In the Name of the Lord. Amen. For eternal memory. So that the deeds of mortals, which are fluid, unstable, and prone to easily perishing oblivion, are not rendered vain and brought to nothing, a prudent human measure has been devised for their permanence and survival, that they be immortalized by the protection of writings – especially those which are established and granted for the glory and honor of GOD and His Saints, or for the benefit of souls, or for ecclesiastical growth and adornment. THEREFORE WE, JAN TARNOWSKI, by the grace of GOD and the Apostolic See, Archbishop of LVIV, perpetual administrator of the abbey in Mogiła [Clara Tumba], make known to all and each individually, both present and future, by this letter: That when the most illustrious and most reverend lord MARCIN RZECHOWSKI, canon of Lviv, dean and provost of Rohatyn, and the noble lord Maciej RZECHOWSKI, brothers by birth, led by the example of pious Catholics and a salutary, more fervent zeal for increasing divine worship – so that in that which the general Christian race is wont to heed above all, nothing should seem to be lacking to them – deemed it above all a salutary thing and in accordance with their intent, that they might acquire heavenly goods in exchange for temporal ones, and while the breath of life governs [...], whatever they acquired with the help of God's generosity through their labor, they first turned to the salvation of their souls, so that they might more easily reach the final goal for which all were created; placing with humble prayer an anchor of hope in the infinite merits of the Lord JESUS CHRIST, Redeemer of the world, and His Most Holy Mother, the MOST HOLY VIRGIN MARY, and in the glorious intercession of Saint Barbara, Virgin and Martyr; out of their piety and reverence for God Almighty, His Most Holy Mother, and their patroness, Saint BARBARA, they recorded an annual rent of one hundred and twenty Polish florins, or as the records show, for the dowry [endowment] of the hospital church of Saint Barbara, Virgin and Martyr, located in the Rohatyn suburb (which until this time had no foundation, and whose consecration according to the rule of the Roman Pontifical they performed at their own cost and expense in the year sixteen hundred and sixty-one), at certain terms; and so that their pious resolution might be put into effect, he appeared before Us sitting in the Tribunal for the administration of justice, and on today's court date, from the summons issued from our chancellery with the power of a general citation against all and individual persons, jointly or severally, claiming any right and interest to the goods written below, and legally – as it turned out – before the people gathered for the service through the publication of the vicar of the Rohatyn church, he accused of non-appearance all and each individually summoned by the aforementioned letter and absent; and upon their non-appearance [he submitted] the records of the principal sum of one thousand five hundred and ten Polish florins, collected both by the aforementioned founders and from pious legacies, and first: the sum of two hundred florins on the estate of the aforementioned noble Rzechowski called Kutcze, lying in the Halych district, with a rent from it paid each year of sixteen florins, recognized before Us. Likewise, the sum of one hundred florins on the farmstead next to the aforementioned church of Saint Barbara, formerly called Doktorowskie, ceded by the peasant Wawrzyniec Kotowicz before the Rohatyn council acts on Friday after the Sunday of the Rogation Days [Rogationum] in the Year of the Lord sixteen hundred and sixty-three. Likewise, one hundred florins by the honest Antoni Cełowa, a Rohatyn burgher, on his property located in Rohatyn, before the same council acts in the year as above, on the Friday after Corpus Christi. Furthermore, one hundred florins on the Bodaczewska Wojtowicz inn before the Rohatyn reeve acts of the same year, on the Monday before the feast of the Nativity of the Most Holy MARY. Likewise, sixty florins with one-third part, payable at four florins, secured by the honest Piotr Iwanowic before the aforementioned acts on the Friday after the feast of the Three Kings in the Year of the Lord sixteen hundred and sixty-four. Also fifty florins by the famous Łuczkiewicz, a Rohatyn burgher, on his property before the acts as above, recorded on the Tuesday after All Saints in the Year of the Lord sixteen hundred and sixty-three; also one hundred florins by Szymon Wołoszyniec on his property before the same acts of the same year, recognized on the Tuesday before the feast of the holy Apostles Simon and Jude. Likewise, one hundred florins by the infidel Israel, a Rohatyn Jew, on his own property in Rohatyn, recognized on the Tuesday after the feast of St. Bartholomew the Apostle. Furthermore, one hundred florins