[f. 1r] JOHN CASIMIR, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Livonia, Smolensk, and Chernihiv, and also hereditary KING of the Swedes, Goths, and Vandals. We make known by this Our letter to all and each person concerned that a document written on paper has been presented to Us, bearing the seal of the court of the Magdeburg law of Our city of Lviv, containing a resolution or a certain ordinance, and a petition has been presented to Us in the name and on behalf of the worthy assessors of the Magdeburg law of Our city of Lviv, that We might deign to approve and confirm said [ordinance] with Our royal authority. The wording of which document is as follows: In the name of the Lord, amen. In the year of our Lord one thousand six hundred and fifty-eight. We, Bartłomiej Dzerowicz, Bachelor of Arts, Jan Klemek, apothecary, the distinguished Andrzej Abrycjusz, Doctor of Philosophy and Medicine, Wojciech Gładysz, Guardian of the Laws, Paweł Borgan[?], Doctor [of Medicine?], Melchior Faszkowicz, Walenty Fosde[?], apothecary, Wawrzyniec Jasznicki, Starosta of Kozakow, Hieronim Wardosi[?], furrier, Andrzej Czechowic, apothecary, sworn assessors of the city of Lviv. To all and each person concerned, we make known and certify that We, chosen by God's calling and the authority of the Higher Power for the present office of assessor, considering that Our predecessors handed down to each other statutes and sanctions without the knowledge and consent[?] of the Higher Power, or as if from hand to hand to Us, which We, having accepted, just as in the given matter and circumstances of our [...], and as if following in their footsteps, by custom and ceremony [...], leaving to Our office and law, expressly for this or acting with the support of God's grace, these articles, both the manner of the ordinance for eternal [...] and [...] as [...]. [f. 1r, bottom] Article one. First of all, starting with the worship of God and pious matters, we wish that on holidays and more solemn feast days and Sundays [...] be praised, or mass be celebrated in the intentions [...] predecessors and colleagues from the venerable Senate and the metropolitan church were remembered, upon the gathering of the lords brethren for the offering [...], and after the lord wójt, the assessors following in their order, and those absent shall be punished with a fine of two groschen. Which groschen the last assessor in the order of calling, as the collector of assessor shillings, deposits into the chest. Of which he is to render an account if he fails in his office in this regard. Article 2. When a funeral happens for one of the assessors, the presiding lord judge, in the presence of one chosen from the body of assessors, shall send a summons by the bailiff, from where all assessors should arrive to accompany the funeral. Where all who are present in the city shall be obliged to gather and accompany said [funeral]; those absent, except for a legal and certified [impediment], shall be punished with a fine of three groschen. Article 3. For the support of [...] it is decided to celebrate one mass for the dead every Ember Days, sung at Our assessor altar, under penalty of one shilling for the scholars of each altar according to the agreement with the scholars [...]; the bailiff on the eve of the celebration [...] interested and they will be obliged to go to the offering, asking the Lord God with prayers for their relatives and friends. Those absent shall be punished with a fine of three groschen, with the preservation of a legal justification for absence. [f. 2r] Article 4. For the administration of justice, all assessors, by the duty of their office, shall endeavor to appear at the appointed hour (this, however, should not be understood as regarding deliberations on issuing a verdict in disputes), whenever the lord wójt designates through the bailiff or his deputy, besides this, for the administration of justice in the morning before the start of the court, they shall gather; for cases postponed on the eve of the trial towards [...] at any time according to the requirement of the coming case. The time for the administration of justice is established: in summer, namely from the feast of Easter to the feast of St. Michael, two or three hours after sunrise; in winter, from the feast of St. Michael to Easter, after the passage of two hours after sunrise. It will be permitted, however, for the assessors to agree with the lord wójt on a fixed hour for the session, which, however, when designating, they should clearly define. The absence of each assessor, the last of the assessors or the one on the right side, whose predecessor is the nearest, shall diligently note, so that for each absence from the afternoon session, a fine of one groschen shall be imposed, for the session of postponed cases two, and in criminal cases a fine of six groschen. Article 5. Money which, from oaths, judicial actions, decrees, and services, is customarily paid to the court, should be paid and issued from the acts drawn up in court; except, however, for one groschen for the bailiff, they shall be deposited into the assessor shillings, which shillings will be divided between the lord wójt and the assessors. The same should be understood about resignations in postponed cases and about fines. As for the monetary fines falling in the courts preceding the deliberations, those present at the entire proceeding with the lord wójt shall demand payment; those absent shall not benefit from those refreshments along with those present. For it is customary to say: He who works, let him eat. Article 6. [...] in court or from the acts, it is decided and has the force of a decree, for the payment of all assessor shillings from commodity fines [...] of the wójt office, from where he has the right of judicial retention for his burdened case, and then for copies a moderate payment, as for other private ones, he shall pay to Our scribe. As for the money for expediting a petition, whether to the Higher Saxon Law or to the Court of His Royal Majesty, which are customary, in this case, special consideration is given to the litigating assessor, and namely, he shall pay only as much as is due to the secretaries of Our Petitioner, or the Saxon law, or the decrees. The messenger, to whom the petition is to be entrusted, the stewards shall give from [...]. Nevertheless, when an assessor wins a case, the court costs legally incurred shall be paid by the defeated party, he is also obliged to collect compensation for absence and the expense for the messenger, due except for the previous assessor [...]