[Front cover, embossed and gilded leather, monograms around the coat of arms:] I. Z. S. CH. K. S. IA. ST. P. W. I. K. M. [f. 1r] IN THE NAME OF THE LORD. AMEN. In eternal memory of the matter. Whoever contemplates with constant and zealous meditation the infinite treasures of Divine Goodness, most abundantly poured out upon the whole human race, only then attains – as is recognized – the true happiness of eternal bliss, when, for the relief of human want and for persons severely exhausted in body and spirit by the hostile arrows of stepmother Fortune, he extends and offers the generous hands of his right, assisting them out of compassion. Frequently pondering this in his thoughts, the hero of distinguished lineage, the most illustrious Jan of Sobieszyn Sobieski, Crown Standard-Bearer, Starosta of Jaworów and Stryj, heir of Żółkiew, desiring to enjoy the eternal happiness of the Kingdom of Heaven, for the salvation of his soul and the remission of sins, has generously and graciously designated and recorded the sum of thirty thousand Polish zlotys on his own hereditary estates called Błudów, lying in the Volhynian Voivodeship and the district of Łuck, for the foundation of a convent or monastery and hospital of the Order of Blessed John of God, commonly called the Brothers Hospitaller. Therefore, [f. 1v] WE, JAN TARNOWSKI, BY THE GRACE OF GOD AND THE APOSTOLIC SEE ARCHBISHOP OF LWÓW, PERPETUAL ADMINISTRATOR OF THE ABBEY IN MOGIŁA. To all and each one individually, both present and future, we make known by this our letter. That appearing personally before us, sitting in the tribunal and for the administration of justice and before our court, the venerable and religious fathers brothers Melchior Maiorowski, Grzegorz Policki, priest, professed members of the Order of Blessed John of God, and lawful plenipotentiaries of the religious fathers and brothers of the same order, commonly called the Brothers Hospitaller, guardians of hospitals and the sick, on today's date, resulting from the letters of 'kryda' [creditors' summons] by virtue of a general summons against all and each one individually, jointly or severally, claiming an opposing right and any interest in the things written below, issued from our chancellery and lawfully – as was evident – executed by posting to the doors of churches located inside and outside the walls of the city of Lviv by the venerable Wojciech Spławski, vicar of the Lviv metropolitan church, accused with due diligence of the non-appearance of all and each one individually, summoned by the aforementioned letters of 'kryda', and not appearing, and in their absence, the authentic foundation and record, included below, of the principal sum of thirty thousand zlotys, for an annual rent with the right of redemption in the amount of two thousand and one hundred zlotys, falling from the same principal sum, for the foundation and erection of a monastery or convent and hospital of the above-written fathers and their order, [f. 2r] offered most piously by the most illustrious Jan of Sobieszyn Sobieski, Crown Standard-Bearer, Starosta of Jaworów and Stryj, Colonel of His Royal Majesty, and secured and encumbered with a mortgage on the estates exactly designated in the content of the foundation and record, submitted, humbly requesting that all and each one individually summoned, and not appearing, be recognized as disobedient and in their absence this same record be approved in all points, clauses, and articles, the mentioned principal sum of money together with the rent derived from it be assigned, incorporated, and included in the freedom and ecclesiastical immunity, and that on this principal sum and rent, a monastery, formal convent or hermitage and hospital of the mentioned religious fathers and brothers and their order at the Church of St. Lawrence, located and existing in the Halicz Suburb of the city of Lviv, after the cancellation and abolition of the prebendary title, be erected, founded, and endowed, and that permission for the construction of the monastery or convent and hospital of the mentioned fathers and brothers be granted in the same mentioned place, as well as other things in this regard and around this from the provision of the holy Council of Trent and apostolic constitutions issued in the matter of erecting new monasteries, as well as the statutes of the provincial synod, as well as the rules and the above-mentioned order be decided and ordered, and that the necessary documents for this be issued in the usual form. The tenor of which foundation follows as such: Jan of Sobieszyn Sobieski, Crown Standard-Bearer, Starosta of Jaworów. I make known by this my letter, that I, fulfilling the Divine inspiration and my pious affection for the order of the Brothers Hospitaller, and wishing that by the temporal and fleeting earthly fortunes, which the Divine hand has entrusted to me, I might gain eternal [blessings] and earn for myself [f. 2v] that blessing which is promised to the lovers of the poor: “Blessed is he who considers the needy and the poor, the Lord will deliver him in the day of trouble”, I have intended to found from the very foundations for the mentioned holy order a convent here in Lviv and a hospital, in which I might both worship the Eternal Creator and serve the members of Christ the Lord, that is, sick poor people, with help in necessary health. Which thought of mine, thus undertaken, the most illustrious His Lordship Father JAN TARNOWSKI, Archbishop of Lviv, Abbot of Mogiła, by allowing the small church in the Lviv Halicz suburb built under the title of Saint Lawrence, helps; therefore I execute it all the more willingly. I record, therefore, the sum of thirty thousand Polish zlotys on my own hereditary property called Błudów and on all its appurtenances, lying in the Volhynian Voivodeship and the district of Łuck, so that it may belong for eternal times to the convent and hospital of the