Judgment of King Stephen Báthory in the dispute between the commonalty and the magistracy of the city of Lwów
King Stephen Báthory resolves a multifaceted dispute between the commonalty and the magistracy of Lwów, regulating, among other things, issues of income from municipal estates, the rendering of accounts, the election of councilors and the college of forty men, and the observance of the staple right. He orders both parties to maintain harmony and obedience under penalty of one thousand marks.

STEPHEN, BY THE GRACE OF GOD, KING OF POLAND, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Kiev, Volhynia, Podlachia, Livonia, etc. Lord, and also Prince of Transylvania. We hereby announce by this our letter to all and each one whom it may concern, present and future, who shall receive knowledge of this.
WHEREAS, having learned from the petition submitted to us in the name of the Community of our City of Lwów that numerous disputes, disagreements, and quarrels have arisen due to various grievances and burdens between the Community on one side, and the Councilors, the Vogt, and the Jurors of the said City of Lwów on the other. And we issued a letter of our mandate, by which we summoned both of the above-described parties before us and our tribunal, setting them a certain term to appear before us with all their disputes, rights, and evidence, so that they might receive a just judgment regarding all grievances, disputes, and differences before us, rather than becoming entangled and sinking into greater and protracted complexities of lawsuits and unrest in that City. On which appointed term, by virtue of the summons issued by us, the parties themselves appeared before us and our Court: from the council estate, the worthy and famous Szymon Magister, Mikołaj Gelazyn, Doctor of Both Laws, Jan Zaleski – councilors; Wolfgang Scholez, Bartłomiej Gadomski – jurors; and Wojciech Bakałarz of Chodel – notary, proxies with sufficient power of attorney from the entire council estate and the vogt and jurors shown before us. In the name of the Community appeared the famous Jan Zgidlicz, Jakub Soszka the furrier, Jan Schultesik the tailor, Jan Ganschern the furrier – burghers, as well as Jan Niedźwiedź and Jan Krawiec Orzeszek – suburbanites, appearing before us and our Court with shown powers of attorney from the Community and the Guilds of that City, accepting the term set for them by us. First, the proxies of the Community submitted articles of grievances and burdens, by which – as they complained – the said Community, and thereby the Commonwealth of that City, was burdened and oppressed by the council and vogt office. Next, the above-mentioned proxies of the council and vogt office also brought forth reasons and evidence of their innocence, both by word and by writing, as well as by privileges, laws, and written documents according to the requirement of each of the articles. We, however, together with the Advisors and Lawyers of our Court sitting then at our side, having diligently listened to the motions, claims, arguments, and evidence of these parties from both sides regarding the individual articles submitted before us, and also having duly reviewed, considered, and evaluated the laws, privileges, and other written documents submitted before us. First, regarding the complaint filed in the name of the Community against the Municipal Magistracy concerning the income from the Zubrza and Sichów estates, that the Magistracy diverts that income for its private needs and does not render an account of it to the Community as it does with other municipal income. Since in the name of the Municipal Magistracy it was argued before us on the basis of records of perpetual sale and resignation of those estates, that these estates were acquired by the right of perpetual sale from certain nobles for the benefit of the persons of the current councilors, for their private needs and for the maintenance of their dignity and council office; it also follows from the privilege of incorporation that these estates, while indeed

subject to the city regarding jurisdiction, but regarding use and possession are subject to the persons of the current councilors – therefore, we have preserved and for eternal times leave these councilors, both present and future, in the free use and possession of the said estates, according to their above-mentioned rights. As for the municipal estates, namely two townhouses sold by the Municipal Magistracy, about which the proxies of the Community complained: since the Councilors argued that some municipal townhouses were purchased with public money, and then under the pressure of municipal necessity were sold with the general consent of the entire Community, and the money obtained for them was used exclusively for the public benefit of the City, and with a surplus, other estates were purchased in better times from municipal income for the benefit and convenience of the City in place of these sold houses, citing in this regard records and accounting registers. We also, considering that the administration of that City was entrusted by our Predecessors to the council office and their fidelity, refer this article to the rendering of an account, so that they