Agreement between the Cathedral Chapter and the Lwów City Council regarding the purchase of the hospital provost's house
The document confirms an agreement between the Metropolitan Chapter and the City Council of Lwów regarding the purchase of the Kosma Salvago tenement house as a residence for the provost of the Holy Spirit Hospital, in exchange for a house sold to the Jesuits, including the exemption of the new property from municipal jurisdiction and its inclusion under ecclesiastical immunity. The act specifies the conditions for managing this property and the rules for maintaining patronage rights and potential future exchange of the building.

IN THE NAME OF THE LORD, AMEN.
For the eternal memory of the matter. We, the prelates and canons of the Lwów Metropolitan Church, together with the venerable Józef Przeszkowski, provost of the same Metropolitan Church and the Holy Spirit Hospital attached and incorporated thereto, who at that time held this provostry by the appointment of the illustrious municipal magistrate by virtue of the right of patronage belonging to it, as well as we, Piotr, mayor and councilors of the city of Lwów, as the true and legal patrons and collators of the aforementioned provostry, having previously obtained permission and authorization primarily from the ordinary of the place, of blessed memory the most illustrious and most reverend Lord Jan Zamoyski, our pastor, and now having received in the same matter the approval of permission and authorization from the most illustrious and most reverend Lord Jan Andrzej Próchnicki, by the grace of God and the Apostolic See the most venerable archbishop and our Lwów pastor, together all and unanimously acknowledge and announce to all and each one individually, to whom it should be known, present and future:
That when the Holy and Most Serene Royal Majesty, our most gracious lord, moved by the zeal of piety for the increase of divine worship and for the establishment of a seminary and the education of youth, intended to found in this city a college of the venerable fathers of the Society of Jesus, caring for suitable buildings for the temple, schools, and residential quarters for the same college and for their convenience, he had already several years ago designated by certain means that some houses of the burghers, directly adjacent to the existing house of their residence, joined and adjoining in the perimeter of one quadrangle of a street or square, be purchased for them. Among these houses was also the house designated by the council magistrate, our ancestors, for the residence of the venerable Mr. Provost and in the course of time brought to a better state.
Yielding therefore, as is fitting, to such a pious and excellent intention and will of the Most Serene King and our most gracious Prince for the spreading of God's glory in this city, and also satisfying the request of the venerable fathers themselves and the intercession of numerous most illustrious and powerful lords, senators, and dignitaries of the Kingdom, for this reason we have sold and alienated to the same fathers of the Society of Jesus [...] and the rights belonging to us to the same provostry, the aforementioned house with the entire square, located opposite the hospital church of the Holy Spirit, on one side next to the former corner school, and on the other side next to the wooden corner house of the heirs of the late Jan Kamieński, in accordance with the deed of sale drawn up and acknowledged in the presence of a public notary by our unanimous and joint will.
Next, after joint deliberations, by the same action we concluded a contract with the famous Kosma Salvago, a Lwów burgher, regarding the purchase of his house, which is located in the same city on the street called Szewska, at the corner towards the house of the residence of the same fathers and next to [the house of] the surgeon Jan Kadzki. For this house, we paid and disbursed to the same Kosma in full the same price, and in the same amount as we received from the contract from the same fathers of the Society of Jesus, in the sum of six thousand eight hundred zlotys of Polish currency, and this is in accordance with the entry in the council records more extensively regulating this matter.
