Entry by the city councilors of Lwów of the foundation of a hospital prebend in Bełz by Fr. Marcin Strykowski

COUNCILORS OF THE CITY OF LWÓW To all and singular whom it may concern, and who shall receive knowledge of this letter, we announce that having appeared personally at a full session of our Council Office, the most reverend father Marcin Strykowski of Leżajsk, acting presbyter and provost of the Bełz hospital – with the approval of the local Lwów civil forum, insofar as it relates only to this act, in the personal assistance of the honest Andrzej Czeczotowic, sworn juror of the same city, taken as his guardian – openly, voluntarily, and kindly showed and presented the foundation of the prebendary at the church under the invocation of the Most Holy Trinity located at the Bełz hospital, erected and founded by himself, and made and recognized before the office and in the acts of the Chełm consistory, and authentically issued from the said acts of the Chełm consistory, sound, whole, intact, and free from any suspicion, asking that the same foundation be accepted, read, received, and entered into the acts of this office in the following wording. The wording of the foundation letter: Done in Krasnystaw on Friday after the Lenten Sunday of Oculi, in the year of our Lord 1625. Before the most reverend lord Jan Ołdakowski, dean and official general of Chełm, in the presence of the most reverend and venerable lords: Jakub Pieckoszewic – ordinary preacher, Kasper Gissowski – canon of Chełm, Jan of Kospuza – senior, Stanisław Kośmider, Kasper Wolbozy, Jan Kłobacki – cathedral vicars of Krasnystaw. Appearing personally before this office and the acts of the present consistory, the most reverend lord Kasper Gissowski, canon of Chełm, on behalf of the most reverend father Marcin Strykowski of Leżajsk, provost of the Bełz hospital under the invocation of the Most Holy Trinity and the holy Apostles Peter and Paul, presented and showed to this office the letter of foundation of the prebend newly drawn up by the same provost in the Bełz hospital church of the Chełm diocese, signed by the own hand of the same provost the founder and the famous lord Bartłomiej Jaklihowic, bachelor of liberal arts and philosophy, by the authority of the holy apostolic public notary, and strengthened with the separate seal of the same provost, sound, whole, intact, and raising no suspicion, asking for its entry into these acts. This office, having seen these letters as authentic, accepted them as a true foundation and ordered them to be drawn up and entered into the acts. The wording of which word for word follows and is as follows: In the name of the Lord, amen. For the eternal memory of the thing. I, Marcin Strykowski of Leżajsk, acting presbyter, provost of the Bełz hospital, long under the invocation of the Most Holy Trinity, after mature deliberation, wishing to anticipate the final day with all deeds and to care for the salvation of my soul and my deceased parents, led by the zeal of spreading the greater glory of God in the Bełz hospital church, for the glory of God Almighty and the holy Apostles Peter and Paul, I decided to erect and found a prebend in the same Bełz hospital church, subject to the approval of the most serene and most dignified father and lord, lord Maciej Łubieński, by the grace of God and the Apostolic See bishop of Chełm, and I ordered and arranged as follows: Firstly, as an endowment by way of remuneration and annual provision for the prebendary or altarist, I endow and designate fifty florins of Polish currency, counting each florin at thirty Polish groschen, of annual reemptional rent (reemptionalem Töyderkaff), perpetually purchased for the sum of six hundred Polish florins, calculated by me in cash, secured on the townhouse, or rather two plots of the famous Adam Smolski in the city of Lwów on Krakowska Street, situated and lying between the townhouses of the famous Walenty Strykowic and Krzysztof Bierath, on both sides, transferred to him in the acts of the office and testimony, as evidenced by the record of the Lwów Council Office. Similarly, another reemptional rent of twenty florins for the sum of three hundred Polish florins on a townhouse in Lwów on the street called Zarywańska, sold and recorded in the current year before the Lwów municipal acts by the famous lord Jerzy Sedoli, citizen of Lwów – a more extensive record of this shall belong for eternal times to the same prebendary. I also give and designate for eternal times to the same prebendary and his successors a farm on the land of the city of Bełz, by the mud and the bridge called Sokal towards the village of Przemysłów, as it has long existed within its boundaries and borders, with fields, meadows, lands, houses, gardens, thickets, formerly of Bieniowski, bought for my own money and testified in the wójt-juror acts of Bełz. The same prebendary shall have his dwelling in a house with two rooms newly built on the hospital land near the church towards the orchard, with a garden adjacent to the same house. For which hospital land, in exchange, I assign and donate to the same Bełz hospital for eternal times a garden with an orchard in the Bełz suburb by the street called Kniazia, next to the farm of the same Bełz hospital, bought by me from the then lady Krystyna Wilska, as recorded more extensively in the Bełz juror acts. With the reservation that this prebend may be held only by an acting presbyter, canonically and legally established, and he may not hold any other ecclesiastical benefice along with it (except for preaching in the Bełz parish, if he himself