Foundation and endowment act of the Boim Chapel in Lviv by Jerzy Boim and his family
Lviv councilor Jerzy Boim, together with his wife Jadwiga and his family, allocates the sum of 2100 florins invested in Lviv townhouses to endow the Chapel of the Holy Trinity and the Passion of Christ, which he founded at the cathedral cemetery in Lviv. The document defines the right of patronage, the principles of fund management, the duties of four priests led by a senior, the order of services, and the right of burial.

IN THE NAME OF THE LORD, AMEN.
IN ETERNAL MEMORY.
Since all deeds of mortals, due to the various and uncertain turns of time and the highest mutability of things, not only undergo change but also mostly perish and fall into oblivion, therefore, thanks to prudent human foresight, a way has been found to preserve them with signs and monuments of writing.
Therefore I, JERZY BOIM, of HUNGARIAN nation, of the rank and dignity of LVIV COUNCILOR, considering this in my heart
[f. 3v:]
considering and desiring to increase the worship of God in this City, in which the Lord has anticipated me with His blessings and endowed me with both well-bred offspring and prosperous wealth, I have erected a Chapel on the edge of the Lviv Cemetery, and having erected it, to the glory and fame of the Most Holy and Indivisible Trinity, as well as to the salutary memory and constant remembrance of the Passion of JESUS CHRIST, our Savior, and also to the honor of the immaculate Mother and Virgin MARY, as well as the Saints PETER and PAUL, princes of the Apostles, GEORGE the Martyr and glorious, NICHOLAS the Bishop and famous Confessor, MELCHIOR the King of Sheba and worshiper of the cradle of the little CHRIST, as well as Saints CATHERINE and DOROTHY Virgins and Martyrs, HEDWIG, ELIZABETH and MARCELLA widows, as patrons of mine and my dearest wife, as well as my children and sons-in-law, I have dedicated and provided and decorated with sufficient, as I believe, holy apparatus.
The endowment of this same Chapel, together with my dearest wife HEDWIG NIŻNIOWSKA, from a portion of our property generously granted to us by Almighty God, and with the kind advice and consent of my relatives and kinsmen, as well as my friends, and furthermore with the fatherly blessing and approval of the Most Illustrious and Most Reverend Lord, Lord JAN ANDRZEJ PRÓCHNICKI of Próchnik, by God's grace Archbishop of Lviv and of the Sieciechów Abbey
[f. 4r:]
eternal Administrator, I henceforth donate, give, assign, and for eternal times grant and record.
Firstly, in my name and my wife's, One Thousand and Fifty florins of the currency circulating and common in the Kingdom of Poland, with another One Thousand and Fifty gathered into one in the following manner. That is, which with Three Hundred florins the recently piously deceased in the Lord, the Reverend Lord WALENTY WARGOCKI, Dean of Lviv, led by a certain special and peculiar devotion to the life-giving Passion of CHRIST the Savior, bequeathed in his will to this Chapel, and the executor of his last will, the Reverend Lord TOMASZ PIRAWSKI, also Dean and General Official of Lviv, placed and handed over into my hands the same [money]. Added to them were also Forty florins, which accrued from the rent of two years that passed from their payment until the very day of the Dedication.
Next, also with the sums that my offspring generously contributed to such a pious work.
My dearest son PAWEŁ BOIM, Doctor of Medicine: Two Hundred and Ten florins.
The Honorable MELCHIOR SCHOLC WOLFFOWIC, Lviv juror, my son-in-law: One Hundred and Seventy florins.
CATHERINE, my daughter, formerly the wife of ZYGMUNT BRESLER: one hundred and ten florins. Another son-in-law of mine, the Illustrious MIKOŁAJ SCHOLC WOLFFOWIC: one hundred and ten florins.
MIKOŁAJ MASSARI, also my third son-in-law,
[f. 4v:]
he also contributed one hundred and ten florins.