However, since such a contract of purchase could not be concluded and finalized otherwise than after the summoning by the municipal magistrate of the Forty Men representing the entire commonalty of the city, and this primarily for the reason that it was necessary to transfer the same house of the aforementioned Kosma from municipal jurisdiction under ecclesiastical immunity, therefore, with the knowledge and consent of these Forty Men, we, the councilors, for the transformation of the aforementioned house into spiritual law and ecclesiastical immunity, under the following express reservations and conditions arranged and agreed upon with the present venerable Mr. Provost and with the entire Venerable Chapter of the lords prelates and canons, in our name and the name of the city, have permitted and do permit:
That first and foremost, the rights and privileges of patronage, which we hold together with the same venerable lords prelates and canons, mutually established and confirmed by the Holy Royal Majesty – regarding the appointment of the aforementioned provostry, whenever it becomes vacant, to one of their number – shall be perpetually inviolable and preserved on both sides [...], and this house is to serve the same venerable Mr. Provost, present and future, for residence and for his free use, just as the former one, which was sold to the venerable fathers of the Society of Jesus; however, so that the Mr. Provost [...] for the time being shall not dare of his own will to exchange it with anyone else, sell, rent, or in any way alienate it to persons of any status and condition, nor designate it for any purposes, unless it happens with the knowledge [...] and consent [...] of the city for the time being. Nor shall he ever allow in this house, either in whole or in any part of it, the conducting of a tavern for any drinks or the practicing of crafts; it should enjoy the same immunity as that former house enjoyed.
If in the course of time, for the more peaceful and comfortable residence of the same venerable Mr. Provost, another house could be acquired, especially one located closer to the metropolitan and hospital church (provided that the mutual consent of the venerable Mr. Provost and the entire chapter together with the municipal magistrate for the time being occurs for its acquisition), then from this house, which is meanwhile being bought from Kosma, the same venerable Mr. Provost or those who will succeed him shall withdraw back in favor of the city or the burgher acquiring it, and they shall accept the other by way of exchange. If, however, it were acquired for a lower price, then that which will be lacking to the price obtained for the former Koźmiński house [?], by the joint council and effort of both the chapter and the councilors, should be turned into a perpetual rent (wyderkaf) for the increase of the prebend of the same venerable Mr. Provost.
To all this and the individual things arranged and agreed upon between us in the above-mentioned manner, primarily the most illustrious and most reverend Lord Archbishop himself graciously expressed his consent, and with the preservation of the confirmation of the Holy Royal Majesty, our lord, for which we are to strive, by his pastoral authority he also approved and ratified it in its entirety. We, whom this matter concerned, in good faith mutually promise each other and by this letter we holily and solemnly promise to consider all this and the individual things mentioned above as valid, permanent, and inviolable, with the exclusion of all deceit and fraud, to maintain, observe, and execute in practice for all time.
Done in Lwów in the house of the Venerable Chapter of the lords prelates, in the presence of deputies from the council magistrate, on Wednesday before the Sunday of Oculi in Lent, in the Year of our Lord one thousand six hundred and twenty-six.
In the presence of [...] the lords: Łukasz Kaliński, appointed Bishop of Nicopolis, suffragan and dean, Józef Przeszkowski provost, Jan Baranowski archdeacon, Melchior Ostrorowski custodian, Jan Solikowski, Piotr Brodowski, Jakub Skrobibewski, Wojciech Pełczyński preacher, Melchior Stephanioli, prelates and canons of the Lwów Metropolitan Church; as well as the famous and distinguished: Wolfgang Szőcz Wolfowicz, Erazm Syxt doctor of philosophy and medicine, mayor and councilor, Marcin Kampian, Paweł Dominik Hepner doctors of philosophy and medicine, Melchior Czołphowicz, Jan Alembek, Bartłomiej Uberowicz, Paweł Dominik Dziurdź mayors and doctors of medicine, Hieronim Zaydl, Mikołaj Siedmiradzki, Stanisław Kuczborski, Wojciech Korzeniowski doctor of philosophy and medicine, councilors of the city of Lwów.
During the prosperous reign of the Most Serene Sigismund the Third, by the grace of God King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Livonia, and also hereditary King of the Swedes, Goths and Vandals, our most gracious lord, in the thirty-ninth year of his reign in the Polish Kingdom, and in Sweden the thirty-third.
For greater credibility of all the above things, seals have been attached. Done and given in Lwów on the seventeenth day of the month of March, in the Year of our Lord one thousand six hundred and twenty-six.