may become clear from this submitted account. Similarly also regarding the sold village of Brzuchowice: since the Councilors, having submitted a privilege for certain empty and deserted places long ago granted to this City, argued that they did not sell these estates, but gave them to certain Burghers for use for a certain time due to the location and costs incurred for the location, and after the passage of these times the City already has a certain not insignificant rent from these estates – so that this too may become clear from the submitted account, we refer it to the rendering of the account. As for the rendering of the account by the Magistracy from municipal income: since regarding the very rendering of this account, a privilege or declaration of the once Most Serene King Sigismund I was shown and submitted to us in the name of the Councilors, issued in the form of a decree between the Community and the Council Office, that for the rendering of the account six capable men should be chosen from the Community, and the former Councilors, in the presence of the residing ones and four Jurors, before the election of new ones, should render an account and sign it under oath – We preserve them and leave them in this custom according to the above-mentioned declaration of King Sigismund I. However, in such a way that by this nothing is infringed upon regarding the public constitutions of the Kingdom enacted about the rendering of accounts, so that it may be permitted for us, whenever we wish or as often as we deem it necessary, to appoint our Delegates together with our Starosta to hear this account. Regarding the Election of Councilors, which the proxies of the Community demanded should belong to the Community according to the custom of other Cities and the general legal practice: since the Councilors insisted on the privilege once issued by the Most Serene King Sigismund I regarding this very election, in which privilege it was reserved that the Councilors themselves should choose another from the Jurors in place of a deceased Councilor or deceased ones – therefore, we preserve and leave these Councilors forever according to this privilege of King Sigismund I. Regarding the Appeals usually sent to us in closed rolls, in the matter of which the proxies of the Community insisted that those closed rolls be abolished and appeals by living voice be permitted, while the Councilors insisted on the privileges and decrees of our Predecessors obtained in the matter of using such closed rolls and shown before us: We have preserved these Councilors according to these privileges and decrees in the custom of sending closed rolls, as we hereby preserve them, yet in such a way that in the future, whenever such rolls are to be sent to us, the parties, both the plaintiff and the defendant, shall be summoned to their closing, and in the presence of both of them these rolls shall be closed, and the entire process of the case from which one appeals to us shall be read in the presence of the parties before it is sealed. And similarly, those rolls sent back from us to them, after summoning the parties, shall be opened in their presence and brought to due execution. Regarding the sold certain house called the Notaries' house, about which the proxies of the Community complained: since the Councilors argued that it was indeed pledged, but currently it has already been redeemed from municipal income and a dwelling is designated in it for the Municipal Notaries – therefore, we release the Councilors from such an accusation, leaving the disposition of that house to their council fidelity and administration. Regarding the Lwów Staple neglected due to the negligence of the Councilors, as was reported to us in the name of the Community: since the Councilors explained that they themselves always protected that staple as far as it was in their power, and because of the violation of this staple they sued many before our Court and Tribunal, and it is not through their fault that this staple repeatedly suffers obstacles both from the side of the castle office and a significant part of the Nobility, to such an extent that many people are allowed to bypass this staple, and even are helped in bypassing it contrary to their rights and privileges granted to the City of Lwów for this staple by our predecessors, and these same Councilors asked us to remedy this with our authority: therefore we decided, as we hereby decide, that this staple according to their rights and privileges should be equally guarded and observed by all, and cannot be violated under any pretexts or excuses by the castle office or by any persons, so that it may be strictly and inviolably observed. Regarding the Taxation of houses put up for sale, about which the proxies of the Community complained that they are oppressed by it: since here before us the proxies of the Councilors expressed consent that this kind of taxation should not extend to people of the same estate, rite, and their municipal jurisdiction – in this regard, we approve and strengthen them according to this their consent, by our authority and the power of this our decree. Similarly, regarding municipal taxes, also with their consent, we decide and ordain that