And those said sums, forming the full sum of two thousand and One Hundred, are formally secured on these properties: Six Hundred and Fifty florins on the townhouse of the Illustrious SZYMON BUCZKO, furrier, and MAŁGORZATA, his wife, on Zarwańska Street, between the townhouses of WAWRZYNIEC ŁOPIANEK, carpenter, on one side, and WOYNAROWSKA on the other, under the act of the Year of the Lord One Thousand Six Hundred and fifteenth, on the eve of the Feast of BLESSED MARY MAGDALENE. And Five Hundred florins on the townhouse of the Illustrious JAKUB KOŚNIKIEL, furrier, and KATARZYNA SOKOŁÓWNA, his wife, on Piekarzy Street, next to the townhouse called TURSKA on one side and on the corner towards the monastery of the Franciscan Conventual Friars Minor on the other, under the act of the Year One Thousand Six Hundred and fifteenth, on the Saturday after the feast of Saint FRANCIS.
The remaining sum of Nine Hundred and Fifty florins [was bequeathed] by the Illustrious Lord MELCHIOR SCHOLC on his townhouse between STAŃCZLEWSKA on one side and KASPER JÓZEFOWICZ on the other, under the act of the Year One Thousand Six Hundred and fifteenth, on the Saturday before the feast of Saint MARTIN.
Since, therefore, the sum of two Thousand and One Hundred florins gathered in this way, counting seven for every hundred, makes One Hundred and Forty-seven florins of rent, by our common advice and consent of all, we decide and order that this rent, when the time of payment marked and expressed in the records arrives, be collected by the Senior Priest of the said Chapel, and from the collected and received [amount] he has the right of issuing receipts
[f. 5r:]
to spend.
And so that the payment of this rent may never cease or be interrupted, and thus, God forbid, the neglect of God's worship does not occur, we diligently stipulate from now on that whenever there is a need to transfer the above-mentioned sum of two Thousand from place to place, whoever wishes to accept it withdrawn from elsewhere for redemption rent, shall be strictly obliged, whenever he wishes to return and give it back in the future, to be absolutely obliged and forced to make a notice of the future return of money half a year in advance. This notice should be made to the Patrons assigned to this Chapel; otherwise, if he were to neglect this, he will not be able, nor in any way will he be able to issue the said sum otherwise than after the lapse of another half-year, and this is so as not to give cause for interrupting and neglecting the glory of God.
We also stipulate that whenever there is a need to transfer these sums from place to place, the Patrons should do so with the utmost care and take the most diligent heed to invest them anew in free, and not encumbered, properties. With the addition also that for its acceptance, priority over other strangers will be held by anyone from my family, provided only that he can secure and insure it on sufficient properties. Similarly, if anyone from my family were a Priest, he should have, in case of a vacancy, the first and main right to obtain the provision of that Chapel.
Regarding the right of Patronage, by the common unanimous will and consent of us all, we decide and order: that as long as God gives me life, it shall remain in an intact state with me. After my departure from this life, it shall pass to my Son PAWEŁ as the main heir and to the male grandson, firstborn from my daughter MARCELLA,
[f. 5v:]
and with both, as long as the male line born from their loins shall last, it shall remain. If it were to expire, from which God preserve, then the right of presentation shall pass to the remaining male and female successors of my daughters equally by degree. If even these were to die out and no one from my offspring remained alive, then in the final instance let it pass to the Venerable Chapter together with the Illustrious Lviv Senate. Whom I ask, by the bowels of the mercy of GOD, that out of love for God's glory and Christian duty they do not shy away from this labor and care, but that the Venerable Chapter watches that the Priests worthily and diligently perform their services and apply themselves to them. And let the Illustrious Lords Councilors strictly punish the negligent Collators and other strangers who in any way hinder this foundation of mine.
Now, as for the Priests, I make the following order with the consent and will of the above-mentioned Most Illustrious and Most Reverend Lord Ordinary of the Place.
Firstly, I want there to be four of them permanently, among whom, according to the discretion of the Patrons, a senior shall be appointed, and upon appointment, let these roles and duties be entrusted to him:
That in everything pertaining to the good management of the Chapel, his authority and prerogative shall be first, and in this, the other Priests are to be obedient to him and respect him as their senior.
