Confirmation by King Sigismund III Vasa of agreements between Lviv burghers and the nobility regarding customs duties
King Sigismund III Vasa confirms and orders the transcription onto durable parchment of seven agreements concluded between the Lviv burghers and councilors and the local nobility, concerning the collection of customs, tolls, and cattle grazing fees (spasne). Under these agreements, the nobility pledged to respect the royal commercial immunities of Lviv and to refrain from collecting undue fees.

SIGISMUND
[S]igismund the Third, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Livonia, etc., and also the rightful heir and future king of the Kingdom of Sweden, etc. We hereby announce by this our letter to all and each person concerned, that there have been presented to us in the name and on behalf of the venerable and famous councilors and burghers of the city of Lviv, by the honorable and famous Stanisław Szolc, their associate, seven literally transcribed, below-placed paper documents, containing certain contracts regarding the collection of customs in the estates of certain noblemen, concluded between these noble persons and the Lviv burghers – whole, intact, and free from all suspicion, provided with the seals of these noblemen and the signatures of their hands. And we were requested by the same Stanisław Szolc to graciously confirm and approve them in full, and because of accidental events and so that frequent use might not easily destroy them, to order them to be transcribed on more durable parchment.
I. THE FIRST of them read as follows: I, Bartłomiej Korytko of Zwenigród, land scribe of Lviv, confess by this my testimony that I have made a certain resolution and agreement with the Honorable Councilors of the City of Lviv, who had summoned me to the Tribunal in Lublin for extorting customs on oxen when the Lviv burghers or merchants drive them through the Wodniki land of my lease, for which customs I do not have there nor do I take it, but only the grazing fee (spasne). Therefore, I have decided with them that they are not to look at this summons to the Tribunal of the past year nor do they ever wish to file it, but only the grazing fee [is to be paid]. And this in such a way that when any Lviv burgher or merchant drives oxen through this Wodniki land of mine, and will not graze the oxen there, then I am to take nothing from him for the grazing fee. But if he sincerely intends to graze, he must hire and pay for the fodder from the one to whom I entrust it, as he agrees or decides. And furthermore, if they cause any damage to me or my subject while walking through this land of mine along the usually wide road, in the fo[rests] or in the grain, then he will be obliged to justly compensate for it. To which the Honorable Councilors agreed. I also [...] gave such testimony for myself, having sealed it with my seal and signed it with my own hand. This took place in Lviv at the Lviv Land Courts on the first Thursday after Saint Adalbert, in the year of the Lord one thousand five hundred and eighty, as above with my own hand.
THE SECOND such: I, Kasper Wasiczyński, sub-prefect (wojski) of Lviv, confess by this my letter that by a certain contract made with the Honorable Lviv Burgher Councilors due to a summons, who summoned me for tolls to the past Tribunal. And since they waited for me to renew it this year at the Tribunal, and indeed, to let it fall into oblivion. I promise with my good word not to take any grazing fee from any Lviv burgher on my land in Lubsza when he passes with oxen from anywhere, except where he himself would have to hire the grazing fee for a day or a few. And for better faith, I affix my seal. Given in Lviv on the day of the Finding of the Holy Cross, Year of the Lord 1590.
II. THE THIRD: I, Andrzej Zborowski of Zborów, Marshal of the Court of the Crown, Starosta of Radom, confess by this my letter that, favoring the freedom from these embankment, bridge, and customs duties graciously granted by the kings of Poland of blessed memory to people having the Lviv municipal law, I want and promise, trusting them, not to take, nor extract, nor allow to be taken or extracted any tolls, nor customs, nor bridge duties, nor embankment duties in the Czesybiesy estates from any goods, excluding none, whether by leaseholders or by those who would hold the aforementioned estate in total, only that toll which was granted and permitted to my ancestors, the leaseholders of the aforementioned Czesybiesy estates – that is, from a wagon and a horse going in the wagon, one kwartnik, also from horses walking freely, one kwartnik – by Sigismund the First of blessed memory, King of Poland. And for better certainty, I have pressed my seal and signed with my own hand. Given in Halicz on the day of Saint Lawrence, deacon and martyr, Year of the Lord one thousand five hundred and eighty-three. Andrzej Zborowski with his own hand.
THE FOURTH: We, Mikołaj and Jan Zbożny Buczacki, inseparable heirs of the Buczacz estates, confess by this our letter that, favoring the freedom from tolls, customs, bridge, and embankment duties graciously granted to Lviv burghers by the kings of Poland of blessed memory, we also want to preserve for them the freedoms and immunities, and we promise by this present agreement described in our name and heritage to preserve them in all places, and to take or extract nothing from them, who would have the Lviv municipal law, except according to the ordinance regarding tolls, customs, embankment, and bridge duties made at the Piotrków Sejm by Sigismund the First of blessed memory, King of Poland, in the year 1521. And since our leaseholder Chaim of Buczacz, contrary to the knowledge of the freedoms of the aforementioned Lviv burghers, took tolls from them beyond the aforementioned ordinance, then we, by this our agreement and good word, promise that we will return all that for which we were summoned to the Tribunal by the famous Stanisław Szolc, a Lviv burgher and merchant, to him – whether through the Jew or by ourselves – in this time until St. Michael's Day. Promising at the same time for eternal times in all our estates not to extract or take anything from any Lviv burghers, except as it has been from ancient times according to the aforementioned ordinance, that is, from a wagon, whether it will be transported by wool or by horses, half a grosz, from every ox and horse walking freely one kwartnik, having free grazing for one day paid. And for better certainty, we have signed with our own hands and pressed our seals. Given in Halicz at the Halicz Land Courts, on the day of Saint Lawrence, deacon and martyr, Year of the Lord [...] with my own hand. Jan Zbożny Buczacki with his own hand.
