IN THE NAME OF THE LORD, AMEN. WE, Jan Dymitr Solikowski of Sołk, by the grace of God and the Apostolic See Archbishop of the Holy Metropolitan Church of Lviv, together with all our brothers, the venerable and reverend prelates and canons of the Metropolitan Church of Lviv, namely: Stanisław Stryjeński, Dean; Jakub Wierzbieński, Provost; Stanisław Rypiński; Piotr Borszowski Moszyczka, then provisor of the venerable Lviv chapter; Wojciech Ferlicki, Official; Stanisław Mieszkowski; Jan Herbort, Preacher; Tomasz Domaniewski; Walenty Twarogowski; and Kasper Starczewski, gathered in the bosom of the chapter and representing the general chapter, announce by the power of this letter to all and each one whom it concerns or who shall receive knowledge of it, that we, together with the venerable chapter of our Lviv Church, having duly considered the sincere kindness and the management of our affairs and interests by the noble Mr. Wojciech Solikowski, our dearest brother, which he has demonstrated both in other difficult matters and above all in faithful economic administration, and which he continues to demonstrate even now, incurring great costs and dedicating constant work and his foresight for the better and more beneficial repair of our goods, with such fidelity that thanks to this care of his, he has brought it about that two ponds of fair size for the benefit of our archiepiscopal table — one on the Teniaczka [Tignicza] river on the hereditary lands of our town of Kozłów, and the other in the heritage of our village of Marków on the river called Zgniła Lipa [Flotulilippa] — have been newly erected and built at his own expense and cost. And furthermore, who in these times full of dangers and unrest shows such help in our lawsuits and legal matters, as well as in the proper defense of our goods, making every effort and diligence so that our goods may be free from damage and harm by any persons and that they may be restored to peaceful possession. Who indeed, among his other merits, has now finally, thanks to his diligence and foresight, managed [and restored to] possession and settlement of subjects our village of Siemikowce, located in the Halych district — first devastated by a hostile Tatar invasion, and not a little ruined by the constant presence of mercenary soldiers and consequently almost completely deserted. Therefore, we, together with the chapter of our Church, wishing to show due favor and kindness to our brother for his merits towards us and the Metropolitan Church of Lviv, to reward him and make others more zealous in serving the Church and us, have given and granted, as we do by this our letter from now on truly give and grant, to the aforementioned noble Wojciech Solikowski the life-long use of the separated and entire village together with its heritage of Siemikowce, located in the Halych district, belonging to our archiepiscopal table, under an annual rent of ten Hungarian gold florins, payable on the feast of the Nativity of the Lord — starting this payment from the nearest feast of the Nativity of the Lord in the following year, and then annually and continuously, exclusively for the duration of his life, paid to us and our successors — with all right, dominion, and ownership, with all the aforementioned village's appurtenances, attachments, connections, profits, incomes, and benefits in general, and all and individual profits in any way derived from these goods, without any exclusion for the benefit of us and our successors during his lifetime, with full right, just as we ourselves possessed, to him until the end of his life, with the reservation made by us of the return of that [...] heritage of Siemikowce, granting him the power to take possession of the goods of the aforementioned village of Siemikowce, complete and intact, by right and title of life tenure in the aforementioned manner, together with their [...] heritage, from the profits according to his own pleasure [...] and possession, as is the custom, by a land bailiff and any nobles chosen by himself. And in that peaceful possession of the same village of Siemikowce with its heritage and in the life-long use of the same noble Wojciech Solikowski, we, together with our said chapter, shall preserve and our successors shall preserve, as long as he shall live. With the reservation of these conditions, that during such possession he shall settle and conduct his lawsuits by virtue of the aforementioned goods indeed with the help and effort of us and the venerable Lviv chapter, but at his own expense; he shall guard and defend against oppression by neighbors, so that the goods and boundaries are kept intact, according to ancient possession. Furthermore, in the same manor and farm of the village of Siemikowce, he shall be obliged to repair or renovate ruined buildings, and whatever he lays out or does by renovating old ones or erecting new ones, after the expiration of his life tenure, it shall have to fall to us, the Lviv chapter, and our successors together with the goods without any reimbursement of building costs or any payment. Similarly, all winter and spring crops on the farm fields of the same aforementioned village shall fall to us and our successors after his death, without any opposition from the successors of the same Wojciech; with the reservation for his heirs only of the right to retain and take away his own movable property in its entirety after the expiration of eight weeks from his death, with peaceful and free use of all these goods and obedience of the subjects; they shall also not impose village transport duties nor force the subjects to them, unless as they are obliged according to ancient custom. And since in the heritage of our village of Marków the pond on the river called Zgniła Lipa [Flotulilippa], newly erected in the year immediately past at great cost by the same noble Wojciech Solikowski, our brother, was breached due to the violent pressure of water, and the newly heaped embankments were to a large extent destroyed, damaged, and scattered, therefore, so that finally that pond may be rebuilt by him as soon as possible for our benefit, repaired by erecting a new embankment and spillway, and brought to utility, we have permitted him to erect embankments and other drainage devices around the said pond in the heritage of the village of Marków according to the requirements and