Confirmation of the rights and privileges of the Shooting Brotherhood in Lwów by King Augustus III
King Augustus III confirms the ancient privileges and immunities of the Shooting Brotherhood of the city of Lwów, granted and confirmed by his predecessors: Sigismund Augustus, Henry Valois, Sigismund III, John Casimir, Michael Korybut, John III Sobieski, and Augustus II. The confirmation includes, among others, the collection of a fee called 'szpaszne', a share in customs revenues, tax privileges and exemptions for the Shooting King, the order of shooting exercises, and the return of the occupied shooting range (celstat).

AUGUSTUS III, BY THE GRACE OF GOD, KING OF POLAND,
Grand Duke of Lithuania, Ruthenia, Prussia, Masovia,
Samogitia, Kiev, Volhynia, Podolia, Podlachia,
Livonia, Smolensk, Siewierz, and Chernihiv,
AND ALSO HEREDITARY DUKE OF SAXONY AND PRINCE-ELECTOR.
We hereby announce to all and everyone whom it may concern: that a parchment document of the Most Serene, of blessed memory, Augustus II, King, our most beloved Parent, signed by his own hand and reinforced with the seal of the Lesser Crown Chancellery, whole, sound, and intact, and free from any suspicion, containing the confirmation of letters, privileges, rights, and freedoms granted by Our Most Serene Predecessors, Kings of Poland, to the Shooting Brotherhood of the City of Lwów, has been presented to Us, with a request directed to Us that We might deign to approve and confirm them with Our Royal authority. The content of this document is as follows: Augustus II, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Kiev, Volhynia, Podolia, Podlachia, Smolensk, Siewierz, and Chernihiv, and also hereditary Duke of Saxony, Prince and Elector. We hereby announce to all and everyone who shall have knowledge of this. That since, by the grace of Heaven, we have been called to the helm of the scepter of the most famous Kingdom of Poland and have deserved to be adorned with the Royal Crown, there is nothing we can have more in our wishes and desires than to abundantly strive for the benefits and advantages of Our subjects. Therefore, having learned that Our City of Lwów is so trained in all arts of municipal administration, in war and in peace, that it deserves the name of the bulwark and invincible fortress of almost the entire Kingdom of Poland,

and escorted Us ourselves, recently setting out for the holy war against the Ottoman power, with all proofs of honor and glory; as soon as it was reported to Us by certain of Our Councilors, then assisting at Our Side, that this city stands strong especially thanks to the Shooting Brotherhood and abounds in constant practice in this art, and the superiors of that Brotherhood themselves, the noble and most worthy men Jan Michał Kotorowicz and Józef Kazimierz Wilczek, Our secretaries, councilors of Lwów, having appeared before Our Majesty, presented privileges for this kind of exercise and the immunities associated with them, observed almost since the founding of the city, and confirmed by the Most Serene Predecessors, namely Sigismund Augustus, and subsequently also by the Most Serene John III, Our Predecessor, by a solemn diploma in Warsaw on April 8, 1677, signed by his own hand and provided with the crown seal, requesting Us through these Our Councilors that We might deign to confirm, approve, and clarify these their rights and privileges with Our Royal authority, and supplement any deficiencies. The content of that document is as follows: John III, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Kiev, Volhynia, Podolia, Podlachia, Livonia, Smolensk, Siewierz, and Chernihiv. We hereby announce to all and everyone whom it may concern. Although already at the very auspicious beginning of Our Coronation we confirmed with an oath, laws, and letters (by which, as if by the strongest bonds, human memory, which is fluid and fallible, is accustomed to be strengthened) all rights and privileges both of all Our estates and subjects in general, and in particular of Our City of Lwów. Nevertheless, we consider it the duty of Our royal office that those who, in the uninterrupted course of times, and even moments, have deserved well of Us and the entire Commonwealth with constant loyalty, obedience, and with their strength and property, should experience from day to day from the Majesty of Our Royal Summit ever greater proofs of generosity and kindness, whenever an opportunity arises in need. For this reason, we take the aforementioned City of Lwów and its requests under our protection all the more fervently and with greater obligation, the more convinced we are that it cares from the heart for its preservation, defense, and knightly skill in the event of any enemy attacks. Therefore, when the noble and most worthy Jan Stefan Ubaldini, councilor and then delegate of the city of Lwów, as elder of the Shooting Brotherhood, presented before Us an original parchment document, containing the confirmation of the rights and privileges graciously granted to the same Brotherhood of Lwów Shooters by Our Most Serene Predecessors, made in Lwów on the 30th day of October in the year of our Lord 1671 by the Most Serene, of blessed memory, Michael,

