SIGISMUND
[S]igismund the Third, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Livonia, etc., and also by the same grace appointed King of Sweden, Grand Duke of Finland, etc. We hereby announce by this our letter to all and each concerned that a paper document has been presented to us, extracted from the Lviv land records, containing an entry transferred from the Lviv castle records regarding the donation of a certain plot with buildings, together with a garden, a meadow, and other appurtenances, made by [the noble Anna Kunowska? by ...] and the noble Wawrzyniec Rosnowski, her second husband, to the honest Mikołaj, formerly a servant of the well-born Kazimierz Hynek, and Anna, spouses, and their descendants. And we have been requested to deign to approve, confirm, and ratify it with our royal authority; the tenor of which is as follows:
It happened in Lviv at the land court sessions on the Thursday after the feast of Saint Adalbert, Bishop and Martyr, in the year of our Lord one thousand five hundred and eighty-five. Appearing personally before the court and these Lviv land records, the noble Anna, daughter of the late noble Adam Molfka, widow of the late noble Łukasz Kunowski from her first marriage, and currently the lawful wife of the noble Wawrzyniec Rosnowski from her second marriage, in the presence and with the consent of her husband as her guardian personally assisting, regarding the matters described below contained in these records, yielding from her land, district, law, forum, and any proper and competent jurisdictions and renouncing them in this regard, and incorporating and transferring herself along with the goods and all her successors to this Lviv land law and jurisdiction, insofar as it concerns and pertains to the act and effect of this entry. Transferring the Lviv castle entry from the records of the same castle of Lviv to these Lviv land records, being of sound mind and body, using and relying on the wholesome advice of her friends, after prior consideration within herself, not being led by any deceit or error, she openly, publicly, and in express words confessed and testified:
That she, her entire and intact hereditary goods, that is, a house with a plot and garden and all buildings and orchards on the upper Podzamcze of Lviv, situated and lying between the plots of the Greek rite church under the invocation of Saint Paraskeva on one side, and the one formerly called Bogdanowski or Niekraszowski on the other, together with a meadow also hereditary near the village of Biłohorszcze [belonging to] the City in the mud, lying between the meadows of the Armenian Bishop of Lviv on one side and the well-born Klemens Kluss on the other; and also another meadow under the Alder Mill, lying between the Kotkowskis on one side and Sieńko the Saddler on the other, acquired by her in any way from her late husband, the noble Łukasz Kunowski, and his successors, with all right, authority, ownership, and hereditary titles, as well as with all appurtenances, attachments, connections, fruits, incomes, profits, rents, revenues, and benefits in general, all and singular, to these same goods in any way looking and pertaining, reserving or excluding nothing of all this for herself and her successors, so that the whole does not detract from the part, and the part from the whole, and as she herself held, had, and possessed them and drew profits from them — to the honest Mikołaj, formerly a servant of the well-born Kazimierz Hynek, and Anna, spouses, both jointly, and their descendants, by the right and title of perpetual and irrevocable donation without the possibility of overturning, she gives, donates, records, and resigns in effect, giving and admitting from now on here before the court and these Lviv land records to the same spouses and their descendants real intromission and actual, peaceful, and free use and possession of these donated and resigned goods through a land or general bailiff of the Kingdom and two noblemen, whomsoever they wish to have, who, together with their successors, have been designated and appointed from now on for this intromission and taking possession of the goods on the site of the goods in accordance with the law and by the said court, so that these goods, recorded and resigned to them in the above-mentioned manner, may be held, had, used, possessed by the same spouses and their successors by right and title of inheritance, and also given, donated, sold, alienated, exchanged, resigned, and freely turned to their own and their successors' any desired profits for all time.