It will be his duty to ensure that services are performed properly. He shall note the negligence of the Co-priests and report them at the Quarterly meeting, which meetings cannot be missed in any way, as in all
[f. 6r:]
assemblies they are necessary, where he shall also account for the expenses made for the needs of the Chapel.
He will keep the keys to the Chapel with him and will have the right to open and close the Chapel. The keys to the Archive shall be kept by the Senior and one of the Collators, to whom alone also belongs the care of satisfying the needs regarding church apparatus.
For the quarterly Masses for the Dead and meetings, he will summon all from the Founder's family a day earlier through a Servant. If they, not being hindered by any very important matter, neglect to appear, let them establish a law for themselves and set a penalty to which they are to be subject.
The holy apparatus shall also be under his authority, guard, and care; he should store them, as is fitting, cautiously and in order, and carefully put them away, not allowing them to be hidden in their place in any way, but so that every thing, large or small, is in its place and lies or hangs in the proper manner.
Finally, it will be his duty to decorate the Chapel on feast days, dress and undress the Altar, and according to the seasons and Feasts, select appropriate colors of antependia and chasubles.
Therefore, of the two Inventories of holy apparatus, vessels, and all chapel equipment, the senior shall keep one with him, and the Patrons shall guard the other.
To all foreign Priests arriving to celebrate [mass] in my Chapel, let all necessary things be provided with the utmost love and readiness of heart.
Regarding this holy apparatus and all other equipment intended for the service of God and assigned to the Chapel
[f. 6v:]
I establish this law, that it is permitted to no one at all – not only to a Priest, but even to the Patrons themselves, and all the more to others of my family – to take out of the Chapel even the smallest thing as a loan or for use, and this under the threat of God's wrath.
The Senior Priest of the Chapel, after collecting or enforcing the rent coming, as said above, from the two thousand and one hundred [florins], shall divide it in the following manner. Namely: for himself and for the three other Co-priests, for each Ember Days [Quarter], he shall pay seven and a half florins each, so that each of them receives thirty florins annually, and all together one hundred and twenty.
The Senior of the Chapel, by reason of his offices described above, in addition to his share equal to others of thirty florins, shall take furthermore five florins from that same remainder.
The common offerings and trays shall serve the same Priests, with the exception of the quarterly collection of my relatives, of which mention is made above.
From the remainder of the rent, twenty florins shall be turned to wine, wax, the cleanliness of things made of linen, and other small needs of the Chapel, about which he will consult with the Collators, who, if something is missing, will supplement it from their collections.
To the three Boys, whom the Rector of the School will appoint, three florins shall be paid for each Ember Days; they will assist the Priests in singing Masses.
Regarding
[f. 7r:]
the dwellings, of those three, of which one is already arranged above the dwelling of the Altarist STANISŁAW MAŁDRZYK opposite the Jurors' benches, and two above the Infirmary of the Students and the dwelling of the Bell-ringer: we designate the more comfortable one for the senior, the second and third for the next in order of seniority of their appointment to service in the Chapel. And for one, we ourselves will take care in time or our successors will take care.
After these provisions and arrangements, I proceed to prescribing the duties of the Priests.
And first, I command them that every day the Office of the Holy Cross with Antiphons and Prayer, immediately after the Mass in the Greater Church, the Mansionaries shall sing in one continuous flow, clearly according to the hours, with gravity and piously in surplices – with the exception of the Easter period, Christmas, and the three feasts of Pentecost together with their Octaves only, as well as Feasts solemnly celebrated by the people – in accordance with the Office deposited by the Patrons in the Archive, written on parchment.
After singing this Office, every day they shall celebrate and perform Masses in each Week in this manner and order:
On the Lord's Day: on the occurring Sunday or Feast, read.
On Monday: for the faithful Departed, both those resting in the place of the Chapel and elsewhere, and deprived of certain intercessory prayers, buried and resting at any time, and most of all for the Founders, read.
[f. 7v:]
On Tuesday: of the Most Holy and Indivisible Trinity, read.
On Wednesday: a sung Mass for the deceased Founders and their and the Chapel's benefactors and relatives.
On Thursday: of the Most Holy Body of our Lord JESUS CHRIST, read.
