[Cover – pp. 2-3:] Foundation of the Lviv scholasticate prelatry [Folio 1v – p. 4:] Chapter [Folio 2r – p. 5:] IN THE NAME OF THE LORD, AMEN. IN PERPETUAL MEMORY OF THE MATTER. STANISŁAW GROCHOWSKI OF GROCHOWICE, BY THE GRACE OF GOD AND THE HOLY APOSTOLIC SEE Archbishop of Lviv, perpetual administrator of the Sieciechów Abbey. We make known by the tenor of this letter to all whom it may concern, that there appeared in person at our public audience the noble Jan Gawłowski, deputy and plenipotentiary of the most illustrious and reverend lord Jan Karol Czołhański of Czołhany, Secretary to His Royal Majesty. Having presented the letters of summons (crida) in the power of a writ, duly executed – as it appeared – for the purpose of approving the foundation of the scholasticate of the Lviv metropolitan church arranged by the same reverend lord, upon the arrival of the term falling on this day, he accused and did accuse of disobedience (contumacy) all and individual summoned parties, who were called three times according to custom and did not appear; and by reason of their disobedience, he moved for the acceptance, admission, and reading of the said foundation, which he obtained. The tenor of this foundation follows and is as follows: In the name of the Most Holy and Indivisible Trinity, Father, Son, and Holy Spirit, Amen. Since the goods with which mortals have been endowed by the benevolence of the Almighty gain for the salvation of their souls through the fruits of good works on earth, so that they may not lose the eternal reward in the heavens – they ought to work diligently every day not only for His glory and honor and the merit of the treasure of immortal glory, which neither moth, nor rust, nor the passage of eternity shall consume in the heavens, but also, not being ungrateful for the graces granted from the heavens by the right hand of the Almighty, to return them into His hands for the spreading of greater glory, and awaiting through faith and hope that which neither eye has seen, nor ear has heard, nor has entered into the heart of man, they ought and are bound to bear witness with the spirit of their whole heart and love poured out toward God, their salvation, with all humility and submission. Therefore I, JAN KAROL CZOŁHAŃSKI of Czołhany, Secretary to His Royal Majesty, of the Sas coat of arms, born in the lands of Rus' of a distinguished and ancient lineage, and finally, though unworthy, honored with the holy degree of priesthood, desiring from the temporal goods which have been entrusted to me from the heavens in succession from my ancestors – the judgments of the Lord are a great abyss – to gain eternal salvation for my soul and those of my ancestors, after prior mature deliberation within myself and with a well-prepared heart, for the glory and fame of the almighty GOD, the honor of the Most Holy Virgin Mary and the immortal All Saints, dedicating myself to their service according to the modesty of my fortune, so that all the more in the Lviv metropolitan church under the invocation of the Assumption of the Most Holy Virgin Mary, in the lands of Rus' not only shaken by schism, but also exposed to frequent invasions of Scythians and barbarians [...] [Folio 2v – p. 6:] exposed as my dearest fatherland, the honor, dignity, and glory of the Almighty God, His Mother, and the Saints might grow, and these very Ruthenian lands under the protection of the Lord's right hand might avoid the dangers of schism, wars, and invasions, and that the clerical and knightly estate (which is the foremost part of our Commonwealth), as well as holy justice as the avenger of crimes and guardian of laws in judicial benches, especially tribunal ones, might endure in their strength, and men educated in good and noble arts, zealous for God, His honor, the Church, and the prosperity of the fatherland, could never be lacking – holding in all things and through all things to a certain contract by way of intereza, with the consent of the most enlightened and most reverend lord, lord Stanisław Grochowski of Grochowice, by the grace of God and the Apostolic See Archbishop of Lviv, perpetual administrator of the Sieciechów Abbey, mutually concluded with the venerable chapter of the most illustrious and reverend lords prelates and canons of the Lviv metropolitan church, and signed and sealed by both parties, as well as the record of donation made before the office and acts of the Lviv castle court in this matter on Wednesday after the feast of the Nativity of the Most Holy Virgin Mary of the current year [September 12, 1640] in both these acts, by which my hereditary goods and all and intact portions, as they are found in the villages situated in the Żydaczów land, that is: Czołhany with the small castle and grange, Bełejów, Wełdzisz, Pacyków, Nowoszyn, Łolin, Myszków, Szynaczów, for the foundation of the prelate to be created on a new root, namely the scholastic – not failing in any way the agreements previously concluded and hitherto observed between the venerable chapter and the famous Lviv magistracy – I have renounced to the most illustrious and reverend lords prelates and canons of the venerable chapter of the Lviv metropolitan church, now and in the future; so also I renounce, give, donate, found, incorporate, and adjudge the parts of the mentioned goods and villages now by means of this my foundation in the best way, law, and order that I can, forever, leaving nothing at all to my successors or any of them in law, ownership, or benefit in the above-described goods, as is more broadly provided for by both the mentioned contract by way of intereza and the said Lviv castle court donation records made in these matters. Because of this foundation of the scholasticate prelatry thus made, first of all I personally as founder found myself for the scholastic of the Lviv metropolitan church, to be admitted to the body of the venerable chapter according to custom, and I present [him] to the most enlightened and most reverend lord Archbishop of Lviv or to whom it belongs by law. Consequently, the right of patronage of the scholasticate so founded, as often and whenever it shall become vacant by my resignation or death, I reserve for myself until the end of my life, to nominate and present