And the testifying Anna Rosnowska herself, nor her successors, should in any way deny or oppose the same spouses or their descendants the real intromission and actual, peaceful, and free use and possession of these donated and resigned goods, nor, after the admission and granting of intromission and possession, cause harm to them in these goods, either by herself or through any other substituted and subordinate persons, or disturb them in peaceful possession. Indeed, she should and will be obliged, as she hereby guarantees and submits herself and her successors from all her goods wherever situated to the same spouses and their descendants, after the granting and admission and in no way hindering the said intromission and possession, to protect, defend, evict, release, intercede, and make free from harm, together with their successors, these spouses and their successors in these goods and their peaceful use from all and any damages and obstacles from all persons of any sex, status, and condition, or their rights and entries of any earlier and later, debts, burdens, dowry and dower, life interests, sales, exchanges, resignations, and any other perpetual and temporal, made and to be made, summonses, co-summonses, [?], royal arm, into these goods [...] and brought, lawsuits and profits obtained and to be obtained, and all court proceedings suspended in any point and degree of law. Likewise, from all legal-like harassment by individual persons, in all courts and offices of the Kingdom, in all legal instances always and everywhere, whenever the need arises, through all land prescriptions to guard, defend, evict, release, intercede, and make free from harm together with their successors, and make these goods clean and free, without the obstacle of any land prescription, and this under the penalty of Three [marks?] of damages on the simple assertion of words, without any corporal oath taxed by these spouses and their descendants, and these, in case of failure to comply with the above, refusal of actual intromission and possession, or in any way hindering, as well as non-performance of defense and eviction, to be paid irrevocably, whenever the need arises, submitting herself; from the defense of such Three damages in no way, neither by land penalties described in the Statute, nor by prescription escaping.
In the event of failure to fulfill all and singular the above things contained in this entry and being sentenced to pay those Three damages due to transgression and submission, for which the said testifying party or her successors will allow themselves to be sued by these spouses or their descendants, again yielding from her land, district, law, court, and any of her own and proper jurisdictions, she shall be obliged to appear in the Lviv castle office on the first term of the summons as peremptory, satisfy the law, answer directly and judicially, and satisfy this peremptory entry, and submit to the judgment. This very first term and other subsequent terms of the case, without any judicial and extrajudicial sought and potentially sought delays, true or ordinary illnesses, absence due to higher matters, for any defenses, for subsequent military service, for years of minority, for acquittance from anywhere newly presented, demanding from now on. Likewise without any legal obstacles: war, general and particular sejm, plague, flood, breaking of bridges, enemy invasion on the borders of the Kingdom, or times — God forbid — of interregnum, absence in the Kingdom, and any other edicts, provisions, and customs introduced that might follow. Furthermore, matters and services of the Republic, lack of any and allegations of ignorance, protests, [...] peremptory prescriptions [...], avoiding nothing that should be legally fulfilled, nor the report drawn up in this name from those presented, without resorting to improper and premature evocations, summonses, co-summonses, as well as announcements resulting therefrom, improper issuances and submissions, motions, appeals, challenges to judgments, or their pursuit through any co-summonses, in no way defending herself together with her successors, from which she already from now on together with her successors through voluntary entry and submission resigns and renounces. In general, without any devised and potentially devised, which the mind and reason or human ingenuity could invent, delays, postponements, escapes, evasions, and legal and factual means, pretexts of prolongation, by which she would protect herself together with her offspring in the above, under the penalty of losing the entire case by herself and her successors. Which, after paying the fee of the memorable court, was confirmed.
We, therefore, SIGISMUND, the aforementioned King, graciously acceding to the said request, have deemed it right to approve, confirm, and ratify the above-written letter and its entire content with our royal authority, as we also approve, confirm, and ratify it hereby, establishing that insofar as it does not contradict the law, it should have and maintain due and perpetual force and durability. And in faith and testimony of this, we have signed this [letter] with our own hand and ordered it to be strengthened with the seal of our Kingdom. Given in Kraków on the twenty-fifth day of the month of March in the Year of our Lord one thousand five hundred and eighty-eight, and the first year of our reign.
Sigismund King
