Confirmation by Archbishop Jan Dymitr Solikowski of the donation by Gabriel Rozen to the mansionaries of the Lviv Cathedral
Lviv Archbishop Jan Dymitr Solikowski confirms a donation of 400 Polish zlotys made by Gabriel Rozen of Rożnów to the provost and mansionaries of the Lviv Cathedral. The foundation was secured in the form of an annual perpetual rent (wyderkaf) of 24 zlotys on the tenement house of the Lviv apothecary Hieronim Wedelski in exchange for the celebration of services and masses for the donor's soul.

IN THE NAME OF THE LORD, AMEN. In eternal memory of the matter. It is fitting that the pious desires of the faithful, especially those adorned with generosity and a magnanimous gift, should remain eternal and imperishable and be protected from all harm of time, so that eternal honor may be rendered to the immortal God by the faithful, and that posterity, imbued with the examples of their ancestors, may be stirred to every duty of piety and charity. Therefore, we, JAN DYMITR SOLIKOWSKI of Sołk, by the grace of God and the Apostolic See Archbishop of Lviv, by the power of this letter make known to all together and to each one individually, to whom it should be known:
That the noble lord Gabriel Rozen of Rożnów, a distinguished and knightly man, distinguished by special piety, and in our city of Lviv particularly inflamed with zeal for the spread of the cult of the most glorious Mother of God Mary, mindful of the fate and condition of humanity, and sighing for the future heavenly homeland and desiring to care for himself and his already deceased ancestors, offered, gave, and donated a portion of his property acquired by his own labor and foresight, namely four hundred florins of Polish currency and count current in the kingdom, to the venerable provost and mansionaries, and at the same time to the priests present and future of the Office of the Blessed Virgin Mary at the altar under the same invocation, erected in the choir near [...] the high altar of our metropolitan church of Lviv, canonically performing service according to the old foundation. He did this namely under the law and condition that the aforementioned Office of the Blessed Virgin Mary be celebrated with greater zeal and splendor, and that in every week, except for holidays, during the donor's lifetime one mass for the remission of sins be celebrated, and after his death likewise one for the deceased by the individual mansionaries.
Providing, however, for this gift of his and having decided that it should last forever and at no time could be lost, for the aforementioned sum of four hundred florins he purchased a perpetual rent, commonly called a redemption, otherwise a wyderkaf, amounting to twenty-four florins, payable to the aforementioned venerable provost and mansionaries annually, six florins in each of the four seasons of the year, on the tenement house of the famous Hieronim Wedelski, burgher and apothecary of Lviv. And the administrators and provisors ordered and established this aforementioned sum, as decided, by the prudent and famous lords of the Lviv council, according to how they ordered the matter to be fully entered into the Lviv council acts under certain conditions, in the following wording:
“Councilors of the City of Lviv. We make known by the power of this letter to all together and to each one individually who shall have knowledge of this. That before us, in the council seat, personally appeared the famous Hieronim Wedelski, called Witembergier, apothecary and burgher of Lviv, and also the honest Anna, his lawful wife, for whose dowry on all their movable and immovable property a security was prudently and cautiously made by us, as the aforementioned husband himself voluntarily and willingly confessed and acknowledged to those present before us, that he indeed received, counted, took into his hands, and accepted from the noble Gabriel Rozen four hundred florins of money and Polish count current in the kingdom. On account of which sum accepted, counted, and taken in the above-mentioned manner, the same aforementioned famous Hieronim acknowledged that on and from his own tenement house, erected from the foundations at his no small expense, acquired by a just title of purchase, situated in the market square of the same city, on the corner going towards the church of the Holy Body of Christ, next to the house of the successors of the once prudent lord Walenty Spilerek, Lviv councilor, to the same aforementioned noble Gabriel Rozen, the aforementioned founder and donor, by full right and free authority, by a certain and lasting perpetual title of sale, he sold, as he does by these presents sell and resign, with the right of sale, an annual rent of twenty-four florins of money and Polish count current in the kingdom, counting each at thirty groszy, from the aforementioned tenement house forever, in whole, really and in effect, annually given, paid, and settled to the venerable by the kindness of the reverend provost and mansionaries of the metropolitan church of Lviv, who for the sins and salvation of the soul of the aforementioned noble Gabriel Rozen would celebrate holy masses daily according to the erection made or to be made, fulfill the Office of the Blessed Virgin Mary with singing, and offer a sacrifice of praise to God Almighty in honor of the Mother of God. Which rent of twenty-four florins the said Hieronim Wedelski, guaranteeing for himself, his wife, and all individual successors, pledged, secured, ratified, and encumbered with a mortgage on the aforementioned tenement house, designating the entire and intact aforementioned tenement house for the mortgage and undoubted pledge, and bound himself and his successors to pay to the aforementioned mansionaries now and in the future forever annually and in every year in four periods, for each quarter, or four legally prescribed terms of each year, namely at Pentecost, the Exaltation of the Holy Cross, and Saint Lucy the Virgin, in installments of six florins of Polish coin and count, without any difficulty, delay, or withholding, without resorting to legal means, benefits of deferment, and any other aids by which he could save, shield, and defend himself. From all of which he generally resigned and by these presents most solemnly resigns, so that the part does not prejudice the whole, and vice versa.