Michael, King of Poland, Our Predecessor, signed by the own hand of the Most Serene Michael, Our Predecessor, and reinforced with the crown seal, and requested Us through certain of Our Councilors that We might deign not only to confirm this document with Our Royal authority, but also to improve it in certain points for the reasons described below and to supplement any deficiencies. The content of that document is as follows: Michael, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Livonia, Kiev, Smolensk, Siewierz, and Chernihiv. We hereby announce to all and everyone whom it may concern. That the five parchment documents described below have been presented and shown before Us in their intact originals. The first of them, inserted here in its full wording, signed by the hand of the Most Serene John Casimir, Our Predecessor, and sealed with the crown seal of the Greater Chancellery, hanging in a tin box. The content of this first document follows in this tenor: John Casimir, by the grace of God, King of Poland, Grand Duke of Lithuania, Ruthenia, Prussia, Masovia, Samogitia, Livonia, Smolensk, and Chernihiv, and also hereditary King of the Swedes, Goths, and Vandals. We hereby announce to all and everyone whom it may concern: That Sigismund III, of blessed memory, Our most beloved Parent, granted to the Shooting Brotherhood of Our City of Lwów, most usefully established in the same city for the purpose of averting and repelling threatening enemy attacks, the power and consent to collect for the benefit of the same Brotherhood a fee commonly called 'szpaszne', from all merchants driving oxen and other cattle and herds of any kind from Wallachia and elsewhere, both to the Crown and outside the Crown, and detaining them on the Lwów territory and beyond for several days or for a certain time on pastures – one grosz from each ox from the herd, and from smaller cattle from the herd half a grosz, for eternal times. However, since in that permission the space or distance of the place within which the aforementioned collection is to apply to them was not strictly defined, therefore, for the removal of any uncertainty that could arise from this, by this Our Rescript we clarify and decide that this permission is to reach and extend to twelve miles. So that the aforementioned Confraternity of Shooters could and would have the right to freely collect this fee from the aforementioned cattle and herds, and that from all merchants, without anyone's opposition and obstacle, for a distance of the aforementioned twelve miles. And so that this Brotherhood might know the proof of Our favorable will and royal generosity for its merits, amply proven in the repulsion and rejection from the walls with their significant defeat of the treacherous and rebellious Cossacks, who recently with a huge multitude for several weeks persistently tried to capture this city – thanks to the proficiency and shooting skill of the brothers – to the same Shooting Brotherhood for the increase and preservation of its integrity and for the cultivation of exercise in the art of shooting we grant all right and power of collecting

from all foreign and visiting merchants, arriving from any sides and nations to this city both for regular fairs and at any other time for the storage of goods, or returning from there – from every hundred florins, whether in cash brought in for trade purposes, or in their goods of any kind and species, after their valuation by the aforementioned merchants under oath – one grosz, and turning it to their own benefit and convenience. Which, making known to all and everyone whom it may concern, especially to the castle and municipal office of Lwów and all other offices, we command them under Our grace that they should preserve and maintain the aforementioned Shooting Brotherhood in this Our permission in its entirety and inviolably for eternal times and cause it to be preserved and maintained by those whom it concerns. In witness whereof we have ordered this document signed by Our hand to be reinforced with the crown seal. Given in Lwów, on the 11th day of