without the public and common consent of the entire City, just as it is observed in our other Cities, they should not be imposed on the Burghers by the Magistracy. Similarly, regarding the election of forty men representing the Community, also with the consent of the parties themselves, we decide and ordain that according to the custom and usage of other Cities, in particular the City of Kraków, forty men should be chosen, provided they are settled, of proven fidelity, and honest. As regards the Burdens of the Suburbanites, in which – as they complain through the said Proxies – they feel oppressed, namely they argued that they are not obliged to remove manure from the City: since in the name of the council office it was argued and proven by the privilege of the once King Casimir the Great that they were settled on municipal lands from the hundred hides donated to this City, and therefore they are obliged without any distinction to all municipal burdens, whatever shall be ordered to them by the office. Considering that not only the Suburbanites themselves, but also the Burghers of that City, even from the circle of Councilors, whoever possesses anything from those lands, equally bear and fulfill these burdens – therefore we have preserved them according to their above-described privilege and decided, as we hereby decide, that the said Suburbanites by reason of their settlement on those lands are obliged to bear for the City all burdens, whatever the Magistracy shall order. regards the complaint of the Guilds about the violation of privileges: since the Councilors argued that they do not violate, but rather preserve such privileges of the Guilds which were obtained for the maintenance of good order in that City with the knowledge and consent of the Municipal Magistracy, without prejudice or harm to the Municipal Magistracy. We, wishing to remedy this in this regard, so that the municipal order does not fall into confusion for this reason, declare that those Guild privileges which were issued with the knowledge and consent of the Municipal Magistracy and provided with the seal of that Magistracy for the purpose of requesting confirmation from us are to have force and be preserved. Regarding the second abandoned Fair, which used to be held on the feast of Saint Margaret, about which the proxies of the Community complained: since the proxies of the Councilors moved to refer this to the common consent of all Burghers, as far as they will want to use that Fair at that time, therefore we refer and transfer them there. Regarding the hidden Municipal Resolutions: since the Councilors declared that they will show the Community all resolutions they possess, and will not hinder the establishing of further ones, provided this happens with the consent of the Magistracy and the entire Community, with the preservation of our Royal approval. Similarly, regarding the public Stones prepared for the construction of the Tower, and – as it was claimed – taken by the Councilors for private use: since the Councilors declared that they will answer for this to the community and prove that they took nothing from them for private use. Similarly also regarding municipal measures, that they should not be diminished, but equalized according to the old public wax measure kept in the Town Hall, we refer the parties themselves to the common and general meeting of the City, and to show and demonstrate them to the Community in the usual place. However, in such a way that in this regard the public constitutions or the office of the Voivode are not infringed upon. Furthermore, we refer all other complaints and private matters of individual persons to the proper municipal court and jurisdiction of Lwów, in which they possess their estates, so that there, by a lawful court, with the preservation of appeal to us, they may pursue their rights, ordering and strictly binding, under pain of our heavy displeasure, the above-mentioned parties, that henceforth they shall not incite any riots, disagreements, disputes, or civil and internal disturbances among themselves, but live in peace and tranquility and in brotherly love, and be content with the common law; let the Community show the Magistracy due obedience, honor, and respect, and let the Magistracy also have due regard for the Community. And let them abandon all disputes and grievances, hatreds and animosities harbored until now mutually between themselves from both sides, and let them cast them into eternal oblivion, and let them not reproach them to each other nor under any pretexts or excuses pursue vengeance one against the other jointly or severally, under penalty of one thousand marks of common currency, payable to our treasury by the party yielding and not observing the above. Adjudging by this our judgment that all these disputes, reports, and accusations cannot and should not at any time harm the good name and honor of any of the parties, both generally and specifically, nor their successors. In testimony of which our seal has been appended to this letter. Given in Malbork, on the nearest Saturday before the feast of Pentecost. In the Year of the Lord one thousand five hundred and seventy-seventh, and of our reign the second year.
