Archbishop of Lviv Jan Sienieński approves the transumed privileges of the Bishop of Chełm, Wojciech Sobiejowski, and King Stefan Batory regarding the annexation of the parish church in Łopatyn to the parish in Busk. IN THE NAME OF THE LORD, AMEN.
We, Jan Sienieński of Sienna, lord of Gołogóry, by the grace of God Archbishop of the Holy Metropolitan Church of Lviv. To all and singular who shall see, read, or hear this our letter, to whom it may concern [...], we certify and make known how, after the presentation before us by the reverend lord Mikołaj Łączyński, canon of Lviv and parson of Busk, of the letter of transformation and incorporation of the said church [...] the parish church of Łopatyn, with the express consent of the most reverend lord Wojciech Sobiejowski of Staroźreby, by the grace of God Bishop of Chełm, made for the benefit of the same Busk church by His Sacred Royal Majesty, as well as the new foundation of five mansionaries and the burdens of the parson of this mansionary church transferred and sealed by the Royal Majesty himself, [a letter] sound, whole, intact, and in no part corrupted, but free from all blemish and shadow of suspicion, the tenor of which follows word for word and is as follows:
In the name of the Lord, amen. For the eternal memory of the matter. WE, Stefan, by the grace of God King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, etc., and Prince of Transylvania, etc. We make known by the power of these presents to all and singular whom it concerns [...] that the reverend father Wojciech Sobiejowski of Staroźreby, by the grace of God Bishop of Chełm, has presented to us how, having learned from the venerable Mikołaj Łączyński, canon of Lviv, parson of Busk and Łopatyn, about the state of the Łopatyn church, that it is highly burdensome for the said church or parson to reside there permanently and fulfill the duties associated with it – due to frequent Tatar raids in those parts and the lack of priests – he devised a new, convenient way and ordained it with perpetual provisions for this church. Namely, in such a way as to unite, assign, and incorporate the Łopatyn church into the neighboring Busk church, located in the diocese of Lviv, and from its revenues to establish perpetual mansionaries at the said Busk [church], who would perform all duties [...]; and he took care that all this be written down and recorded by his authentic letter for the eternal memory of the matter, and he presented and showed this letter to us, asking in the name of the aforementioned venerable Mikołaj Łączyński, parson, that we, by the power of our law, in the said parish church of Łopatyn [...] express our consent to the incorporation for the benefit of the mansionaries and their establishment from those revenues, and that we deign to recognize this as valid and desirable and approve it. The tenor of this letter follows word for word and is as follows:
Wojciech Sobiejowski of Staroźreby, by the grace of God Bishop of Chełm. We make known by the power of these presents to all and singular whom it concerns [...] The venerable Mikołaj Łączyński, canon of Lviv, parson of Busk and Łopatyn, has submitted that it is very difficult for him to bear the burdens in the village itself, which have been incumbent upon and assigned to the church in the village of Łopatyn since its original establishment, due to Tatar dangers and their very frequent raids, as well as due to the small number of priests residing there, because of which it happened that this church was often neglected in its services and devotions, both by himself and by his predecessors. Since the aforementioned current parson and other parsons existing at the time could not conveniently perform and personally continue residence at the same church, nor were they at all able to fulfill the pastoral duties towards the said church, [he requested] that we deign to transfer and incorporate the said parish church for the benefit of the mansionaries of the parish church in the town of Busk, with the special consent of the venerable patron and collator, the Holy and Most Serene Royal Majesty, for all time. WE, therefore, desiring in this matter above all to increase the worship of God Almighty, do agree, permit, incorporate, and transfer by the power of these presents the said parish church in the village of Łopatyn for the aforementioned reasons, together with all rights, privileges, rents, tributes, revenues, and all appurtenances long since endowed for the said church. Ordaining by ordinary authority that all burdens, services, and devotions that were previously performed be carried out and fulfilled by the said Busk mansionaries. The letters of endowment, erection, foundation, and rents and tithes established thereon are also given force in all clauses, points, and conditions. We do, however, impose upon the said Busk mansionaries, of whom there should be five, and a sixth as provost, the duty that they shall daily piously sing in the Busk parish church the hours of the Most Holy and Most Glorious Virgin Mary: Matins with Lauds, Prime, Terce, Sext, and None, and then Mass together with vesper prayers; and one of them is to reside in turn at the parish church in Łopatyn for the whole year or – if they so decide – quarterly, and the revenues belonging and accruing to the Łopatyn parsonage are to be divided equally among themselves. Likewise, the highly learned bachelor of the Busk school shall be obliged to receive twelve florins, and the cantor eight florins annually. The Busk provost, together with his appurtenances, is and shall always be obliged to give to the mansionaries of the Busk church, who will perform the church burdens and services, each year for their table [...] and forty of Polish count. In witness of all and singular of which, our seal has been affixed. Given in Toruń, on the twentieth day of the month of December, in the Year of the Lord one thousand five hundred and seventy-six. The same Wojciech Sobiejowski of Staroźreby, Bishop of Chełm, signed with his own hand.