August in the year of our Lord 1651, of Our Polish reign the third year, and the Swedish fourth. John Casimir, King. Place of the seal of the greater Crown Chancellery hanging, contained in a tin box, and impressed in red wax. Wojciech Kadziałowski, secretary of the Royal Majesty, by his own hand. The second document, also parchment, signed by the hand of the same Most Serene John Casimir and reinforced with the seal also of the Greater Crown Chancellery hanging, containing the privilege of a donation of a certain sum, namely fifty Polish florins, from the Tower, otherwise called the Crossbow Bastion, annually falling due and collected by the Lwów Shooting Brotherhood, from the proceedings in Lwów on the Tuesday after the nearest Cross Sunday, in the year of our Lord 1653, and the donation of a certain land, or field in the suburb of the same city, called Halickie, lying on the Zalborski Field, to the same Brotherhood for the sake of shooting exercises from the proceedings in Lwów on the Wednesday after the nearest Exaudi Sunday of the same year by the Lwów Magistrate, or the Orders of the same city granted, and confirmed by the same Most Serene John Casimir dated in Lwów on the very calends of the month of August of the year aforementioned. The third document, similarly parchment, signed by the hand of the Most Serene King Sigismund III, reinforced with the seal of the greater Crown Chancellery hanging, dated in Warsaw on the 30th day of August of the year 1628, containing the fee called 'szpaszne', that is, the authorization to collect for eternal times by the Lwów Shooting Brotherhood one grosz from merchants driving oxen and other cattle and herds from Wallachia and elsewhere to the Crown and outside the Crown, and detaining them for a certain time on pastures within the borders of the Lwów territory.
[p. 9 / p. 10:]
[At the top, a fiscal stamp]
The fourth letter, also parchment, of the Most Serene Henry I, signed by the hand of the most illustrious Valentine Dembiński, Chancellor of the Kingdom of Poland and reinforced with the crown seal of the Greater Chancellery hanging in a wax box, impressed in red wax, dated in Kraków at the General Crown Sejm of the Coronation of the same Most Serene King, on the second day of the month of May of the year 1574, containing the confirmation of the privilege, or prerogative of the Shooting Brotherhood, graciously granted by the Most Serene, of blessed memory, Sigismund Augustus for the development of shooting exercise – namely that in shooting, whenever any of the townspeople knocks down and throws off the bird or chicken made of wood, placed as a shooting target on the mountain set up for shooters, he should be free from all taxes, both royal and enacted and those to be enacted by the Commonwealth, as long as until a similar bird is knocked down by another shooter. And a broader prerogative granted by the same Most Serene Henry to shooters and gunners, that he who knocks down the aforementioned made bird, or a gunner who hits the very center of the target with any war cannon, should be free from municipal taxes, or levies appearing under any name. Furthermore, containing the duty imposed on the mayor and councilors of the city of Lwów to pay to the shooters and gunners from the municipal treasury every year, perpetually and forever, under the penalty of one thousand Polish marks, the sum of forty Polish florins for the purchase of jewels. The fifth and final document, signed by the hand of the Most Serene King Sigismund III, sealed also with the hanging seal of the Lesser Crown Chancellery, contained also in a wax box, including the confirmation of the above-described privilege of the Most Serene Henry, or the prerogatives expressed in the same privilege, dated in Warsaw on the 15th day of the month of April of the year of our Lord 1600. All these five letters of privileges are sound, whole, intact, and free from any suspicion. And because Our Councilors, then staying at Our Side, interceded on behalf of and for the benefit of the elders, juniors, and the entire Shooting Brotherhood established in Our City of Lwów, the metropolis of Ruthenia, that We might deign to approve and confirm the above-mentioned five letters of privileges with Our Royal authority: WE, considering that the shooting exercise for averting and repelling threatening enemy attacks has been founded from the most ancient times with the best intention and for public benefit and has been preserved until now as absolutely necessary, graciously acceding to the aforementioned request at the intercession of Our Councilors, we have deemed it right to approve and confirm the above-included documents – both the first one entered here in full wording, and the others, only specified by proceedings and date (which, however, we wish to have as included and entered) – or rather the rights and privileges expressed above and all other rescripts and diplomas
