[Drawing of the Abdank coat of arms under a crown] To all and each person concerned, or who in any way in the future may be concerned, by this letter intended to preserve the memory of the matter for eternity, we make known. He offers a sacrifice and brings pleasing incense to the Highest Deity [f. 3v (pagination 4):] whoever turns property acquired by their own labor not entirely to secular benefits, but as a sign of recognition of the Highest Lord, God Almighty, offers some part of it for the multiplication of His glory and for the adornment of the Church Militant, for in this way they shall gain an eternal reward in the Church Triumphant. Not forgetting this, the distinguished and most reverend Antoni Gomoliński, pastor of Tołszcz in our Archdiocese of Lviv, sincerely devoted with all his thought to increasing – according to the measure of his possibilities – the divine cult in our metropolitan cathedral church of Lviv, has brought, donated, and actually and effectively paid in cash to the procuratorial office of the most reverend chapter the sum of six thousand zlotys of Polish currency for the foundation of a supernumerary canonry in this same cathedral church of ours, after obtaining our consent in this matter; this amount, at the current general March chapter, for the perpetual consolidation of this foundation, was located by the most reverend chapter on the goods of the village of Miłoszewice, situated in the Ruthenian Voivodeship, in the land of Lviv, and its official registration was made by the noble Stanisław of Wieniawa Wieniawski, cup-bearer of Żydaczów, deputy-starosta of Przemyśl, heir of these same goods of Miłoszewice, for an annual redeemable rent, payable at seven zlotys for every hundred. And since all the above provisions would have no power at all if they were not strengthened by the authority of our ordinary power and were not recognized as permanent for all time, therefore the aforementioned distinguished and most reverend Antoni Gomoliński turned to us with a request that we deign to recognize this pious intention of his as legal and pleasing, to erect a supernumerary canonry, to assign and designate the recorded sum as an endowment for it, to assign and include it in the ecclesiastical liberty and immunity, and to give all these acts the power [f. 4r (pagination 5):] of ordinary power and perpetual durability. We, wishing to preserve the manner and form accepted by law and practice in similar matters, first of all considered it appropriate to issue edictal letters, that is, a public edict, and ordered them to be issued from our chancellery, as they were indeed issued and announced. Therefore, on the date falling from these edictal letters, the aforementioned distinguished and most reverend Antoni Gomoliński appeared before us, sitting in the tribunal for the administration of justice to the parties, and after accusing of non-appearance all and each person who, from the opposite side, thought or claimed any right or interest, jointly or severally or in any way, to this case of the new foundation and erection, and who were summoned by edictal letters and did not appear – due to their non-appearance, he submitted the official record of the above-mentioned sum of six thousand Polish zlotys, authentically extracted from the Lviv starosta castle acts, asking for its approval, confirmation, ratification, the granting of the power of ordinary authority and perpetual durability, and for his appointment and investiture to this same canonry, as well as for ordering and ruling on other necessary and appropriate matters in this regard. The wording of this record follows and is as follows: Done in the lower castle of Lviv, on the Saturday after the Sunday of Reminiscere of Lent, nearest, in the year of our Lord one thousand seven hundred and thirty-two. Before the office and the present starosta castle acts of Lviv, the noble Stanisław of Wieniawa Wieniawski, cup-bearer of Żydaczów, deputy-starosta [f. 4v (pagination 6):] of Przemyśl, appeared in person, being sound in mind and body, renouncing all his proper court and withdrawing from his own jurisdiction, and voluntarily accepting the current Lviv starosta castle jurisdiction for himself, his descendants, and his goods in general, regarding this act, openly, publicly, and of his own free will acknowledged that he himself had received and actually taken the sum of six thousand Polish zlotys, deposited by the noble and most reverend Antoni Gomoliński, provost of Tołszcz, for the foundation of a supernumerary canonry in the metropolitan church of Lviv, from the hands of the most illustrious and most reverend gentleman Father Antoni Brześciański, nominee suffragan and official, and the noble and most reverend gentleman Father Marcin Łosowski, cathedral canon and procurator of Lviv. Which received sum of six thousand Polish zlotys he brings and secures on his own and hereditary goods in general, and especially on the goods of the village of Miłoszewice, lying here in the Ruthenian Voivodeship and in the current land of Lviv, by the right of wyderkaf, otherwise for wyderkaf, and securing this sum, an annual redeemable rent, counting seven for every hundred, to the hands and for a handwritten receipt of the current noble and most reverend Mr. Procurator of the venerable arch-cathedral chapter of Lviv or his successors – which receipt should be considered credible – and this starting from the present act, on a similar Saturday in the year of our Lord one thousand seven hundred and thirty-three, by the grace of God future, [f. 5r (pagination 7):] every year, until the payment of the original sum, in whole and in entirety, not paying attention in the future to years of disaster, to give, pay, and actually and effectively deposit and leave before the office and the present acts, and not to resume the deposited and left sum back from there, nor in any way to arrest or disturb it, on and from his goods in general, movable and immovable, hereditary and pledged, debt scripts, any