ALBERT of Pilica KORYCIŃSKI, by the Grace of God and the Apostolic See ARCHBISHOP OF LVIV, GENERAL PROVOST OF MIECHÓW
To all and singular whom it may concern, by this Our Letter, intended to have force for all time in eternal memory of the matter, We announce and deem it worthy that what is piously done for the glory of Almighty God and the increase of His worship in the expansion of the churches of Our Archdiocese, and for the salvation of souls redeemed by the precious Blood of Our Lord JESUS Christ by Christ's faithful, pious priests and religious men, should be inviolably crowned with perpetual testimonies of writing. Since, therefore, the religious and most venerable father brother Mikołaj Lassota, Prior of the Order of Hermits of Saint Augustine of the convent outside the walls of the city of Lviv, on behalf of his convent, has represented to Us how they, by the special grace and privilege of the late Most Serene Władysław IV, invincible and most fortunate King of Poland, and also by the permission and erection of the late most reverend Stanisław Grochowski, Archbishop of Lviv, Our predecessor, possessing a certain place and land in the Halych Suburb of the same city, commonly called Mostki, granted for the church and convent of his order, and having a church and formal convent erected and built on this place, several times due to the hostile Cossack-rebellious invasion and the last Muscovite one, as they were adjacent and closest to the ditches, ramparts, walls, and bastions

of the city of Lviv, were destroyed by fire along with the church and all structures and buildings. And hence they went to the Most Serene Prince MICHAEL, by the grace of God King of Poland, Grand Duke of Lithuania, etc., happily reigning, through the most illustrious envoys of the Ruthenian Voivodeship to the General Crown Sejm, requesting that they might be moved to another place, more convenient and safer and further removed from this city, and on it might erect and build a church and convent for the fathers and brothers of their order anew, and according to their state and religious vocation serve God the Best and Highest immaculately and contemplate heavenly things more freely. And when they obtained special consent for this from His Royal Majesty through the intercession of the most distinguished and most reverend dignitaries of the Kingdom, and were recommended by His Royal Majesty's letter to Us, as well as to the most illustrious and most venerable prelates and canons of Our metropolitan church, and also to the noble and distinguished mayor, councilors, and the entire magistracy of the city of Lviv, and received from the same noble council magistracy land and a place outside the walls of the same city in the Krakow Suburb, on which there exists a brick church under the invocation of Saint Anne along with other buildings, structures, appurtenances, and all accessories – they turned to Us with due diligence that We might grant Our metropolitan ordinary consent for the above and assign to them and the entire Order of Hermits of Saint Augustine the said Church of Saint Anne along with the land, buildings, structures, dwellings, and all other appurtenances and accessories, and approve, ratify, and confirm all and singular of this by Our ordinary authority. WE, however, after mature reflection of Our mind, desiring to provide everyone with an appropriate legal remedy, and above all desiring to provide in time from the heart for the public need of the defense of this city, so that it might not be captured due to nearby obstacles, and desiring to make [complete?] compensation to the aforementioned hermit fathers of the Order of Saint Augustine for such great damages suffered for the salvation of the entire city during several threatening dangers due to enemy invasion, finally decided that the request and plea of these fathers, as just