[p. 10 / p. 11:]
graciously granted and confirmed by the Most Serene Kings of Poland, Our Predecessors, to the aforementioned Lwów Shooting Brotherhood, as well as customs, habits, freedoms, and immunities, serving exclusively the good and benefit of the Kingdom and the same city, until now shining and immortalized, in all their points, clauses, articles, conditions, and conjunctions, just as if all and each of them were entered word for word here, and we approve, confirm, and ratify them with Our Royal authority, and we preserve and maintain the aforementioned Lwów Shooting Brotherhood in these rights, privileges, prerogatives, rescripts, letters, freedoms, immunities, customs, and habits long serving them, from the fullness of Our Royal Power. Deciding that the aforementioned five letters of privileges and everything contained in them is to have the force and weight of due and inviolable durability (to the extent that they are based on law and are in use). In witness whereof we have ordered this document signed by Our hand to be reinforced with the crown seal. Given in Lwów, on the 30th day of October in the year of our Lord 1671, of Our reign the 3rd year. Michael, King. Place of the hanging seal of the Lesser Crown Chancellery, Stanisław Bużeński, canon of Gniezno and Warmia, regent of the Crown Chancellery. Therefore WE, King John, graciously acceding to the request of the aforementioned Our Councilors, brought to Us on behalf of that Lwów Shooting Brotherhood – as it greatly matters to Us and the entire Commonwealth that this city, lying in the vicinity of pagan borders (with whom peace, even if concluded by ancient and new alliances, can never be free from suspicion), placed almost in their jaws and under the anvil of misfortunes, should become as strongly fortified and provided with weapons as possible, and although from Our zeal for the Commonwealth we have raised from the very ruins with no small expense from Our own royal fund the works and external ramparts, destroyed by the age of time and mostly fallen, and we have taken care of the execution of certain new ones and as much as depends on Us, we strive in continuing the fortifications – desiring nevertheless to have this City of Lwów not only fortified with walls, ramparts, positions, trenches, and fortifications on all sides, but also garrisoned with valiant men, skilled and trained in the art of shooting and provided with the remaining equipment, with Our Royal authority we not only approve, ratify, and confirm the above-included document about shooting exercise, or rather the rights, privileges, rescripts, diplomas, customs, habits, freedoms, and immunities, all in total and each individually, in all points, articles, and conditions, but also, so that even greater
[p. 11 / p. 12:]
zeal in decorating and fortifying the city to arouse in these Lwów townspeople, from certain knowledge and deliberation of Our Royal and with the consent of Our Councilors and the entire Commonwealth present with Us at this General Assembly of Our Kingdom, we hereby declare that the aforementioned Shooting Brotherhood should perpetually collect and enforce not only the fee called 'szpaszne' from oxen, cattle, and herds driven or imported from Wallachia and elsewhere to the Kingdom of Poland and outside it – one grosz from each ox, cow, calf, and Turkish, Moldavian, Wallachian, or Hungarian horse, and from smaller herds or cattle half a grosz – but also from all foreign and domestic merchants, from the east, from the north, and other parts and sides of the world arriving from anywhere with sums and goods of all kinds and species, of great or lesser price, as well as with finer and more expensive drinks, namely Hungarian wine, malmsey, Spanish, Italian, Wallachian, raw or brewed mead, imported or exported from there not only to Lwów, but to the entire Ruthenian voivodeship and towns and villages belonging to it, now and in the future, during fairs and outside them, at any time, and also from the inhabitants of the Crown, in accordance with the privileges of the Most Serene Kings John Casimir and Michael, Our Predecessors, by virtue of this Our Declaration – not only to twelve miles nor on the Lwów territory itself, but on the entire area and in all parts, places, towns, and villages of the lands and districts of Ruthenia, after prior taxation and valuation of those