by the honest Gaługa, secured on the Tuesday on the eve of the feast of St. Martin in the Year of the Lord sixteen hundred and sixty-five before the same acts, as well as a debt of [...] florins by the infidel Daniel, a Rohatyn Jew, recognized under the same act. Likewise, one hundred florins on the field called Konupczakowskie towards Rohatyn, secured on the Friday before the feast of the holy Apostles Simon and Jude in the Year of the Lord sixteen hundred and sixty-five. Also one hundred florins by the infidel Zelig, a Rohatyn Jew, on his property secured on the Tuesday before the feast of St. Martin in the year as above before the same acts, and also two hundred florins by the famous spouses Vehlenkicucs, specified before the acts as above, recorded on the Monday before the feast of the Transfiguration of the Lord of the same year sixteen hundred and sixty-six [sic!]. Likewise, one hundred florins on the farmstead called Kaniukowskie, secured and recognized before the acts specified above on the Monday after the second Sunday after Easter; and also a plot bequeathed to the same church in the will by the formerly noble Zofia Olkowska; finally, the lands and meadows with all their appurtenances and accessories of any kind, primarily offered, donated, and recorded by the said reverend Marcin and noble Maciej Rzechowski, just as these authentic documents were presented before Us – requesting that such records and dispositions be accepted, approved in all and each of their points, clauses, articles, and conditions, and that the aforementioned principal sum together with the rent derived from it, as well as the donation of the plot, house, land, meadow, and gardens with all their appurtenances and accessories of any kind, be released and included and incorporated into the ecclesiastical immunity; and that from this sum, rent, and donation, a prebend and prebendary be erected in the aforementioned hospital church, to whom the pastoral care and management in the said hospital and church would be entrusted, to impose burdens upon him due to the aforementioned rent and to bind him under the burden of conscience to fulfill them; and to reserve, grant, and assign the right of patronage and of presenting a priest to the said prebend and church to the aforementioned founders for the rest of their lives, and after their death to their successors of the village of Kutcze together with the famous mayor and councilors of the city of His Royal Majesty Rohatyn, and to decide, resolve, and order other things that are wont to be observed in the erections of benefices, and to issue the necessary letters of approval, confirmation, erection, and ordination. We, JAN TARNOWSKI, by the grace of GOD and the Apostolic See, Archbishop of Lviv, perpetual administrator of the abbey in Mogiła, desiring with zeal to increase the worship of God and His Saints and to bring to the desired goal the pious offering of the aforementioned most illustrious and most reverend Marcin and noble Maciej Rzechowski, brothers, primarily deemed the aforementioned summoned parties, called for longer than an hour of hearing and not appearing, to be disobedient [contumacious], and because of their non-appearance, after prior mature deliberation, we decided that the records and donations specified above from the acts should be accepted [...] and in all and each of their points, clauses, articles, and conditions, insofar as they are legally permitted and righteous, approved, confirmed, ratified, given the power of ordinary authority and eternal permanence, and at the same time issue a decree; to grant, include, and incorporate freedom and ecclesiastical immunity to the said rent in the amount of eight per one hundred florins and no more collected from their debtors, [in the amount of] one hundred and twenty Polish florins together with the principal sum, as well as to the land, buildings, meadows, gardens with all their additions, accessories, and appurtenances of any kind, just as they exist within their boundaries and circuits; and on this same rent, the aforementioned meadows and gardens, we deemed it appropriate to erect, found, and endow a prebendary in the said hospital of St. Barbara, Virgin and Martyr, on the Halych Suburb, worthily erected of masonry at the cost and effort of [...] the said most reverend founder, consecrated by the late most reverend Stefan Kazimierz Charbicki, Bishop of Nikopol, suffragan and official of Lviv, provost of Włocławek, canon of Warsaw, in the Year of the Lord sixteen hundred and sixty-one, the anniversary of the dedication of which church is celebrated on the second Sunday after Easter – as having invoked the name of Christ, we approve, confirm, ratify, assign, incorporate, introduce, erect, found, and endow, so that the prebendary of the said hospital church of St. Barbara will collect the aforementioned