. Article 7. The lord wójt for the time being, by virtue of the petition or the response of the lords councilors, will not decide otherwise than on the basis of a joint deliberation agreed upon with the lords assessors. Also, referrals of criminal cases, which usually follow from the council office to the criminal court, he shall not accept alone, but having taken to himself at least two assessors. So that the assessors may behave as colleagues fraternally, and the assessors among themselves cultivate mutual love and respect, avoiding any haughtiness and bias. [f. 3r] Article eight. The effect of brotherly love requires the same constancy in prosperity and in adversity. Therefore, if any of the assessors happens to suffer damage to his honor or any heavy grievance contrary to the provisions of our Magdeburg law, the assessors as one body should consider that injury as common and shall repel it with common effort and expense. Article ninth. The stewards, as well as the managers of the estates in Sołonka (whom the college of assessors will designate for this), every year four weeks before the election of the new magistrate, without any delay shall have ready the accounts of income and expenditure prepared for this purpose, and the remainder, if any appears from the accounts, they shall faithfully return and calculate to the colleagues for the chest, or as it seems appropriate; and they shall beware not to take the money belonging to the chest to private houses, but entrust it [only with the knowledge] of the entire college, and in the common treasury faithfully and inviolably keep it. The sealing of documents and petitions shall take place exclusively in the town hall. Since the assessor chest and the fees collected there are frequently mentioned, so that no one might think that this is an invention of novelty, a clear gloss from the city law is added here under article 56: "Whatever - he says - benefits and money falls to them (that is, the assessors) from the verdicts, they take justly". And there below: "Every Ember Days, the money collected from the shillings they divide among themselves and no one has a share with them in this kind of money". From which it clearly follows that the collections of the assessor chest are gathered there and no one except the assessors has any right or interest in them, since the law itself so provides. At the same time of rendering accounts, the acts of Our judicial chancellery shall be revised every year by several men designated from the body of the College capable of this matter. Article tenth. [f. 3v] It was also deemed appropriate by us that for the examinations or tortures of criminals (for it is a matter of the highest importance), the lord wójt should always come personally with two assessors, the assessors, however, shall keep to their order. The elder with the younger shall always come, and that according to seniority, until the whole order is completed and finished. If, however, any of those whose turn it is (being present in the city), without a justified reason, after an admonition made by the lord wójt or those present from the College, does not wish to be present at the tortures, but deliberately absents himself, he shall irrevocably deduct twelve groschen to the chest, whenever he does not submit to this ordinance. Article eleventh. It remains that whoever from future elections will newly join Our College, because he enters into ready labors and legitimate incomes, which we enjoyed due to the vacated estates, we most strongly decide that he shall increase the common chest with a worthy honorarium. Those obliged shall pay this at least within two weeks after the election, and not earlier will they have a share in the cup of merit or refreshment, or the division made by the stewards in the seasons of the year – especially for the feast of the Nativity of the Lord, Easter, All Saints, which from the common chest of this College, by common consent, is customarily distributed to each individually – until they effectively deposit such a worthy honorarium. The measure of such an honorarium shall be such as the status of the entrant and his wealth will indicate, so, however, that due to the vacated estates and hereditary debts subject to repayment, he shall pay no less than sixty florins [...] to the city. This ordinance, for the glory of Almighty God, the governance of holy justice, and the multiplication of our common good in the above-mentioned manner sanctioned and enacted, we, the undersigned assessors, desiring both to keep it inviolably and firmly ourselves, and that it be kept and observed by Our successors in the same office, have strengthened with the suspension of the judicial seal and the signature of our hands. Not closing, however, the way for Us and Our successors, so that this ordinance, with the consent of all of us, could and should have the power in the changeability of affairs and times to be changed, reformed, increased, or decreased, as necessity and the matter itself may seem to require. Done [f. 4r] [Done] and written in the seat of our entire College on Monday, December 19, 1658 [sic]. Place + of the pressed seal. We therefore, JOHN CASIMIR, KING, graciously inclining to the petition of the above-mentioned worthy assessors of the Magdeburg law of Our city of Lviv as just and consistent with reason, have deemed the above-written document of the ordinance or resolution in all its points, clauses, articles, connections, conditions, and obligations worthy of approval, confirmation, ratification, and strengthening (with this, indeed, expressly added by Us condition, that the above-mentioned assessors of the Magdeburg law of Our city of Lviv, chosen and to be chosen, according to the resolution or ordinance written above, as well as ancient customs and habits for many years in continuous execution and order kept and specified in their registers, shall immediately pay the honoraria to the Assessor College to their chest on the day of Palm Sunday and fulfill the remaining points of this ordinance under the penalties described below. If, however, any of the assessors of Our city of Lviv opposes this ordinance or resolution, such one will not only be unable to use the incomes or benefits, but also will not be able to be called or elected to a higher chair, namely to the Lviv council magistrate; [...] of these Lviv assessors [...]; but the Lviv Magdeburg law shall remain), with Our royal authority we approve, confirm, ratify, and strengthen for eternal times, and we wish that they enter into due execution, providing that the same document of the ordinance should obtain the force and weight of due constancy and power. In proof of which, we have ordered this document signed by Our hand to be strengthened with the crown seal. Given in Poznań, on the 6th day of the month of May, in the Year of our Lord 1658, and of Our reign in Poland the tenth, and in Sweden the eleventh year.