Brothers Hospitaller, monks of the Order of Blessed John of God, founded by me here in Lviv at the mentioned church, now and hereafter incessantly following. From which sum of annual rent, two thousand one hundred Polish zlotys annually in three installments, I and my successors, and all heirs and possessors of the mentioned estates shall be obliged to pay them, and after me the mentioned successors shall be obliged: that is, the first installment on every feast of the Three Holy Kings, seven hundred zlotys; the second installment on Pentecost, seven hundred Polish zlotys; and the third installment on every feast of the Assumption of the Blessed Virgin Mary, also seven hundred zlotys, and this against receipts of the superior now and hereafter [f. 3r] being manual, which are to be of such weight as also testified in the Crown books. The payment of this provision is to begin at the near approaching Three Kings, at which time also the mentioned religious fathers are to appear at the newly founded local convent and hospital in the number of four brothers and a fifth priest of the same order, and having taken in eight sick poor, they shall be obliged to begin service to them with God's help, both by administering the holy sacraments for the salvation of the soul, and by temporal [efforts] for the improvement of the health of the body. This same priest from the mentioned brothers shall be obliged to celebrate Holy Mass for the remission of sins for me once a week, every Tuesday, during my lifetime, and after my death a requiem for eternal times. And if a solemn feast happens on that day, then he is to do it the next day. And since I cannot record this my foundation right now due to the lack of a land court, nor wait for the near following terms for military service, I oblige myself that, God willing, at the Lviv land terms, which are accustomed to be held directly after the Three Holy Kings, I will execute and admit this in the face of the full land court, that I make this foundation from the very foundations; and I take God as my witness that it is from my own pure generosity, having taken no money for it, as I also now admit under faith, honor, and conscience. Which all, so that it may have greater force, I therefore register this my letter in the Lviv castle books and I oblige myself and my successors to fulfill it in everything, under the penalty of the sum of thirty thousand Polish zlotys. Done in Lviv on the nineteenth [f. 3v] of the month of August in the year of our Lord one thousand six hundred and fifty-nine. Jan Sobieski, Crown Standard-Bearer, by his own hand. The tenor of the record or registration of the above-included foundation is of this kind: Done at the Lower Castle in Lviv on the Friday nearest before the feast of Saint Matthew the Apostle and Evangelist, in the year of our Lord one thousand six hundred and fifty-nine. Before the office and present castle starosta acts of Lviv, appearing personally the illustrious Jan of Sobieszyn Sobieski, Crown Standard-Bearer, Starosta of Jaworów, being of sound mind and body, having abandoned any of his proper court and having bypassed his own jurisdiction, and having voluntarily accepted the present Lviv castle starosta [jurisdiction] upon himself, his descendants, and his estates generally all, as far as it pertains to this act, openly, publicly, and voluntarily testified: That he, a certain manual letter by himself, the testifier, because of certain things and conditions expressed in it, with its action and date here in Lviv, on the nineteenth of September of the current year, for the benefit and persons of the religious fathers brothers of the Order of Blessed John of God, called Brothers Hospitaller, prepared and written, signed and sealed by his own hand, the testifier, strengthened by a bond of thirty thousand Polish zlotys, in all conditions, points, clauses, articles, knots, bond, obligations, and benefits of the same letter in general all, he corroborates, confirms, and ratifies. Recording himself with his successors on the estates generally all, movable and immovable, hereditary and pledged, [f. 4r] and all sums of money possessed and to be possessed, to hold, fulfill, execute, and inviolably preserve the same letter; and to satisfy it both in whole and in any of its smallest part – relating the mentioned letter to the present registered record, and the present registered record to the mentioned letter mutually and reciprocally. And this under the above-written bond of thirty thousand Polish zlotys, to be paid and forfeited by the above-written illustrious testifier and his descendants, in case of any violation against the present registered record and the mentioned letter, to the mentioned religious fathers brothers of the Order of Blessed John of God or their successors. For which bond, in the manner mentioned above, fallen to payment and violated, and in case of non-fulfillment of any thing and condition of the present registered record and the mentioned letter, nevertheless having to be fulfilled, the aforementioned illustrious Crown Standard-Bearer testifier with his descendants legally summoned, renouncing the proper court as above, before the present Lviv castle starosta office, to which he submits and incorporates himself with his descendants and his estates in general all in this part, on the first summons of the mentioned religious fathers brothers of the Order of Blessed John of God or their successors, he shall be obliged and bound to answer categorically, to appear, to be obedient to the law [f. 4v] and to bear any judgment with his descendants; the first term and all others following from this always peremptory, not evading or escaping by any postponements in general all, evasions, suspensions, defenses, prescriptions, protestations, legal obstacles, and any objections, motions, and their support, affairs of the Republic, royal letters or exemptions, true