collection of benefits and other income from the land, meadow, and gardens for himself and his maintenance. And because a temporal portion in the Church of God designates a benefice, for which divine service should be performed, therefore this same prebendary [...] will be subject in matters exclusively righteous and honest to the most reverend provost of the parish church in Rohatyn and will be obliged to listen to his admonitions and correction regarding life and customs, as well as regarding services. Furthermore, this same prebendary, personally residing permanently at this same church, will have entrusted the care of souls only of the poor staying in the hospital – whom he will confess no otherwise than once, or in significant weakness, and well recommended to him, and not wandering and sinful, accepting them according to his conscience together with the Rohatyn councilors. He will perform and shall perform three masses each week in the same church: the first on Sunday according to the rubric of that Sunday with a collect for St. Barbara, and that early in the morning before the start of services in the parish church or at another convenient time, so that by drawing people away from the mother church it does not happen to its detriment and hindrance. Two, however, for the dead, on whichever day of each week he wishes, for the deceased founders; if, however, a more solemn feast falls in any week, he will perform the mass for the dead according to the intention of the founders for the falling feast. So every week for eternal times he will perform. Furthermore, he will provide wine and wax for the use of his church. He will diligently maintain order and cleanliness in the said church. He will not remove the peasants belonging to the said church who currently exist and will not make any exchange, unless with the consent of the superiors or the office, and that for the benefit of the church. He will not sell the things and holy vessels and equipment of the church, but will maintain them in proper condition and repair; he dares not make any reduction of goods, but will increase them to the best of his ability. And if the aforementioned wish to free their goods from paying rent by returning the original sum, these returned sums together with the consent and personal participation of the most reverend provost will from then and then be located in other clean and free goods and secured by a new record. Offerings from alms, if they are given by the faithful of Christ in food (as long as the poor have a common table), he will distribute to them without deceit and treachery equally, without any regard for the person, not taking from one at the expense of another, himself or through someone else. If, however, this alms is given in ready money, having deducted the third part, he will distribute two parts equally among the poor, and the third part he will keep and after entering it into the register, which he is to keep in the book of income, receipts, and distributions, he will turn it to the needs of the church, the prebendary's house, and the hospital. Furthermore, on Sundays and feast days he will be obliged to appear in the parish church for calls, incensations, and processions together with the vicars and mansionaries. And if this same prebendary for the time being [fails to fulfill] all the aforementioned duties and burdens, imposed on this church by the express will of the lords founders, he will be deprived [of the prebend], and another person, capable and worthy, presented by the patrons, will be established. Finally, the right of patronage and of presenting the said prebendary to the aforementioned church, when a vacancy of this same prebend ever occurs, we grant and assign to the lords founders for their lifetime, and after their passing to the possessors (Catholic only) of the goods of the village of Kutcze lying in the Halych district, as well as to the famous mayor and councilors of the city of Rohatyn jointly and indivisibly. In case of negligence, the observance of the holy canons we reserve to Us and to our most illustrious and most reverend Successors, Archbishops of Lviv or vicars in spiritual matters and temporary officials; and all and individual legal or factual defects, if they have occurred in any way in the above, we repair by ordinary authority and we decide and issue the necessary documents of erection and foundation in the usual form. — Done and given in Kąpoly, on the thirteenth day of the month of November, in the Year of the Lord sixteen hundred and sixty-five. In the presence of the most illustrious and most reverend Florian Warszawski, provost, Adam Piaskowski, our vicar in spirituals and general official, Stanisław Żelechowski, Jakub Zawat, Stanisław Mościcki, Mikołaj Zychlin, doctors of both laws, canons of the metropolitan church of Lviv, and many other credible witnesses.
