Erection of the Saint Martin Monastery in Lviv by Archbishop Jan Tarnowski
The Archbishop of Lviv, Jan Tarnowski, approves the foundation of Aleksander Zborowski and canonically erects the church and monastery of Saint Martin of the Carmelites of the Ancient Observance, along with a hospital for sick noble soldiers in the Krakow Suburb of Lviv. He secures the income and endowment of the order and ensures the inviolability of the rights of the local parish.

IN THE NAME OF THE LORD, AMEN.
IN PERPETUAL MEMORY.
Lest the deeds of mortals, which are fluid, fleeting, and prone to falling into the oblivion that confusion often infects with various errors, should dissipate and come to nothing, it has been devised by prudent human resourcefulness for their eternity and durability that they be immortalized by the defense of writings – especially those which are established and granted for the honor and glory of God and His Saints, or for the benefit of the salvation of souls, or for ecclesiastical greatness and adornment. Therefore, We, Jan Tarnowski, by the grace of God and the Apostolic See Archbishop of Lviv, perpetual administrator of the Abbey in Mogiła, hereby notify all and sundry, both present and future, by this Our letter, that before Us, sitting on the tribunal for the administration of justice and before Our court, personally appeared the religious and most reverend father brother Władysław Zardecki of the Order of Carmelites of the Ancient Regular Observance, the lawful procurator or provisor of the convent and church of Saint Martin, situated and located outside the walls of the city of Lviv, in the Krakow Suburb, on this day, by virtue of a citation letter (crida), issued by way of a general summons against all and sundry, jointly or severally, claiming an opposing right or any interest in the goods described below, issued from the chancery of Our court and legally, as was evident, proclaimed from the pulpit before the people gathered for service by the venerable Wojciech Spławski, priest vicar of Our metropolitan church, and affixed to the doors of the Lviv churches of Our archdiocese by the venerable Maciej Łobodzic, subdeacon of minor orders, accused of non-appearance (contumacy) with due insistence all and each individually, summoned by said citation letter, and not appearing; and in their absence, he presented: the record of the principal sum of one thousand Polish zlotys for an annual rent (wyderkaf) of eighty zlotys derived from said principal sum, located on the Komarno estates, as well as the donation of a plot, lands, meadows, an inn, together with their houses, buildings, and all other appurtenances and accessories, for the founding and construction of the church and convent of Saint Martin and for the maintenance of the fathers and brothers of said Order, as well as for the construction of a hospital for sick noble soldiers, most piously offered, donated, and secured and mortgaged on certain estates by the late noble Aleksander Zborowski of Rytwiany; or rather, the authentic certification of all these aforementioned documents by the most reverend late Andrzej Srzedziński, Bishop of Nikopolis, suffragan, custodian, and official general of Lviv, together with two confirmations of the most serene monarch John II Casimir, by the grace of God King of Poland, Grand Duke of Lithuania [etc.], strengthened by the greater crown seal; humbly requesting that all and sundry summoned, and not appearing, be declared in default (contumacious) and in their absence, said record, donation, certification, and approvals be approved in all points and articles; that the above-mentioned principal sum together with the rent derived from it, as well as the donation of the plot, lands, meadows, houses, buildings with all appurtenances and accessories, be assigned and incorporated into ecclesiastical liberty and immunity; and that on this sum and rent, as well as the donation, the church, monastery, and formal convent, or cenobium of said religious fathers and brothers and their Order, as well as the hospital for sick soldiers, according to the thought and intention of the founder, on the plot, lands, meadows, and houses, as well as the garden commonly called "Angielczyków", and on the second garden, located between the meadows of the Dominican Order of Lviv on one side, the Armenians on the other, and on the outside by the lands of a certain miller, lying in the Krakow Suburb of said city of Lviv, be erected, founded, and endowed; and that permission for the construction of the above-mentioned church, convent, and hospital in that place, as well as the care of souls and the management of the hospital mentioned above and only of that place, which care they had already previously assumed, be granted and delegated to said fathers and brothers; and that other things necessary in the above regard and around it, by the provision of the holy Council of Trent, as well as the statutes of the Provincial Synod, and also the Rule and the prescribed Order, be decided and ordained, and that appropriate letters in the usual form be issued.
The content of which record, donation, foundation, and certification follows: Andrzej Srzedziński, by the grace of God and the Apostolic See Bishop of Nikopolis, suffragan, custodian, vicar in spiritual [matters] and official general of Lviv, provost of Przemyśl [...] [insert of the certification of Andrzej Srzedziński from the year 1630/1631, transuming the record of Aleksander Zborowski on Komarno from 1631] [...] John II Casimir, by the grace of God King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Livonia, Smolensk, Chernihiv, and also hereditary King of the Swedes, Goths, and Vandals [...] [insert of the diploma of John II Casimir dated: Given in Zamość, on the 10th day of the month of May in the Year of the Lord 1656 [...] Piotr Ryszewski, secretary] [...]