or ordinary illness, minority of successors, action pro maiori, ad munimenta, ad quietiorem, and in general all legal means and defenses, but rather renouncing them in whole, but to the present registered record and all its contents and the bond of the mentioned letter, as often as it will be necessary, having paid, to satisfy, obliging and encumbering himself, his successors, and his estates in general all to this. By means of this his personal testimony in everything and in each one individually. Extracted from the Lviv castle starosta acts. Michał Sebastian Wyszowaty, Lviv castle scribe, by his own hand. Place + of the seal. WE, HOWEVER, JAN TARNOWSKI, ARCHBISHOP aforementioned, desiring to bring the pious and praiseworthy intention of the above-named most illustrious lord Crown Standard-Bearer and founder to the desired end, first of all, the mentioned summoned, expected longer and beyond the hour of hearing, and not appearing, we have recognized as disobedient [f. 5r] as they justly deserved, by the counsel of justice, and in their absence, after mature deliberation and due and diligent examination of this matter, considering above all that all and individual formalities from the provision of the constitutions of the Apostolic See, as well as the statutes of the holy Council of Trent issued about establishing new monasteries have been fulfilled; therefore, having invoked the name of CHRIST, we have recognized the above-included foundation and record of the principal sum of thirty thousand Polish zlotys and the annual rent of two thousand and one hundred zlotys in all and individual their points, clauses, articles, and conditions all as worthy of approval, confirmation, ratification, granting of the force of ordinary authority and eternal durability, as well as the judgment for this as worthy of being issued, the mentioned principal sum together with the annual rent as worthy of being assigned, incorporated, and included in the freedom and ecclesiastical immunity, and on this principal sum of money and annual rent, a formal convent or monastery or hermitage and hospital, as well as the religious fathers and brothers of the mentioned Order of Blessed John of God, commonly called Brothers Hospitaller, guardians of hospitals and the sick, on the model of other churches and religious convents and their order, at the Church of St. Lawrence located and existing in the Lviv Suburb, as worthy of being erected, founded, and endowed; the mentioned Church of St. Lawrence, after the abolition and cancellation of the prebendary title, after diligent consultation, which we held with the venerable Lviv chapter, our brothers, and by the unanimous and express consent of the worthy [f. 5v] magistrate of the city of Lviv, as patrons and provisors of the mentioned church, as worthy of being assigned, incorporated, and included to the same fathers and brothers of Blessed John of God with all the fruits, benefits, incomes, rents, plot, land, and other appurtenances of the same church and all its surroundings, and the authorization and permission for the erection and construction of the monastery, convent or formal hermitage and hospital to the same religious of the mentioned order from our certain knowledge as worthy of being granted, and their introduction to it, and once introduced, as worthy of being maintained and preserved in their use and peaceful possession for eternal times – as we also actually approve, confirm, ratify, impose, assign, incorporate, include, erect, found, endow, assign, grant, introduce, maintain, and preserve; and so that there the religious fathers and brothers of the said order, now and for times being and staying, according to the laws and custom and the provision of their rule, as well as regular observance and decrees of the Congregation of Interpreters of the Holy Council of Trent, in peace of spirit and body might freely serve the Highest, from now on we permit and by anyone it should be permitted, we want and decide. Furthermore, we decree and decreeing for eternity we decide, that the parish church of the place or plot and land and the church of the mentioned and all their appurtenances and surroundings, on which the convent or monastery and hospital was recently erected by us, from the same convent and hospital, as it is said, newly erected, and its superiors and religious persons of any kind, together with their temporal rectors and servants, should never suffer or have any detriment, damage, and diminution or reduction in their incomes by reason of the administration of church sacraments, both [f. 6r] voluntary and necessary, funerals, serenades, and other any incomes all and each one individually, nor any obstacles in parish rights, which we want to have expressed here. Which church and its rectors and servants we want to enjoy, possess, and use in whole and in full by this our declaration with the same parish rights and ancient customs. And if anything, any violation by reason of this kind of rights (from which may God preserve) should arise, then the mentioned church, monastery or convent and hospital and the newly established religious for the given time being, for eternal future times shall be subject to our ordinary jurisdiction and of the most illustrious and most reverend our successors, Archbishops of Lviv, and their any commissaries or officials for eternity, and they shall not be able to shield themselves by any exemptions, objections, appeals, and legal and factual means. Which our decree, decision, and declaration we extend and expand to all and individual parish and any other churches lying inside and outside the walls of the city of Lviv, and the right of summoning before us and our most reverend successors and their commissaries as well as any officials we leave to the same churches forever, and we issue the letter of approval and confirmation of the foundation and erection in the usual form.