For which rents in each quarter the venerable mansionaries or any of them will not have to come to the said tenement house for its demanding, but with the free liberty of assigning to another of the mansionaries according to their discretion; the said famous Hieronim, as well as the successors or any possessors of the aforementioned tenement house, shall be obliged to bring themselves or send by a capable servant to the mansionary house ten marks [...] in each quarter, starting from the quarter of the Exaltation of the Holy Cross in the year last past, and hand them to the hands of the mansionary school. For which payment and received money the aforementioned provost of the mansionaries shall give and hand over a receipt written by his own hand and provided with his seal to the same famous Hieronim Wedelski and his successors. The power of which receipt of the mansionaries shall last regarding the paid amounts until the time of issuing a new receipt; and the rent itself shall burden the above-mentioned expensive tenement house as long as they possess it, and the inhabitants shall not be freed from paying the said rent until the entirety of the sum of four hundred florins by the said donor or his successors and possessors of the said tenement house is paid, and from this burden and bond and necessity of paying the annual rent of twenty-four florins. As the same famous Hieronim the apothecary in his own name and that of his noble wife reserved for himself and his successors and possessors of the aforementioned tenement house the free possibility and power of redeeming the rent, so that if and when they wish, they may do so, albeit with the special knowledge of the aforementioned mansionaries then being, as well as the Lviv council office, having care in this measure, etc.
To which Gabriel Rozen, the receiver, and at his request and order to the same noble, the below-written receivers at that time could deduct, give, and hand over those four hundred florins to some well-settled Lviv burgher, possessing free and clean property corresponding to the aforementioned value, so that they may possess peacefully and safely, and for themselves and their successors pay the payment of the said rent of twenty-four florins in the installments and terms described above to the said venerable mansionaries, voluntarily and willingly accepting and acknowledging on their immovable property, and binding and subjecting these very properties to this exchange and quarterly payment, so that in this way the divine worship of celebrating the Office of the Blessed Virgin Mary and masses for the glory of the Divine Majesty and the glory of His Nobility may never be taken away from the aforementioned venerable mansionaries and the same council office for all time. And if the aforementioned famous Hieronim the apothecary or his successors do not do this, the aforementioned tenement house of his and those who inhabit it as possessors will always pay the said rent of twenty-four florins in four annual installments and will remain obliged until they or their successors are freed from this first obligation. Moreover, all damages and expenses and necessary costs, as often as they neglect to pay the said rent in the installments and terms, they shall return to the same mansionaries and shall be obliged to pay to those then being, without taking an oath and without any proof from witnesses by judicial assessment or the verdict of trusted men, but in this measure they will be forced to believe and trust the simple word and bare assertion of the said mansionaries or one of them without objection.
Also the aforementioned noble Gabriel Rozen, the generous giver and collator of the said sum of four hundred florins for the perpetual rent, openly, voluntarily, and willingly in the presence of the aforementioned famous Hieronim Wedelski the apothecary, for himself and all his descendants and common successors, for a more credible confession asked the council office that the office of provisors and executors by reason of paying this kind of annual rent and by reason of transferring and transporting this same sum under the same condition of paying the rent to the possessors of another tenement house of a well-settled Lviv burgher, if the need should arise, as expressed more broadly above, take upon themselves out of love for the glory of God and apply diligent care so that Hieronim Wedelski and his successors, or the possessors of the said tenement house, pay the rent [...], that we accept out of love for God's glory, and diligently strive that the payment of this rent is never neglected by any action, nor that as a result of neglect (from which may God preserve) the payment of the sacrifice of God's glory and the singing of the Office of the Blessed Virgin Mary in the same metropolitan church by the said mansionaries cease. Indeed, because the said rent-paying tenement house is subject to municipal jurisdiction, as often as the venerable senior of the mansionaries reports to the office about the neglected or refused payment of the said rent and files a complaint, so often we shall force the possessor of the said tenement house, whoever he may be, to pay the same rent after legal summonses under the penalties provided by law, and our successors shall force and shall not cease, but shall order to proceed until he pays the entire withheld rent in full. To which, by the power of administering justice by my office by reason of the unpaid rent, the aforementioned famous Hieronim Wedelski the apothecary for himself, his wife, and common children openly and voluntarily consented, subjecting himself and his successors in the fullest form of obligation. In witness of which the municipal seal was pressed. Done in Lviv on Wednesday after the feast of the Most Holy Trinity, in the Year of our Lord one thousand five hundred and ninety-two. Andrzej Mądrowic, municipal scribe”.
