Translation / modern text
In the Name of Christ, amen. In the Year of Our Lord one thousand five hundred and seventy-seventh of the current indiction, on the twenty-eighth day of the month of March, in San Pietro Comitatus, in the house of the buyer mentioned below, in the presence of Master Marek, son of the late [...] Coluccius of Cesco in San Pietro, and Master Bartłomiej, son of the late Julian of Prezonario, credible witnesses called, requested, and brought for this purpose.
There, Grzegorz, son of the late Franciszek of Cesco in San Pietro, in his own name and on behalf of his heirs, by his own right and forever gave, sold, and transferred to Jan [quondam Joanni] of Cesco of the same place, the buyer, accepting the obligation and receiver for himself and his brothers and their heirs, a piece of meadow and arable land measuring about one arable morgen and half a sextarius of mowing, located and lying in the municipality of San Pietro, in a place called sotto polpezza, contained within its boundaries: to the east by the [property] of the late Florian, son of the late Jakub of Cesco, to the south by the property of the Brotherhood [Scola] of San Pietro and partly by the property of San Bulfingo [?], to the west by the buyer and partly by the property of San Pietro, to the north by Bartłomiej, brother of the said seller, and Florian, brother; free and unencumbered without any condition of servitude, to possess, hold, and rule, and to do forever whatever the aforementioned buyer and his brothers and their heirs shall henceforth please. With all and singular things contained within the said boundaries or others, if they were more accurate, and with access and egress up to public roads, with everything and individually that the said sold property has upon it, under it, or within it in its entirety, and with every right, claim, usage, or demand pertaining to it, for it, or in any way owed to the sold thing itself, for the price and sum of 380 lire [...], determined by the late Alojzy de Tonniello and the late Leonard, son of the late Bartłomiej de Tonniello, men chosen jointly by the parties, after receiving an oath from them by me, the notary; which price the said Grzegorz the seller acknowledged with satisfaction that he had received, collected, and was fully satisfied, renouncing completely the plea of the price not given, not paid, and not counted; the said seller in his own name and on behalf of his heirs undertook towards the said buyer, accepting the obligation for himself and his brothers and their heirs, that in the future he will not bring any dispute, question, or objection, nor will he allow them to be brought. But he shall defend, confirm, release from claims, and maintain in possession the sold thing itself, both as to ownership and possession, before every man, person, and legal community, and consider all the above-mentioned things and each one individually as fixed and inviolable, preserve them, and not oppose them by himself or through others for any reason or cause, by law or by fact, under the penalty of double the value of the aforementioned sold thing, taking into account improvements if it were to increase in value over time, after a prior solemn obligation, and with the duty of repairing damages, reimbursing costs, and judicial and extrajudicial interest, as well as with the encumbrance of his present and future property, which satisfaction – whether paid or not – shall leave all and singular the above provisions in full force. With the reservation, however, that the said seller may, within the next four years, recover and redeem for himself the aforementioned plot for the same amount calculated in cash, in good money, fully counted in cash, and if he does not redeem it within the said period, he shall have no possibility of recovering it. [Notary's sign]
And I, Jakub Glerius, son of the distinguished man, Master Jan Chrzciciel, late notary [...], and by imperial authority a notary, called to draw up the above act, found an extract by the hand of the late Mikołaj a Fabro, notary from Campolongo, without his signature, and therefore in testimony of everything, by virtue of the previously granted permission of the most reverend Master Vicar, having affixed the signs of my notarial office, I have signed with my name.
Glory to God the Best, the Highest.