We, however, Jan Tarnowski, the above-mentioned Archbishop, desiring to bring the pious and praiseworthy intention, as a spiritual and religious person, to the desired effect, first of all, having waited for the aforementioned summoned parties for a long time and more than an hour of hearing, and they not appearing, we have judged them as in default, as they justly deserved and holy justice commands; and in their absence, after mature deliberation and after due and diligent examination of this matter, considering above all that all and sundry formalities from the provision of the constitutions of the Holy Apostolic See and the statutes of the holy Council of Trent issued regarding the construction of new monasteries have been fulfilled, therefore, having invoked the name of Christ, we approve, confirm, and ratify the above-included record of the principal sum of one thousand Polish zlotys and the annual rent of eighty zlotys in all and individual its points, clauses, articles, and all conditions, by the power of ordinary authority and perpetual durability, and at the same time place a decree upon it, and also assign, incorporate, and include said plot, lands, meadows, inn together with their houses, buildings, and all other accessories and appurtenances, along with the donation of these and with the principal sum of money and rent, into ecclesiastical liberty and immunity; and on this plot, lands, meadows, inn, houses, and other buildings, and all their appurtenances and accessories, as well as on the mentioned principal sum of money and rent, we have deemed it a duty to erect, found, and endow the church under the invocation of Saint Martin, bishop and confessor, the holy apostles Philip and James, and also the holy virgins and martyrs Apollonia and Barbara, and a formal convent and monastery or cenobium, as well as a hospital for sick soldiers according to the intention of the founder, as well as the religious fathers and brothers of said Order of Carmelites of the Ancient Regular Observance, after the pattern of other churches and religious convents and their Order, in the mentioned Krakow Suburb of the city of Lviv of Our archdiocese, namely in the place where they are now located, and to grant the right and permission for the establishment and construction of the church and monastery or formal cenobium, as well as the hospital for sick soldiers, to said religious of the mentioned Carmelite Order from Our certain knowledge, to introduce them to it and to them, and to support and preserve them in their peaceful use and possession perpetually once introduced and intromitted.
Thus, we hereby approve, confirm, ratify, place [a decree], assign, incorporate, include, erect, found, endow, grant, introduce, support, and preserve. So that said religious fathers and brothers of the mentioned Order, present and future, according to the laws and custom and the provision of the Regular Observance and the decrees of the Congregation of Interpreters of the holy Council of Trent, may freely serve the Most High in peace of spirit and body, and may have the care of souls of the hospital of only that place, from now as from immediately, and vice versa, we permit and wish and ordain that it should be permitted to anyone. Furthermore, we decide and by deciding sanction forever that the parish church of the place or plot and houses, or of said lands, appurtenances, and all their accessories, on which the church and convent, as well as the hospital, have recently been erected by Us, shall never feel or suffer any prejudice, damage, or diminution or reduction in its income from the title of administering sacraments, both voluntary and necessary offerings, carols, and other benefits, nor any obstacles in parish rights from said church and convent and hospital, as stated, recently erected, and from its rectors and servants. Which church and its rectors and servants we wish, by the power of this Our declaration, to fully and completely enjoy, use, and rejoice in their parish right and ancient customs. And if any violation should ever occur from this title (from which may God protect), we leave the right of pursuing [claims] before Us and Our most reverend successors, their commissioners or officials, to said church forever, and we order letters of approval, confirmation, and erection to be issued in the usual form.
In witness whereof, we have ordered this letter to be strengthened by Our seal. Done in Lviv in Ruthenia, on Wednesday, the seventeenth day of the month of July in the Year of the Lord one thousand six hundred and fifty-eight, in the eleventh Roman indiction, during the pontificate of our most holy lord, lord Alexander, by Divine Providence Pope, the seventh of that name, happily reigning, in the fourth year. In the presence of the most illustrious and most reverend lord Stanisław Czuryło of Goraj, provost, vicar in spiritual [matters] and Our official general, Jakub Cawatt, canon of Lviv, parish priest of Wyżniany, and the distinguished Maciej Kuczankowic, master of liberal arts, doctor of philosophy of the Krakow Academy, public notary by the authority of the holy apostolic see and of acts before Us, and many other credible witnesses.

Parchment document in very good condition. At the bottom, the coat of arms seal of Archbishop Jan Tarnowski is attached on a green silk cord in a metal case with red wax (partially worn, the coat of arms shield and episcopal insignia are visible). On the verso, numerous chancery annotations, including a report on the introduction of the Carmelites into possession of the donation on July 28, 1658. The document transumes earlier acts: of Bishop Andrzej Srzedziński (1630/1631) and King John II Casimir (from Zamość, May 10, 1656).