THE FIFTH: I, Stanisław Stadnicki of Żmigród, Castellan of Sącz, confess by this my testimony that I have made a certain resolution and agreement with the Honorable Councilors of the City of Lviv, who had summoned me to the Tribunal in Lublin for extorting customs on oxen when the Lviv burghers (or merchants) drive them through the Bahowce land of my lease, for which toll, as I do not have it there, nor do I take it, but only the grazing fee, therefore I have decided with them that they are not to look at this summons to the Tribunal of the past year. And I also, from now on, as I have not taken any toll, I never wish to take it, but only the grazing fee. And this in such a way that when any Lviv burgher or merchant drives oxen through this Bahowce land of mine, and will not graze the oxen there, then I am to take nothing from him for the grazing fee. But if they wish to graze the oxen, he must hire and pay for the fodder from the one to whom I entrust it, as he agrees and decides. And furthermore, if they cause any damage to me or my subject while walking through this land of mine along the usually wide road, in the meadows or in the grain, then he will be obliged to justly compensate for it. To which the Honorable Councilors agreed. [...] gave such testimony for myself, having sealed it with my seal and signed it with my own hand. This took place in Lviv on Friday after Misericordia Sunday, Year of the Lord one thousand five hundred and eighty-four. Stanisław Stadnicki, Castellan of Sącz, with his own hand.
THE SIXTH: I, Jan Potocki, Captain of His Majesty the King, fulfilling the resolution made by my servant, the noble Jaczek Gozimierski, with the Lviv gentlemen regarding the customs and action that took place at the Tribunal. By this agreement, I assure and promise not to take any customs from the Lviv gentlemen and I have ordered that they not be taken from these times, as I have not taken them, and to whomever this agreement is shown, no one on my behalf is to take customs under the penalty ut supra – leaseholders, officials, reeves, village heads, and other servants of both estates being. If someone were to take more than this agreement, I promise to do firm justice with him and to present him peremptorily, as often as any of the above-mentioned persons would violate this agreement. Given in Potok, August 21, Year of the Lord 1594.
THE SEVENTH: I, Rafał Sieniawski of Sieniawa, confess by this my letter that, favoring the freedom from these embankment, bridge, and customs duties graciously granted by the kings of Poland of blessed memory to the city of Lviv, I want and promise fidelity to the Lviv burghers: not to take, nor extract, nor allow to be taken or extracted any toll, nor customs, nor bridge duty, nor embankment duty in the Bursztyn estates in my part from oxen and from any other goods, excluding none, whether by leaseholders or by those who would hold that estate from me. However, if any Lviv merchant, passing through my aforementioned estate with oxen, needs grazing, he must notify me or my official, or my subject, and bargain for that grazing and pay for it. And since some Lviv burghers had summoned me to the Tribunal for the toll, which was taken from them without my knowledge, then I promise to return to them everything that was taken from them. And this agreement [...] and is announced for the near future Halicz Land Courts, that is, on Thursday on the day of the Assumption of the Virgin Mary – as to Stanisław Wilczek (what was taken from him: from three barrels of sturgeon glue one zloty each, from two masses of sturgeon glue [...] each, from five barrels of Wallachian wine nine groszy for each barrel, makes fifty groszy; from a quarter of leather baskets five groszy each, makes fifty groszy). Also to the famous Jan Andrzej Sambor, Lviv councilor, [...] he is to pay twenty zlotys for the mentioned time. However, with such an addition and with such a condition, that if all this is on me alone, as mentioned above, then I myself must also return it. And if only half is on me, and the other half on Her Ladyship Lady Kamieniecka, then I will not be obliged to return anything but half, and the Lviv gentlemen should look for the other half from what was taken by Her Ladyship Lady Kamieniecka. I assure all this by this present agreement and promise to fulfill it. And for better certainty, I have pressed my seal and signed with my own hand. Given in Lublin on Saturday after the Ascension of the Lord, Year of the Lord one thousand five hundred and eighty-five. Rafał Sieniawski with his own hand.
We, therefore, favoring the request of the aforementioned, approve and confirm the above-written letters with our authority, and approve and confirm them hereby, insofar as they do not contradict the common law. In witness and testimony of which, we have signed this with our hand and ordered it to be strengthened with the seal of our Kingdom. Given in Warsaw at the general assembly of the Kingdom, on Friday before the nearest Judica Sunday, Year of the Lord one thousand five hundred and ninety, and of our reign the third year.
