Anno Domini M.D.C.XC.IX. Regni vero Nostri III. Anno [1699] · Warsaw (in Arce Nostra Regia Varsaviensi)

King Augustus II confirms the statute of the Tailors' Guild in Przemyśl, enacted in thirty-one articles and previously confirmed by municipal authorities. [Top right, later note:] No. 5, Year 1704 [Decorative header:] AUGUSTUS II, BY THE GRACE OF GOD, KING OF POLAND, GRAND DUKE OF LITHUANIA, Ruthenian, Prussian, Masovian, Samogitian, Kievan, Volhynian, Podolian, Podlachian, Livonian, Smolensk, Severian and Chernihivian, and also hereditary Duke of Saxony and Prince-Elector. To all and each one whom it may concern, we hereby announce by this our letter: A paper document has been submitted to us, signed by the hands of the worthy mayor, councilors, and the municipal scribe of our royal city of Przemyśl, strengthened with the municipal seal, containing the proper order and regulation of the articles serving the tailors' guild of the same city, written in the Polish language. We have been humbly requested to deign to approve, confirm, and ratify the said document with our royal authority. The content of this document follows in this manner: We, the Mayor and Councilors of His Royal Majesty's City of Przemyśl. We make known by this our letter to whom it should be known: That, inclining to the petition of the famous guild masters, seniors and juniors, and the entire tailors' guild of the same city of Przemyśl, who during the plenary session of our Council Office begged us in the name of their entire guild to confirm, strengthen, and approve these points with our authority. We, therefore, having considered the matter just, having weighed these points submitted to the tribunal of our Council Office with our mature judgment, in all conditions, clauses, and obligations, confirm, strengthen, and approve, the content of which articles is as follows: We, the sworn guild masters of the tailors' guild of the city of Przemyśl, with all brothers, both seniors and juniors [...] of the Greek religion, by the calling of the guild gathering into the guild, diligently watching over the office [...], as in these times everything has risen and things go differently now than before, wishing to have good order in our guild, so that first God may have glory, and then the Commonwealth of this city may derive increase, having a diligent eye on this, especially during the time of devastation by the enemy of the Crown, for the order of this city of Przemyśl and the Commonwealth, we ordain. Regarding our tailors' brotherhood, which we have long had handed into our hands by Their Lordships the Councilors, which we promise to provide with weaponry, clothing, handguns, and other weaponry, ammunition, and equipment. And seeing that the true income from the guild chest cannot suffice for this, therefore, not out of any compulsion, but out of sincere desire and love for the expansion of God's glory at our altar under the invocation of Saint Nicholas in the Przemyśl cathedral church and for the service of this city, according to our resolution, we have decided and for eternal times decide the articles described below, the content of which articles is as follows: Article one: First, that there be free election of guild masters, both from the Polish [Roman Catholic] and Greek religion. Article two: That every apprentice who has worked for a master for six weeks – and if he has not worked, he is to give six pounds of wax – and not a boy, who joins the guild and wishes to be accepted as a master, must first accept municipal law. A new brother joining the guild who would not want to write a piece [masterpiece] of this craft, should give an entrance fee of thirty zlotys; that brother, however, who wrote a piece, should give only fifteen zlotys. He should write this piece three times: at the first time, when he is to write, six master gentlemen must be present; at the second writing, four master gentlemen must be present; at the third writing, the guild master must be present [...], so that at this writing all are present, and he is to provide a treat three times according to the instruction given to him. So also that brother [...], who withdraws from the piece, should provide a similar treat to the guild brothers, and he is to satisfy all this within two weeks and is not to perform the craft until he has fulfilled it. Article three: The same joining brother should provide an entrance treat [...] before the master gentlemen, and also from his liberation he should give six pounds of wax, and a quarter of a stone of gunpowder, a quarter of a stone of lead, a good matchlock musket – all this is to belong to the tailors' brotherhood. So also he is to perform church and guild service for a year and six weeks; upon the completion of this service, he should provide a solemn treat for the brother gentlemen, about which he will be instructed by the assigned senior brothers. The same master, having fulfilled everything regarding the guild, will be able to keep three apprentices and a fourth boy, and no more; and if he were to keep more, he is to give two pounds of wax as a fine for each. Article four: Master's