monetary rights, possessed and to be possessed, and especially on the said village of Miłoszewice, he binds and obligates himself together with his successors. And this under a similar penalty of the sum of six thousand Polish zlotys regarding the principal sum, and regarding the interest under a penalty corresponding to the annual rent, to be paid, settled, and borne by him, the declarant, and his descendants in case of any violation of this wyderkaf record and failure to fulfill all and individual conditions contained therein, to the same noble and most reverend Mr. Procurator of the same venerable chapter, present and for the given time being, without any evasion. For which penalty, due to be paid and exceeded in the manner described above, and in case of failure to fulfill any condition of this redeemable record, which nevertheless must be fulfilled, [f. 5v (pagination 8):] the above-mentioned noble declarant, summoned by law together with his descendants, renouncing the proper court as above, before the current starosta castle office or the Lviv consistory court – to which or whom he submits and incorporates himself together with his descendants and all his goods in general in this regard for an answer – will be bound and obligated to answer, appear, satisfy the law, and accept any verdict together with his successors or descendants upon the first summons of the said venerable chapter of Lviv, present and for the given time being. Always considering the first term, as well as all others resulting from it, as peremptory, not avoiding them by any postponements in general, evasions, suspensions, defenses, protests, statutes of limitations, legal obstacles, and any objections, motions, appeals and their support, matters of the Republic, military service, embassy in the country or abroad, peremptory terms of law, land statute of limitations, war, interregnum, convocation, matter of majority or minority of successors, true or ordinary infirmity, safe-conducts or exemptions from appearance, and in general not hiding behind any means and defenses of the law nor in any way escaping from them, but rather completely renouncing them; but to satisfy this wyderkaf record in all its provisions, after paying the penalties as many times as necessary, before the court, [f. 6r (pagination 9):] binding and burdening himself, his successors, and all his goods in general by the power of this testimony. We, therefore, Jan Skarbek, Archbishop of Lviv, after seeking the advice of the noble, most reverend, and very reverend prelates and canons of our Lviv cathedral church, first of all, we considered all those summoned who did not appear as disobedient, and due to their non-appearance, after viewing and reading the record of the aforementioned sum of six thousand Polish zlotys, inserted above in its wording, we considered it worthy of approval, confirmation, and ratification in all and individual points, clauses, articles, and all conditions, and we approve, confirm, ratify, and grant it the power of ordinary authority and perpetual durability. We erect and establish for eternity a new supernumerary canonry of the Gomoliński foundation with all rights and privileges belonging to supernumerary canons by the power of ancient custom in our cathedral church, and for such an erected one, for endowment and bearing burdens, we designate, assign, and attach the above-mentioned sum of six thousand Polish zlotys [f. 6v (pagination 10):] and the rent derived from it, in such a way that the current founder and subsequent canons of this foundation may and have the right to collect, receive, and turn to their own use the said rent from the said goods perpetually and forever; and furthermore, we designate and include this sum in the ecclesiastical immunity and liberty. The right of patronage and collation of this same canonry we assign to the same founder for his lifetime, and after his death to us and our successors, the Archbishops of Lviv, for one turn, and for the second turn of vacancies to the most reverend chapter of our cathedral church according to the will of the founder forever, with the addition, however, of the condition that a candidate from the house and family of Gomoliński be chosen, if he is capable, worthy, and able to bear the burden of the canonry, and if not, then also someone else. And so that this may happen more effectively and the news of the vacancy may reach the Gomoliński house, we decide and order for eternity that in such a case notification letters be announced in the collegiate church of Jarosław, and let the same right of patronage always be considered secular, since benefits due from the foundation act to a specific family of persons are not subject to reservation [f. 7r (pagination 11):] to the Apostolic See, according to Monacelli, part 1, in the appendix to the forms, p. 394. And since the benefit is granted for an office, it will be the duty of this newly founded canon that he celebrate one mass for the Blessed Virgin every week and perform functions by the custom of other supernumerary canons and be present at choir services. And so we decide, resolve, and order, not only in the manner described above, but in every most perfect way. And immediately we considered the aforementioned distinguished and very reverend Gomoliński, the founder, as called and invested to this newly founded canonry, and after receiving from him the usual corporal oath regarding the faithful preservation of the profession of the Catholic faith, as well as regarding not alienating the income of this canonry, but rather, if they were diminished, about their recovery according to possibility, as well as about obedience and respect for us and our most illustrious and most reverend successors, [f. 7v (pagination 12):] Archbishops of Lviv, by the laying of our hands on his head, we introduced him to the office and invested him in the Name of God. In testimony of which, we ordered this letter, signed by our own hand, to be strengthened with our seal.
