Privilege of King Stephen Báthory confirming the demarcation of the estates of the Lviv Dominicans and royal estates
King Stephen Báthory confirms the commission act establishing the boundaries between the villages of the Lviv Dominican convent of Corpus Christi (Zarudtsi, Koshchiyiv, Zashkiv) and the royal and municipal estates. [Main text – fol. 1r:]
STEPHEN, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Kiev, Volhynia, Podolia, Podlachia and Livonia etc., and also Prince of Transylvania. We make known by this our letter to all whom it concerns, present and future, who shall have knowledge of this: There has been presented to us by the religious father Esaias, prior of the Lviv convent of the Corpus Christi church of the Order of Preachers, a commission letter, provided with the own seals of those commissioners and signed by their hands, free from any defect of suspicion. It explains that by our below-mentioned commissioners, appointed by us, the boundaries were established between the estates of the religious brothers of the Order of Preachers of the Corpus Christi convent in our city of Lviv on one side, and our royal estates, namely the Lviv starosta district, and the royal estates of the city of Lviv on the other side, which estates are described below. And a request was made to us that we might deign to approve, confirm, and ratify this same commission letter with our royal authority. The literal sequence of this very letter is as follows:
IT HAPPENED on the field site, the boundary of the disputes over the balks between the below-written estates of the Corpus Christi convent and the estates of His Royal Majesty [and] the city of Lviv and other estates and the land of the same, on which a new village called Rokitnica is currently settled, around two corner mounds heaped up in the forest and under the Masiów hill by the Rokitna river, demarcating the estates of Zarudtsi, Koshchiyiv, Zashkiv of the Lviv Corpus Christi convent on one side, and Mierzwica and Mokrotyn of His Royal Majesty in the tenure of the magnificent Jerzy Mniszech of Wielkie Kończyce, Crown Carver, starosta of Sanok etc., on the other side, on Wednesday after the nearest feast of Saint John the Baptist, in the year of our Lord one thousand five hundred and seventy-eight, before the magnificent and well-born Stanisław Stadnicki of Żmigród, castellan of Sącz, Jan Dzedro of Pleszowice, castellan of Sanok, Stanisław Starzechowski, sub-chamberlain of Lviv, Walenty Orzechowski, judge, Jan Rychłowski, cup-bearer of Przemyśl, Bartłomiej Korytek, scribe of the Lviv land, commissioners appointed and designated by His Royal Majesty for this matter of demarcation in the wording of the below-written letter of the commission of His Royal Majesty. In the presence of the well-born and noble Stanisław Żorawiński, sub-chamberlain of Halych, Piotr Berecki, vice-starosta of Stryi, Jan Białoskórski, cup-bearer of Halych, Baltazar Ożga, deputy starosta of Lviv, Marcin Kunat, Michał Chomętowski, Mikołaj Pieczanowski, Dobrogost Cielecki, Stefan Kłocznicki, and also in the presence of the prudent Michał Oresz from Lviv and Wojciech from Rościeczyn, land bailiffs, and other credible witnesses in the above-written hearing and seeing.
FIRST, the religious IZAJASZ, prior of the Corpus Christi convent in Lviv, acting on behalf of the entire convent, presented before the above-mentioned lords commissioners the letter of the commission of His Royal Majesty, intact and in no part suspicious or damaged, and so that neither now nor in the future there would be any doubt about it, it was read before the lords commissioners and entered here in the following wording:
STEPHEN, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Kiev, Volhynia, Podolia, Podlachia and Livonia etc., and also Prince of Transylvania. To the magnificent and well-born Stanisław Herburt of Fulsztyn, starosta of Lviv and Sambir and supervisor of the Ruthenian salt mines, Stanisław Stadnicki of Żmigród, castellan of Sącz, Jan Dzedro of Pleszowice, castellan of Sanok, Stanisław Starzechowski, sub-chamberlain, and in his absence the bailiff, Jan Biejkowski, cup-bearer of Przemyśl, Walenty Orzechowski, judge of Przemyśl, Jan Rychłowski, deputy judge, Bartłomiej Korytek, land scribe of Lviv, our faithful dear ones, our royal grace. Magnificent and well-born, especially our faithful and dear ones! Although formerly the most serene Prince Władysław, by the grace of God, Duke of Opole, Wieluń and Ruthenia etc., at the request of the venerable father Zygmunt, vicar of Ruthenia of the Order of Preachers, prior of the Corpus Christi church in the city of Lviv and his convent etc., [concerning] the villages of Zarudtsi, Koshchiyiv and Zashkiv and four manors in Mierzwica with the heritage of the above-mentioned convent, after the perpetual donation of the said estates made to the same convent by the same Duke Władysław, wishing to appease and remove disputes between the said estates of the said convent and his own estates, that is, the city of Lviv and the villages of Mierzwica and others belonging to it on the other side, because of boundaries and balks, and to keep the said convent in peace, having summoned before his face and his advisors, while staying at that time in the village of Mierzwica, the elders from both sides, after due examination of the matter itself, designated certain places for boundaries between the said estates and confirmed it in writing. Which document and boundaries the most serene formerly Prince Władysław, by the grace of God, King of Poland, our dearest predecessor, had confirmed and renewed and gave the above [the power] of perpetual durability...
