, that is, to hand over the third share of the mill together with the houses and meadows into the possession of the plaintiff after the deposit of the sum, and the defendants are to give the plaintiff a receipt and withdraw from these goods by virtue of the consent and commission of H[is] R[oyal] M[ajesty] and allow the intromission. [f. 3v] To which withdrawal and introduction, a Lwów land bailiff was added to the plaintiff side, whomever he would choose with the nobility for the introduction; in case of refusal to allow the intromission, they were referred to the royal arm of the Lwów Starosta for the execution of the decree. Nevertheless, with the preservation of obedience and labor services to the Lwów castle and the rights of the Royal Majesty [...]. And here, before the same commission office, the aforementioned Jan Hynek, both on his own behalf as possessor, and on behalf of Andrzej, Stanisław, Jadwiga, and Zofia, submitting to the commission decree, appearing personally, openly, publicly, and expressly testified that he received the aforementioned sum from the valuation by these commissioners amounting to four thousand six hundred and eighty-four florins deposited by the same plaintiff, the well-born Andrzej Dembowski, Castellan of Sieradz, and gives a receipt for it, withdrew from the said goods and immediately handed over the possession of the same mill through the prudent Hryćko, Lwów land bailiff, which possession the plaintiff received from him. In witness and more obvious evidence of which, we have strengthened the act and this decree with our seals and signed with our hands. Joachim Sęp Siarzniski, Podstoli of the Lwów land; Baltazar Ozga, Vice-Starosta of Lwów. WE THEREFORE, STEFAN, KING, not refusing the request of the well-born Andrzej Dembowski in this regard out of our grace and kindness, have deemed it proper to approve, ratify, and confirm with our royal authority the aforementioned act of our commissioners concerning the redemption and valuation of the income belonging to the third share of the Zimna Woda mill, located in Lwów in the Kraków suburb, recently prepared by them, as we also approve, ratify, and confirm by this our letter under the condition that this valuation was made by our commissioners properly, honestly, fairly, and legally, and without diminution and damage to the income and goods of the Republic and our table. Wishing that in the future this commission act and the tax contained therein obtain the force of due stability, and that in this sum of money resulting from the valuation, paid by the aforementioned Castellan of Sieradz for the redemption from the well-born Hynks of the mentioned third share of our mill, this our mill be peacefully possessed by him, and that its possession could not return to us or anyone else having the power of redemption from us with full right earlier, until the same sum is returned to him or his successors. And in undoubted witness of this, we have signed this confirmation with our own hand and ordered the seal of our Kingdom to be affixed. Given in Bydgoszcz, on the sixteenth day of the month of February, in the Year of Our Lord one thousand five hundred and seventy-seven, and the first year of our reign. Reading notes

Parchment document in the form of a libellus (quires) of 4 sheets (8 pages), sewn and sealed with a seal on a silk cord. State of preservation very good, parchment clean, writing legible (neat Renaissance humanist/chancellery cursive). King Stefan Batory transumes and confirms a commission act of January 25, 1577 (prepared by Joachim Siarziński called Sęp, Podstoli of Lwów, and Baltazar Ozga, Vice-Starosta of Lwów) concerning the taxation and redemption of the third share of the royal Zimna Woda mill in the Kraków suburb in Lwów by Andrzej Dembowski from Jan Hynek and siblings (heirs of Kazimierz Hynek). The commission act cites a royal mandate from Toruń of December 1, 1576, and a commission summons from Gródek of December 10, 1576. At the end, the handwritten signature of King Stefan Batory (Stephanus Rex), on sheet 4r the signature of Albert Baranowski (later bishop and primate, then royal secretary). The catalog card incorrectly states '1 sheet', whereas it is a 4-sheet quire (libellus).