successors or a successor by oral voice, letters of presentation, or testament. After my death and the last day of my life, as often as this scholasticate prelatry shall successively become vacant by resignation or death, the venerable chapter and its prelates and canons shall be bound and obliged perpetually and forever to bestow it primarily and in the first place upon one from the family of my house of Czołhański of the Sas coat of arms, and no one else. If, however, at that time and in subsequent vacancies there should not be found a suitable person from the family of me, the founder, namely ordained to the higher degrees of priesthood for the above-described scholasticate prelatry, then the venerable chapter of prelates and canons shall choose, nominate, and present a scholastic from their own body, originating from both noble parents. And that successor to the scholasticate, nominated by me and chosen by the venerable chapter [...] [Folio 3r – p. 7:] chosen and presented, during my lifetime shall be bound and obliged to celebrate the divine sacrifice of the Holy Mass once every week for the remission of sins, and after my death primarily for the soul of me as founder and of my ancestors. Finally, I give and grant to the venerable chapter the right and power, so that for my successor and successors for the time being, and for each of them, it may assign from the mentioned founded goods an annual pension appropriate to his office and according to its discretion, and in reality let it assign and pay the sum of one hundred and fifty florins; beyond which pension he shall participate without anyone's objection in all revenues, old and new, from the mentioned goods and portions falling to them according to the customarily observed division, as well as in the stall, voice both active and passive, in sessions, and all public and private burdens to be borne. Furthermore, obliging the reverend lords prelates and canons of the Lviv chapter, my dearest brothers, according to the modesty of this my foundation, I order that from the revenues of the above-described founded goods and parts of villages, for the deputy judge to the Tribunal from their body every second year – namely in that in which there has hitherto been a lack of a tribunal judge from the Lviv venerable chapter, so that in the future it may have its deputies every year: one from the old endowment of the most enlightened archbishops, the second from this one of mine – I allocate six hundred florins for the one chosen by the venerable chapter. Likewise, I adjure, give, and oblige that for the anniversary service (anniversary) on the day of my death in the Lviv metropolitan church annually falling with due devotion, together with the distribution according to the arrangement to be made at the next chapter, where the duties of the scholastic will also be discussed, they should be bound to give, deduct, and pay three hundred florins actually every year and for all eternity. For all this which has been done, recorded, founded, and ordered by me, I ask and demand with due respect that the venerable chapter of the most illustrious and reverend lords prelates and canons of the metropolitan church for the multiplication of [...] from mutual love accept, preserve, defend, execute, and actually bring to effect. Otherwise, whoever in the future should oppose this my foundational will in anything, in any way, and with anyone's help or advice, I summon him to the judgment and before the tribunal of the Almighty for judgment; with the preservation in all things of both the mutual contract with the venerable chapter, my dearest brothers, and the donation record made above, preserved and reserved to the above, as well as the expressed bail – not only in the above, but in every best way. This was done on the day, month, and year as above. After the admission and public reading of the foundation as above, in view of the statement of the plenipotentiary made in the name of his reverend principal that the successor scholastic would have and receive [this sum] annually as a pension for the performance of his office, he urged and with due insistence demanded that, because of the disobedience of all and individual so summoned and not appearing, first of all they be declared disobedient (contumacious), and in their absence the scholasticate foundation so drawn up be approved, confirmed, ratified, ascribed to ecclesiastical immunity, given the power of perpetual durability, ordered to be put into due execution, and that which is law be decreed, and also that letters of summons (crida) in the power of a writ be issued and expedited for the purpose of introducing the same to the mentioned scholasticate [...] [Folio 3v – p. 8:] introduction, not only in the above-mentioned, but in every best way. And we, Stanisław Grochowski of Grochowice, Archbishop of Lviv, etc., again after calling all and individual so summoned, and again after calling three times, although more than an hour of the audience was waited, in view of their non-appearance having recognized them as disobedient, in their absence and in the absence of anyone's objection, we have approved, confirmed, ratified, and decreed and pronounced by the power of this our sentence that the foundation of the scholasticate of the Lviv metropolitan church so drawn up by the most illustrious and reverend lord Jan Karol Czołhański, Secretary to His Royal Majesty, in all its points, clauses, articles, conditions, and connections, is to have the power of perpetual durability and is to be put into due execution according to its content; and we have ordered the issuance of letters of crida in the power of a writ for the purpose of the installation of the same most illustrious and reverend lord to this scholasticate and their delivery according to the form against all and individual judging that they have any right to the above. In the presence of the most illustrious and reverend lords: Andrzej Średziński, custodian of Lviv and provost of Przemyśl, Łukasz Witkowski, Walenty Skrobiszowski, doctor of both laws, vicar and official general, Samuel Kozarski, canons of Lviv, and many other credible witnesses. In witness whereof we have signed this letter with our own hand and ordered it to be sealed.