wishes and is legally called to it); if the same prebendary were to obtain any other benefice besides this, the said benefice shall by the law itself (ipso facto) – after a prior declaration issued by the most dignified lord ordinary present and acting at the given time – become vacant. Furthermore, the said prebendary should never depart or leave from there, unless for his own just causes and pressing necessity, and that upon obtaining the consent of the lord provost of the hospital and after revealing to him the reason for which he would necessarily have to depart or leave. If he does not return within one month, or at most two, he should by that very fact be deprived of the said prebend, so that for the very reason of his absence for a whole month or at most two without a legally proven cause, the below-signed patrons shall have the right to present another suitable priest for this prebend. And since a benefice is given because of a duty, I decide and order that the prebendary or altarist, by virtue of the said foundation, for the glory of God Almighty and for the rescue of the salvation of my soul and my loved ones, shall celebrate masses twice every week: the first on the Passion of the Lord on Fridays, with a collect for the benefactors, in the Bełz hospital church at the high altar or another serving the Confraternity of the Compassion of Christ, he is to sing along with a sermon (exhortatio) directed to the people. The cantor and organist, who will sing masses together with the youths from the parish church, shall have a perpetual rent by way of annual remuneration from the garden in the Bełz suburb by the street called Kniazia, called Chwastowski, with the house and all appurtenances long belonging to this plot, bought by me for the same cantor and organist, as evidenced by the record in the Bełz municipal acts. The second mass for my deceased parents, and after my death for me the founder, he shall be obliged to read on Wednesdays of every week in the Bełz parish church at the altar of St. Anne for all future times. To ensure this order is fulfilled, I entrust and assign the power of watching over the prebendary to the lord provost of Bełz each time acting and to the provisors, literate citizens of Bełz. If the said prebendary proves sluggish and negligent in his service, and neglects to celebrate any of the above masses in any week, not being hindered by illness or other grave necessity, then as often as he misses a mass through his negligence, he shall be punished with a fine of six groschen, which fine for each neglected mass is to be turned to the use of the poor of the same hospital, with the knowledge of the provisors and the provost of the hospital. As for the apparatus, vestments, chalice, and other things necessary for the celebration of this holy mystery, all these apparatuses were acquired during the time of my provostship and serve the hospital church; furthermore, wine, candles, and hosts (oblata) should be willingly provided to the prebendary by the lord provost without any difficulty. Furthermore, I want the same prebendary, in my absence or that of my successors or for any other reason requiring it, to administer the sacraments to the poor of the hospital and to the servants and subjects belonging exclusively to the hospital church, to hear confessions, and in all that is decent and honest to show obedience and respect, as befits, to me and other succeeding provosts. If (which God forbid) he proves disobedient, rebellious, incorrigible, and scandalous, after proof of his disobedience and transgression, he shall be deprived of the prebend itself, and in his place another priest shall be presented by the below-signed patrons, to be installed by the most dignified lord ordinary of the place. To which newly founded prebend I hereby present to the most dignified and most reverend lord, lord Maciej Łubieński, bishop of Chełm, my most gracious lord, the venerable Wojciech Sliucin of Sokołów, currently a suitable presbyter, earnestly asking that His Most Dignified Paternity deign to establish and invest him, and no one else, in this prebend, and entrust to him the care of souls and the administration of the temporal goods expressed above by the power of this foundation. Which right of patronage I reserve for myself as long as I live, and after my death I give and donate this right of patronage and presenting the prebendary to the famous Lwów magistrate, and transfer it to them completely and fully. In such a way, however, that if they prove negligent in this regard or present a less suitable person, let the most reverend lord ordinary of the place contemporary and acting at the given time have the full right to supplement such their negligence and lack. I humbly ask the most dignified lord ordinary of the place for the approval and confirmation of this my foundation, and for its entry and registration in the acts of the diocesan consistory. In testimony of all these matters, I have signed this letter with my own hand and affixed my separate seal. Given in the Bełz hospital house, on the Sunday of Exaudi in the year of our Lord 1622. We, therefore, the councilors, have read and accepted the presented foundation letter in its durable form shown by the most reverend father Marcin Strykowski of Leżajsk, provost of the Bełz hospital, and we ordered it to be entered into the acts of our Lwów council office at the just request of the same presenter (considering that public acts should not be denied to anyone), deciding that it should have the power and weight of durability according to the form of law.