The wording of the obligation of the honest Anna, wife of the noble Hieronim Wedelski, apothecary and burgher of Lviv, is as follows and follows:
“Councilors of the City of Lviv. To all together and to each one individually whom it concerns, by these presents we make known. That before our council residence personally appeared the honest Anna, lawful wife of the once famous Hieronim Wedelski called Wytembergier, apothecary and burgher of Lviv, in the presence of this same husband of hers, being sound in mind and body, unforced, unconstrained, nor misled by any error, through the honest Marcin Staniszowic, a prudent zither player, guardian for this action chosen with the consent of her husband, openly, publicly, and voluntarily testifying, expressed her consent to the entry made by her aforementioned husband before this same office on Wednesday after the feast of Corpus Christi of the previous year, regarding the debt of four hundred florins received and taken from the noble Gabriel Rozen, and the sale of the annual rent of twenty-four florins of Polish coin and count, payable annually in certain installments to the said mansionaries of the metropolitan church of Lviv, secured on the tenement house here in Lviv next to [...] Wilkowa on the corner going to the church of Corpus Christi. Thus, in the part of her marital share, she approves the aforementioned entry, as if she herself were present, acknowledging the future obligations of her husband, with all points, clauses, and conditions fully and completely approving and making legally binding forever, in the most perfect form of consent and approval of the entry. In witness of which my seal has been pressed to these presents. Given in Lviv on Thursday after the Sunday Exaudi next, in the Year of our Lord one thousand five hundred and ninety-three. Andrzej Mądrowic, municipal scribe”.
When this document was presented, read, and accepted before us, the same aforementioned donor asked with great insistence that we deign to approve, confirm, ratify, and assign and incorporate into the ecclesiastical liberty and immunity by our ordinary authority the said donation of four hundred florins together with the document of the said perpetual redemption rent and all its clauses, points, and details.
We, however, relying on common law and ancient custom, [...] summoned all and individual who thought they had any direct or indirect interest, jointly or separately, in the usual form to summon and set a firm and final term for seeing and hearing the execution of the above, the confirmation and strengthening, which was requested. In which term and date of these presents, when the aforementioned noble Gabriel Rozen appeared before us [...] presiding for judging cases and administering justice, after charging the non-appearance of those alleged heirs or debtors after a fourfold and legal summons, the said donor earnestly begged and demanded that that donation and the document of purchase of the perpetual rent be accepted, strengthened, confirmed, and declared by us as belonging to the immunity by ordinary authority [...].
We, Jan Dymitr Solikowski, Archbishop, mindful of those magnificent, and above all pious and generous donations, [...] and after waiting more than the usual hour for those not appearing and considered recalcitrant, in their absence to the same lord Gabriel Rozen [...] the aforementioned sum of four hundred florins mentioned above and the entire document of purchase, legally and prudently drawn up, with all its points, clauses, and conditions, by our authority [...] we assign and incorporate into the liberty and immunity of the Church by this decree. Ordering the servants of the altar, as well as the aforementioned venerable mansionaries then being, that they fulfill all this and individual [...] diligently and piously for present, future, and eternal times.
In witness and open testimony of all the above described, our seal as well as that of the aforementioned lord Gabriel [...] with his own handwritten signature has been appended to these presents. Done and given in Lviv, on the tenth day of the month of December, in the Year of our Lord one thousand five hundred and ninety-three, in the presence of the venerable Stanisław Ziernicki, dean, Wojciech Czyrlicki, provost, Bartłomiej Ryz[?]onowiusz, canons of Lviv, and witnesses of the above. And I, Bartłomiej Ryz[?]onowiusz, canon and public notary of Lviv.

[Signature of the issuer:] We, Dymitr Solikowski, Archbishop of Lviv, by our own hand.

Parchment document in Latin. The parchment has a significant tear/loss of text in the lower part (touches the last few lines above the seal). It contains a transumption of two entries from the council books of the city of Lviv: 1) from 1592 (Wednesday after Trinity Sunday) regarding the entry of Hieronim Wedelski, apothecary; 2) from 1593 (Thursday after Exaudi Sunday) regarding the consent of his wife Anna. At the bottom, a seal hanging on a green-pink silk cord is preserved in a metal (tin) case, belonging to the donor Gabriel Rozen (in the field a coat of arms with the initials G R). The document is signed by hand by Archbishop Jan Dymitr Solikowski and Gabriel Rozen of Rożnow. On the verso, numerous chancery and archival notes from various centuries.