On Friday: one sung Mass with the passion performed in the tone of the Gospel, the second for the Dead for the soul of the late Reverend WALENTY WARGOCKI, Dean of Lviv, as a benefactor of this Chapel and participant in the foundation.
On Saturday: two read Masses – one in the larger Chapel of the Most Holy Virgin MARY, the second in the smaller, where is the rest in the Lord of the children of the family, of the Holy Guardian Angels of my family and my relatives and kinsmen. Regarding the solemnities and the service of Holy Week, the Senior will consult with the Collators; however, they will be obliged, according to the order that falls on a given Priest on Good Friday, to sing with gravity and solemnly the passion according to St. JOHN immediately after the sermon. Furthermore, these same Priests during indulgences will assist the celebrant at services in surplices for the greater splendor of the Chapel and the dignity of the indulgences.
These same Priests shall annually sing an Anniversary for my soul with vigils of nine readings on the eve and a Mass for the Dead on the 22nd day of the month of September, as well as for the soul of my dearest wife, when she departs from this world, with the observance of the day of her death.
In these
[f. 8r:]
all Masses, the celebrating Priests should always have special remembrance of me and my loved ones, both living and dead.
Finally, on every Ember Days, they shall perform and sing a service for the dead, having summoned to it all from the family, as decided above, through the Senior's boy. After its beginning, the celebrating Priest after the Gospel will mention from the Register the names of the deceased from my family and encourage those present to pray to GOD for their souls.
After the completion of this service, all together and each individually from my family, men and women present, according to their pleasure and good will, shall make a donation for the emerging needs of the said Chapel and at the same time shall conduct an inspection of the holy apparatus and equipment in both Chapels, and if they notice that something is missing, they shall look for the perpetrator of the damage; if they see something unclean, they shall immediately order it to be cleaned, and if torn – to be repaired. They shall not fail to note new acquisitions and increases in property, if they should happen. The chest, both for voluntarily collected donations and for money serving the needs of the Chapel, as well as for storing the act of foundation and other documents, they shall keep in the Archive, secured with two keys, of which one shall be kept by the senior Priest, and the other by the oldest of the Collators. Finally, they shall diligently watch that in nothing that pertains to the preservation of the original state of this Chapel, any detriment or diminution occurs.
Finally, the right of burial in this Chapel of mine shall be held by all of my family born and to be born, and they shall rest together with me, awaiting the great day of the Lord. Similarly, the Priests serving the Chapel and who died in its service.
To which also the Honest KATARZYNA BARSZCZOWA together with
[f. 8v:]
together with other Parents, her husband, her son MIKOŁAJ, as well as to all intercessory prayers established and founded in this same Chapel, I admit, and this both by reason of the mutual kindness that we cultivated during life, and because she also, out of her generosity, recorded in the City Acts of the Year of the Lord 1609, on the Saturday on the eve of the Holy Apostles PETER and PAUL, a Redemption rent in the amount of ten florins on her part of the GRACZOWSKA Townhouse and added it to the endowment of this Chapel, obliging herself and her successors to pay it or redeem it with the sum of one hundred florins. Now, however, as long as she is still alive, as long as she shall live, my dearest son PAWEŁ BOIM, Doctor of Medicine, undertakes to pay this sum of redemption rent every year from his properties.
This foundation of mine, therefore, all and each of my successors, as pious and by no means degenerate offspring of mine, my shoot and my blood, let them most holily guard, preserve, maintain in all points and clauses, and let no one dare or attempt to violate, diminish, or subtract anything from it in the slightest degree under the penalty of eternal damnation and under God's vengeance, but according to their piety and love for GOD and honor for their ancestors, rather let them strive and endeavor to multiply and expand it, to the glory and fame of Almighty GOD the FATHER, and the Son, and the Holy Spirit. Amen.
For the undoubted faith and stronger weight of all these things, this foundation letter was signed by the hand of my dearest son for me and for himself as well as my sons-in-law and sealed with both my seal and theirs. GIVEN IN LVIV, 1 AUGUST OF THE YEAR OF THE LORD 1617.
