The Metropolitan Chapter of Lwów and the municipal authorities of Lwów approve the sale of the former residence of the provost of the Holy Spirit Hospital to the Jesuits for the construction of a college, and the acquisition of a new tenement house from Kosma Salwago on Szewska Street for the sum of 10,800 Polish florins. The newly purchased building was placed under ecclesiastical immunity, with the reservation of the inviolability of the city's and chapter's patronage rights and a prohibition on operating a tavern or crafts within it.

IN THE NAME OF THE LORD, AMEN. For the eternal memory of the matter. We, the prelates and canons of the metropolitan church of Lwów, together with the most reverend Józef Przeczkowski, provost of the same church and the Holy Spirit Hospital, annexed and incorporated into the metropolis, who at that time held this provostship on behalf of the distinguished magistrate of the metropolitan city by virtue of their patronage, and at the same time we also, the mayor and councilors of the city of Lwów, as the true and legal patrons and collators of the aforementioned provostship, after having previously obtained permission and authorization primarily from the ordinary of the place, of blessed memory the most illustrious and most reverend Lord Jan Zamoyski, our bishop, and now for the same act, after having received from the most illustrious and most reverend Lord Jan Andrzej Próchnicki, by the grace of God and the Apostolic See, Archbishop and our pastor of Lwów, the most venerable, the approval of that permission and authorization in the present matter: we all jointly and severally acknowledge and make known to all and each one individually, whom it concerns, present and future: That since the Most Holy and Most Serene Royal Majesty, our most gracious lord, led by the zeal of piety for the increase of divine worship and for the founding of a seminary and the education of youth, conceived the intention of erecting in this city a college of the reverend fathers of the Society of Jesus, caring for the proper convenience for the same college in erecting buildings for the church, schools, and residential quarters, already several years ago by certain means decided to buy for them several burgher houses directly adjacent to their own residential house, connected and located in the quadrangular perimeter of one street or square. Among which houses was also the house intended for the residence of the reverend priest provost, over time, through the efforts of the distinguished council magistrate, our ancestors of this city, brought to a better state. Therefore, fulfilling as is fitting such a pious and most magnificent intention and will of the Most Serene King and our most gracious Lord, for the expansion of God's glory in the same city, and also giving heed to the request of these reverend fathers and the intercession of many most illustrious and distinguished lords, senators, and dignitaries of the kingdom, we have sold and ceded for this reason to these reverend fathers of the Society of Jesus, by the power of mutual agreements and rights belonging to us regarding this provostship, the aforementioned house together with the entire square, located opposite the Holy Spirit hospital church, on one side next to the former corner old school, and on the other side next to the wooden corner house of the heirs of the late Jan Kamieński, in accordance with the deed of sale drawn up and acknowledged in the presence of a public notary by virtue of our agreed and unanimous will. Next, after mutual consultation, by the same effort we concluded a contract with the famous Kosma Salwago, a burgher of Lwów, for the purchase of his house, which in the same city on the street called Szewska is located at the corner towards the residence house of these fathers, next to the house of Jan Kałuski, a surgeon, for which we paid and laid out to the same Kosma entirely the same price as and how much we received from the contract from these fathers of the Society of Jesus, in the sum of ten thousand and eight hundred florins of Polish currency, and this is in accordance with the entry in the council records more broadly stating about this matter. Since, however, such a contract of purchase could not be otherwise concluded and finalized, except after summoning and with the consent and knowledge of the burgher Forty Men, representing the entire commonalty of the city, especially for the reason that it was necessary to remove the said house from the municipal jurisdiction and transfer it under ecclesiastical immunity, therefore with the knowledge and consent of these Forty Men, we, the councilors, expressed our consent and permitted that transfer of the aforementioned house under canon law and ecclesiastical immunity, under explicit conditions and reservations agreed upon with the most reverend provost himself and arranged with the entire Venerable Chapter: First and foremost, that the rights and decubalia of patronage, which the city and the prelates and canons jointly possess, established and confirmed by the Most Holy Royal Majesty regarding the aforementioned provostship, whenever it becomes vacant, for conferring it upon one of their own, should be inviolable and preserved forever in all use by our side, and this purchased house should serve the same most reverend provost, present or at the given time being, for residence and for his free use, just as the former one served, sold to the reverend fathers of the Society of Jesus. Always, however, so that the provost for the time being in office would not dare of his own will to exchange it with anyone, sell, rent, or in any way alienate it to persons of any condition and status or allocate it for any purposes, unless it happens with the will and consent of the Venerable Chapter and the lords councilors for the time being in office. Nor should he ever allow in this house, whether in whole or in any part of it, the operation of a tavern for any drinks or the performance of crafts; nevertheless, this house should enjoy the same immunity as that old house enjoyed. If in the course of time, for a more peaceful and comfortable residence of the same most reverend provost, another tenement house could be acquired, especially closer to the metropolitan and hospital church (provided that mutual consent for its acquisition is expressed by both the most reverend provost and the entire chapter together with the then municipal magistrate), then this same most reverend provost or those who succeed him will resign from this house, which is meanwhile being bought from Kosma, back to the city or anyone who acquires it; and let him accept it by way of exchange. But if it were acquired for a lower price, then whatever is missing from the price obtained for the old Kosma house, then by joint consultation and effort, both of the chapter and the council, it should be allocated for a perpetual rent (wyderkaf) in order to increase the prebend of the same most reverend provost. To all this and individual points, in the above manner agreed and settled between us, primarily the most illustrious and most reverend Lord Archbishop himself graciously expressed his consent, and while maintaining the need to obtain the confirmation of the Most Serene Royal Majesty, our most gracious lord, with his pastoral authority he also approved and ratified this in its entirety. We, whom this matter concerned, in our good faith promise and by this letter solemnly and ceremoniously pledge that we will preserve, observe, and fulfill all this and the individual points expressed above, unshaken, constant, and accepted, with the exclusion of all deceit and fraud, for all eternity. Done in Lwów in the house of the Venerable Chapter of the lords prelates, in the presence of the appointed deputies of the council magistrate, on Wednesday before the Sunday of Oculi in Lent next, in the Year of Our Lord one thousand six hundred and twenty-six. In the presence of the most reverend lords: Łukasz Kaliński, bishop-elect of Nicopolis, suffragan, dean; Józef Przeczkowski, provost; Jan Baranowski, archdeacon; Melchior Ogbłowski, custodian; Jan Solikowski, Piotr Brodowski, Jakub Skrybiszowski, Wojciech Belczyński, preacher, Melchior Stephanides, prelates and canons of the metropolitan church of Lwów. As well as the distinguished and eminent: Wolfgang Szolc Wolfowicz, Erazm Syxt, doctor of philosophy and medicine, then mayor, Marcin Kampian, Paweł Dominik Hepner, doctors of philosophy and medicine, Melchior Wolfowicz, Jan Alnpek, Bartłomiej Uberowicz, Paweł Boim Dziurdzi, doctor of philosophy and medicine, Hieronim Waydolt, Mikołaj Siedmiradzki, Stanisław Kuczkowski, Marcin Korzeniowski, doctor of philosophy and medicine, councilors of the city of Lwów. During the happy reign of the Most Serene Sigismund III, by the grace of God King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Livonia, and also hereditary King of the Swedes, Goths, and Vandals, our most gracious lord, reigning in the kingdoms: in Poland the thirty-ninth, and in Sweden the thirty-third year. For greater credibility of all the above things, seals have been affixed. Done and given in Lwów on the seventeenth day of the month of March in the Year of Our Lord one thousand six hundred and twenty-six.