needs of the place where the pond was built, so that it could withstand the pressure of waters and not suffer damage under the influence of any water element; and because this will not be done otherwise than with the greatest difficulty and great costs, therefore we, the Archbishop of Lviv together with the venerable chapter of the said Lviv Church, having due regard both to those costs which are now to be incurred in the repair of the abandoned pond and to those laid out earlier during its new erection, have given and permitted to the same noble Wojciech Solikowski, our brother, and his heirs or successors, as we do by this our letter give and permit, for twelve years consecutively and directly following one another, in use under the title and name of lease, our village of Marków, complete and entire, with all its heritage and with all right, sovereignty, and ownership to hold, possess, derive benefits, and rule, with all and individual profits and incomes flowing from it. With the exception that all inhabitants of the Kąkolniki key shall retain free felling of wood and oak for fuel and construction. With the reservation also of free choice of pigs and swine, that is, collecting monetary fees by virtue of the said grazing and pannage in the above-mentioned Marków forests and oak groves, exclusively by the inhabitants of the Kąkolniki key; furthermore, the reverend archbishop himself, present and serving at the given time, shall have free grazing there in the groves and the mentioned oak groves for the farm pigs and swine of the above-described goods of the Kąkolniki key. But apart from that, nothing more from these goods for himself, his successors, and the mentioned chapter during the duration of the said lease, not excluding or reserving [this lease], starting from the nearest feast of the Nativity of the Lord and continuing until the complete expiration of twelve consecutively following years. With this condition attached to the same lease of the village of Marków and expressly reserved, that the same noble Wojciech Solikowski by virtue of this same lease should and will be obliged — to which indeed he has voluntarily bound himself and his successors until the expiration of twelve directly following years — to pay to the same venerable chapter, prelates, and canons of Lviv, gathered in the house of their capitular residence, on the Lenten Sunday Reminiscere of each year, one hundred florins of money of Polish currency and count, as a true and certain debt, from the incomes of the said village of Marków, voluntarily granted over the costs incurred for the construction of the said pond, and without any opposition deducted and actually left in the chapter; and this for a chosen Lviv canon, a deputy to the distinguished courts of the Crown Tribunal, sent to Lublin by us and the venerable chapter of the Metropolitan Church of Lviv; such payment starting first on the nearest Reminiscere Sunday falling in the year 1591 and in a similar sum until the year 1602, so that for a full twelve years under the penalty of losing the same lease it may be continued and completed. To what was said above, it was added and expressly reserved that the said pond, located on the Zgniła Lipa river, the renewal of which he is currently undertaking anew at his own expense, the same Wojciech with his successors shall freely and peacefully possess for the full time of those twelve years, counting from the nearest Easter feast, by which time he is obliged to heap up and repair the embankment and erect other spillways and retain water in the same pond; so that he will be able and will have the right to drain the above-described pond, located in the heritage of the village of Marków, three times and catch fish of all kinds for his own benefit, without any obstacle on the part of us, the venerable chapter, and our successors; however, so that after the expiration of the mentioned lease and after its last draining, for the benefit of us and our successors, he shall return and hand it over in a state of proper construction, capable of proper water retention and flooding, to which he has bound himself by this letter. Furthermore, with the addition of this condition, as the same noble Wojciech Solikowski has submitted and bound himself according to his strength to defend the Metropolitan Church of Lviv and the rights and goods of the same Church, and in case of suffering harm, to act accordingly at the expense of the administrators. And so that the above-mentioned goods of the village during the possession granted to him do not suffer any detriment and damage, we reserve for ourselves and the Lviv chapter the right of free inspection of the mentioned goods according to ancient custom. And after the expiration — if it concerns the village of Marków — of that lease, as well as in relation to the village of Siemikowce after the death of the same noble Wojciech Solikowski, all these goods of both villages (except for the pond, which, as said, he will peacefully possess after the third draining) shall pass and return by full right into the possession of us, our successors the archbishops, and the venerable Lviv chapter, without any opposition on the part of the same Wojciech and his successors. Furthermore, the same noble Mr. Wojciech Solikowski shall be obliged and has the duty to personally testify this document of life tenure and lease, with the conditions described in it, to the Lviv castle court records on the first and second nearest annual terms, and for the completion and establishment of the above, under a pledge of one hundred thousand florins of money of Polish currency and count, under the penalty of a firm response in the strongest form before the land court and the Lviv castle office, renouncing all delays, appeals, and their pursuit, to submit and enter into the land records. To the credibility of all of which and individual provisions, we have strengthened this letter by hanging our seal and that of the mentioned venerable chapter and have signed it with our own hand. Done and given at the Lviv general chapter, on the Monday after the nearest feast of the Most Holy Trinity, in the Year of the Lord 1590. In the presence of the noble gentlemen: Józef Proczeński, Andrzej Nagolski, Kasper Gosławski, Jan Witowski, Rafał Rożniatowski, and many other, most venerable courtiers of the current court.