sons, who are born in the guild, should not write a piece more than once, without imposing any piece on them beyond custom; and if any did not want to write, he is to give an entrance fee of fifteen zlotys, three pounds of wax, half a quarter of a stone of gunpowder, also lead, and a musket, and should perform a treat together with the brothers in the guild. Article five: As for the election of guild masters, who will be chosen at the guild from among the guild master gentlemen, without evasions, both from among the Romans [Catholics] and Greeks [...], the senior guild master is to be chosen by the senior [...] during the election, which should take place on the Sunday after Corpus Christi. Whichever brother would despise the elected guild mastership, is subject to a penalty of a stone of wax. In a similar manner, which brother would be called and did not appear at the election and was the cause of this, also falls into a penalty of a pound of wax. The guild masters, however, who are stepping down from the guild master office, should be presented as candidates. Article six: For judging guild matters, there are to be six brothers: three Romans and three Greeks, who should sit according to the seniority of years, as each brother joined the guild. From among these six brother gentlemen, key-holders are to be chosen: one Roman and two Greeks. Article seven: Amicable guild matters are to be judged by the guild without leaving an appeal, unless in a matter from a property verdict it would not belong to the guild – then the appeal is to be free. Article eight: A younger brother in the guild is to serve until a newly accepted one joins the guild; the same for [...] unnecessary to the same guild is to give half a stone of wax. If he does not marry in the third year – a stone of wax fine; if in the fourth year – he loses guild rights. Article nine: A younger brother in the guild should serve as long as another brother does not take his place. At the altar of St. Nicholas, he should watch the candles, and if he were negligent in this, he is to give a penalty – a pound of wax. On solemn holidays, that is, at Easter, at Pentecost, at the Holy Trinity, at Corpus Christi, at the Assumption of the Blessed Virgin Mary, at the Nativity of the Virgin Mary, at Christmas throughout the entire octave, at matins, masses, vespers, he is to diligently perform service, so that he neglects nothing. For neglect – a penalty of a pound of wax. Article ten: If any brother were to wet or damage cloth, or cut it, no other brother may accept it or repair the cloth; and if he were to do so, what he takes for the work, he should give to the brotherly chest. Article eleven: If any master were to entice [refuse obedience or persuade to leave] an apprentice, boy, lad, worker, or servant from another master, he is subject to a penalty of half a stone of wax. Article twelve: If any master or brother were to negatively assess or criticize the work of another brother, and were convicted by two witnesses, he should give a penalty of half a stone of wax. Article thirteen: If any brother did not come to the guild upon a guild summons, and the chest was already open, such a disobedient one is to give a groschen to the chest. Those brothers who are not at home are to be designated by [...]. Whoever would neglect the guild throughout the entire period of his service and did not appear for a year and six weeks, such a one loses guild rights. Article fifteen: Every brother, once he is called to the guild, is to have a saber and [...], and the younger brothers equipment. The remaining widow is to give half a pound of wax. The deceased brother should be buried together by the younger brothers in order and they should dig the grave together one with another, and if they neglected this out of reluctance, [...] is forfeited. Article sixteen: The widow remaining after a tailor has the right to practice the craft until she marries; the widow remaining without offspring may practice the craft for a year and six weeks, and no longer. Article seventeen: Every master should be present at funerals, as well as the younger brother who is performing service at that time. Article eighteen: Whoever among the brothers made quarrels or reproaches during the guild prayer or other guild matters, or grabbed one another, such a brother falls into a penalty of half a pound of wax. Article nineteen: Local masters, both Romans and those of the Greek religion, are not to come to the town hall or to the guild with any weapon, under penalty of a pound of wax. Article twenty: Every brother is to conduct his affairs with the brothers every quarter, except for one guild master, who may [...] tell, under penalty of a pound of wax; and upon summons, he should appear when a complaint arises from another brother. Article twenty-first: Every brother who would accept a boy for learning the tailoring craft is not to keep him longer than two weeks without reporting, but after two weeks he should report him to the guild and register him under penalty of six pounds of wax. And this accepted apprentice is to give sixteen groschen to the guild masters upon