and consistent with equity, should be satisfied. However, so that by Our swift consent to the above it might not appear that We are causing prejudice to anyone, first of all, according to the custom and form observed in such matters, We ordered the issuance of citation letters [crida] with the force of a general summons against all and each individually who might claim a contrary legal title and interest, jointly or separately. Finally, on this day, as We sat before the tribunal for the administration of justice, the aforementioned most venerable father Lassota, Prior of the Lviv convent of the said order, appearing in person, having presented the crida letters separately expedited, executed by posting on the doors of the churches: the metropolitan in the city and Saint Anne outside the walls of the city of Lviv by the venerable Andrzej Wojnarowicz, priest, accused of non-appearance all and each individually summoned by the said crida letters, and those not appearing, and in their absence filed with due diligence and demanded that the grant or donation of the Church of Saint Anne outside the walls of the city of Lviv, made by the special benevolence of His Most Serene Royal Majesty, Our Gracious Lord, as well as with the consent of the noble and distinguished Lviv council magistracy, as the lawful patrons and collators of the same church, for the benefit of the entire order and its convent, along with all and singular rights of the same church, profits, revenues, incomes, gardens, appurtenances, and all accessories long belonging and pertaining to this church, be approved and confirmed, assigned, united, incorporated, and annexed, and that on the same land and place a church and convent of his order be ordered to be erected and built anew, and that letters of approval and confirmation of the union or incorporation and annexation and erection and foundation be ordered to be drawn up and issued in the usual form of law. We, however, ALBERT of Pilica KORYCIŃSKI, Archbishop of Lviv, seeing the crida letters duly announced in Our cathedral church from the pulpit before the people gathered for the hearing of the service and by posting on the doors of the same church, as well as Saint Anne's, having reviewed the letters of grant or donation of His Royal Majesty, seeing also the consent of the noble and distinguished Lviv council magistracy, having previously sought the advice of the most illustrious and most venerable prelates and canons of Our cathedral church, Our brothers, and having weighed and considered that all formalities from the provision of the constitutions of the Apostolic See, as well as the decrees of the Holy Council of Trent regarding the erection of new monasteries, have been fulfilled and announced, above all all and singular who from the opposite side had some right and

interest, jointly or separately, claimed pretensions to the said Church of Saint Anne and its land, houses, and gardens, and summoned by the said crida letters did not appear nor hinder the above, We deemed them disobedient to the law, and in their absence, and also on the basis of serious disputes of the intervening parties, which are known from Our acts, as is more broadly contained in the decree issued in the current year on the seventeenth day of the month of April, We decided that the grant or donation of the place and land, as well as the Church of Saint Anne itself, made for the benefit of the aforementioned fathers and brothers of the Order of Hermits of Saint Augustine of the Lviv convent, should be accepted, approved, and confirmed, and the aforementioned Church of Saint Anne along with the land, houses, and gardens and all and singular rights of the same church, profits, revenues, incomes, appurtenances, and all accessories long belonging and pertaining to this church – assigned, united, incorporated, and annexed, and on the same land and place a church and convent of the said order be erected and built anew, and those fathers and brothers of the Order of Hermits of Saint Augustine be moved and introduced from the place where they currently reside to the same holy church, as also having invoked the Name of CHRIST we accept, approve, confirm, ratify, assign, unite, incorporate, annex, erect, found, move, and introduce. And so that in the same place and church called Saint Anne the religious hermit fathers of the Order of Saint Augustine, present and future, according to the laws, custom, and provision of their rule, as well as the decrees of the Sacred Congregation of Interpreters of the Holy Council of Trent, may freely serve the Highest in peace of mind, we henceforth permit and ordain, with the rights of the parish church of this place and the said Church of Saint Anne and its accessories and appurtenances remaining inviolate. Namely, that the convent of the hermit fathers of the Order of Saint Augustine and its priors, subpriors, sacristans, and their deputies, as well as other officials and servants, should not cause or inflict any prejudice, obstacle, damage, or

any diminution whatsoever in the parish incomes and revenues by reason of the administration of church sacraments, both voluntary and necessary, and other parish obventions, which we wish to be considered as expressed here, to the parish church at any time. Finally, all and individual deficiencies, if any have occurred in any way in the above by law or by fact, we supplement by Our ordinary authority, and we order the necessary letters of erection and foundation to be drawn up and issued in the usual form. Done and given in Lviv in Ruthenia, in the Year of Our Redeemed Salvation one thousand six hundred and seventy-first, of the ninth Roman indiction, during the pontificate of Our Most Holy Lord, Lord CLEMENT, by Divine Providence POPE of that name the Tenth, in the first year, on the day of Friday, the seventeenth of the month of April. In the presence of the most illustrious and most venerable: Paweł Józef Leszczyński, Doctor of Sacred Theology, Dean of Kamieniec, Provost of Kołomyja; Marcin Rzechowski, Apostolic Protonotary, Dean and Provost of Rohatyn; Mikołaj Zychyni, Doctor of Both Laws, Pastor of Halych; Kasper Czekajski – canons of Our Lviv cathedral church; and the noble and distinguished Maciej Kuczankowicz, Doctor of Both Laws, Secretary of His Royal Majesty, Notary by Apostolic Authority and Chancellor of the affairs of Our curia, and many other credible witnesses.