WE, therefore, King Stefan, seeing that this incorporation and assignment of the mentioned church and the establishment of mansionaries, made by the reverend Bishop of Chełm, serve the good of the Church and the propagation of divine worship, and in addition on our part – with the approval of both the reverend Bishop of Chełm himself and the above-mentioned parson – we have deemed it appropriate to express our consent by the power of our law, and we hereby agree, and we fully, completely, and sufficiently approve, ratify, and confirm that letter and the above-included letters in all their points, clauses, articles, and entire content. Providing that the same letter and letters drawn up in this measure and inserted here shall be lasting, valid, and inviolable for all time. With the reservation, however, that the right of presentation of the mentioned Busk provost shall belong to us and our successors. In witness of all this, we have signed these presents with our own hand. Given in Toruń, on the twenty-third day of the month of December, in the Year of the Lord one thousand five hundred and seventy-six, and in the first year of our reign. Signed: Stefan, King.
AFTER THE PRESENTATION of those letters before us, the said reverend lord Mikołaj Łączyński [...] requested and with due urgency demanded and required that we approve, confirm, ratify, and apply the ordinary authority, as well as the decree and power of perpetual validity, to the same [acts] in all and singular their points, clauses, articles, and all conditions. We, however, desiring to maintain the mode and form of law usually applied in such cases, so that it might not appear that by such hasty confirmation by decree we cause prejudice to anyone, and wishing for this reason to examine the rights and interests of all, we decided to issue citation letters with the power of public proclamations (krid) against all and each one who might think they have an interest in this, jointly or severally [...], and we also directed them under the literal wording of the words. On the appointed date of the citation issued with the power of the krida and duly – as it appears – executed, the aforementioned lord Mikołaj Łączyński [...] having appeared personally before us and having shown those letters of the krida duly announced, accused of disobedience (contumacy) all and singular those cited who thought they had an interest jointly or severally, and who did not appear, nor did they take care to file any opposing objection, although they were awaited longer, beyond the usual hour of the session; and because of their non-appearance, he requested and demanded that we approve, confirm, ratify the mentioned letters of the Holy Royal Majesty in all and singular their points, and place our ordinary authority together with the decree and power of perpetual validity upon them.
WE, therefore, since the said cited persons were awaited beyond the usual hour of the session before our face, and not having appeared, were declared disobedient (contumacious), because of their non-appearance – having previously accepted sufficient recognition and attestation of the seal and hand of the Holy Royal Majesty by credible witnesses (although they are well known to us), and also after viewing, reading, and carefully examining those letters, considering that through this transformation of the said church and the mentioned incorporation, the new erection of the foundation of mansionaries, and the imposition of duties upon them, divine worship will be increased among that people and church, and thereby recognizing the request of the mentioned reverend lord Mikołaj Łączyński as just, in accordance with law and equity, and acceding to it, by the advice and will of the lords dean and canons and the entire chapter of our Lviv [church], present there and expressing consent – together with them, having invoked the name and aid of Christ the Savior, by our ordinary authority and by any other better right, way, manner, and form by which we could and can best and most effectively, upon the fulfillment of all formalities required in similar cases, we have deemed it right to express consent to the said transformation, incorporation, new erection, and foundation of mansionaries and the imposition of burdens originally made and granted, as well as to the cited letters of the Holy Royal Majesty in all and singular their points, clauses, articles, and all conditions, and to everything else contained above, and we hereby agree, and we approve, praise, confirm, and ratify all and singular of this, and upon all this, after examination of the matter and with the observance of due legal solemnity, we hereby impose our ordinary authority, as well as the decree and power of perpetual validity.
All and singular of which above [...] we wish to have [confirmed] by these our letters of confirmation; in witness and testimony of all and singular of which matters mentioned above, we have ordered these our letters of confirmation to be written and signed by a public notary and of our curia of cases, and also to be strengthened by the suspension of our seal. Done and given in Lviv, on the second day of the month of December, in the Year of the Lord one thousand five hundred and seventy-seven. In the presence of the venerable and noble lords: Jakub Wierzbiński, canon of Lviv, Paweł Łączkowski, provost of Gołogóry, Florian Klonowski, Jan Wiązownicki, Stanisław Woroniecki, Andrzej Napolski, courtiers of His Most Reverend Grace, witnesses called and requested, and me, Jerzy Silicius, public notary and of the court of the curia of His Most Reverend Grace.
The same as above, Jan, Archbishop, signed with his own hand.
Jerzy Silicius, public notary and of the court of the curia of His Most Reverend Grace [signed with his own hand and affixed the notarial sign].

Parchment document in good condition, visible traces of folding, plica with slits for the seal cord (seal lost). The text contains two transumed documents: 1) a letter of Albert (Wojciech) Sobiejuski/Sobieski, Bishop of Chełm, dated in Toruń, December 20, 1576; 2) a diploma of King Stefan Batory dated in Toruń, December 23, 1576. Discrepancy with the catalog card: the card gives the date '[22 December 1577]', while the dating formula of the document reads unambiguously: 'die secunda Mensis Decembris Anno domini Millesimo quingentesimo septuagesimo septimo' (December 2, 1577).