registration [...]; upon his liberation, he is to give four zlotys to the Przemyśl guild and twelve groschen to the guild scribe. He is to learn the craft for a whole year, as he agrees with the master, and for service, it is to be three years. Article twenty-second: Every brother is to give a groschen to the guild chest every quarter during the ember days. Furthermore, for two weeks they will gather on both ember days to conduct brotherly affairs. If, however, any brother were to tell or carry out secrets or guild matters, and were convicted of this by two witnesses, such a brother falls into an unforgivable penalty of half a stone of wax. Article twenty-third: No brother is to take money from the guild chest until he first deposits a pledge in gold or silver, or writes a security on a brick property that would not be encumbered by anything, and gives a guarantee to the guild. Article twenty-fourth: A brother who would spoil someone's dress or garment through his incompetence or negligence is to justify himself for this in the guild [...], and they are to consult with the brothers under penalty of two pounds of wax. Article twenty-fifth: If at any burgher's, suburbanite's, or outside the jurisdiction on a cart and gates, people subject to the tailoring craft were found working illegally, he is to give a stone of wax; and as often as he would dare to work, and will be convicted by the testimony of credible people – even if he were not caught at work, as long as it is proven by testimony that he performs the craft – the same is subject to the penalty. Article twenty-sixth: Masters of the tailoring craft, whether living at Their Lordships the Canons in their manors, or under the jurisdiction of the bishop, or in any other tenement houses and noble manors, are to belong to the guild equally with those living on municipal lands and should proceed according to the guild articles, with the exception of ecclesiastical manors [...], from which, however, if the servants wanted to perform the craft besides the ecclesiastical habits themselves, in order to earn bread, then these too should perform guild duties and bring all payments to the chest. Article twenty-seventh: One should not approach or buy out another in his dwelling under penalty of a stone of wax. Article twenty-eighth: No master or apprentice should sue another in any other court, only directly to the guild, which the brothers recognize, under penalty of a pound of wax. If, however, any party wanted to appeal to the Lords Councilors from a guild verdict, and this verdict were upheld, such a brother or apprentice should give a second pound of wax as a penalty. Article twenty-ninth: And because [...] they attempt to perform new tailoring work and publicly carry goods through the streets during sejmiks to the detriment of the guild, no guild member is to undertake work for Jews or sell it to them, unless they buy for their own need. Whoever would be caught in this should give a stone of wax as a penalty without forgiveness on the basis of testimony and report. The same is to be understood about Jewish peddlers, that they should not sell caftans, cloth ribbons, gloves, laces, skirts, new jackets; the same is to be understood about junk dealers and Jewish tailors, who should not do any new Polish work to the hindrance of the guild. And where peddlers and junk dealers would have such new work for sale in their stalls, junk dealers exhibited, and Jews sold in shops, then the tailors' guild with the permission of the Lords Councilors is to take such goods from them, about which they are to notify the Przemyśl judge, so that he may punish them. Peddlers and junk dealers are to fall into a penalty of two stones of wax, which is to go to God's glory: half to the Przemyśl cathedral to the sacristan, and half to the guild altar of Saint Nicholas in the church. Article thirtieth: It is to be permitted for guild masters in general to perform such work. Article thirty-first: Finally, wherever in the city of Przemyśl in ecclesiastical or noble manors and tenement houses there would be found bunglers hindering the guild in work, such are to be punished with the knowledge of the Municipal Office and according to the privilege of His Royal Majesty. Which articles we, the undersigned Mayor and Councilors of His Royal Majesty's City of Przemyśl, sign with our hands and confirm with the municipal seal. Jan Kuźmicz, Mayor of HRM Przemyśl; Franciszek [Dziubek?], councilor; Paweł Stanisław Waryocki, councilor of the city of Przemyśl; Stanisław Janczarewicz, councilor of the city of HRM Przemyśl; Jan Wachowski, scribe of the city of HRM Przemyśl. Place of the municipal seal. We, therefore, AUGUSTUS KING, kindly inclining to the request of the mentioned Przemyśl tailors as just and corresponding to reason, consider the above-written document in all its points, clauses, articles, connections, and obligations worthy of approval, confirmation, and ratification, and insofar as it corresponds to common law and customs, we approve, confirm, and ratify, ordaining that it is to have the power and weight of proper durability and eternal constancy.