foreign and domestic goods and expensive drinks to a just and proper sum, which the merchants will be obliged to show under oath – one grosz from every hundred [florins], through their collectors, who should be present with the administrators, superintendents, and writers of crown and Our customs in those lands of Ruthenia. However, without any burdensome disputes with merchants and their complaints; and let them faithfully turn the obtained sums to the needs, ammunition, moving and bringing in of cannons and their repair, to rewards for those shooting well and to other expenses concerning exclusively the shooting exercise itself (with the obligation of accounting before the Magistrate), and let them not abuse that grace and kindness of Ours in any way. Referring also to the point of the privilege of the year 1574, granted to the same Shooting Brotherhood by the Most Serene Henry, Our Predecessor, at the Coronation Sejm in Kraków – so that each of the shooters
[p. 12 / p. 13:]
understanding the art of more accurate and regular firing of bullets from larger cannons, hitting the target and the center of the shield, should learn it with a more zealous spirit and enthusiasm, and be a glorious example for others – we decide and announce that that winner, commonly called King (who, however, must be a sworn citizen), hitting from any war machine into the center of the target, and his successors hitting the target in an equal or more accurate way, not only are to be decorated with the designated reward of just and appropriate value and jewels for this use and honor long intended (which the same Shooting Brotherhood should buy out as soon as possible from this future income), but also let that King be free and exempt from all taxes and burdens of Ours and the Commonwealth, from paying Our and the Commonwealth's customs, as well as other bridge, water, and land fees, in the Crown and outside the Crown, in any places, chambers, and tollgates, from all goods, both upon departure and return, during fairs and after them – just as we declare him free and exempt by the authority of this Our Sejm, until another hits the same target or any mark of the center of the shield with similar or better skill and shot and wins that glory. Furthermore, we command the Lwów Magistrate as the then and future provisors of the same Brotherhood, that they should treat those citizens entered or to be entered into the register of shooters – not for any reasons and favors, but for merits and diligence, as men capable and perfecting themselves in the art of shooting – especially and paternally, when it comes to private contributions and municipal burdens, and to some extent graciously ease them from those municipal burdens; and let them under Our grace never allow them to be forced and burdened by the decurions or quartermasters with any guards, common watches, otherwise to the quarters, day and night in gates and wickets (since they are obliged to spend sleepless nights in towers, bastions, and ramparts in sudden need and by order of the Magistrate at heavier cannons, as custom dictates). Deciding that all these rights and privileges and this Our ordinance and declaration, approved by public law at the current General Sejm, are to have the force and weight of law, resolution, and Our decision and eternal, inviolable durability, which can never be disturbed by Us, Our Most Serene Successors, Kings of Poland, nor by the then and future Lwów Magistrate. And so that all this may come to general knowledge, let
[p. 13 / p. 14:]
all courts and offices of the Kingdom, castle and municipal, especially of the Ruthenian lands, accept into their acts the presented document of this privilege and Our decision and have it proclaimed by the general crown bailiff on the public market, and also let them take care that this document is strictly observed by all in its entirety, and let them observe it themselves. Wishing furthermore that the places dedicated to the glorious exercise of annual shooting from smaller firearms, called muskets, as this called 'celstat', occupied by the gunners of Our Royal Arsenal, otherwise taken away by the gunsmiths and turned to secular purposes, should be returned and vacated to the same Brotherhood as soon as possible – we command that those gunners of Our Royal Cekhauz in Lwów, at the first call of them or the superiors of the same Brotherhood, without delay, under the threat of Our severe penalty, vacate and return the aforementioned places called 'celstat'. In witness whereof we have ordered this document signed by Our hand to be reinforced with the crown seal. Given in Warsaw, at the General Crown Sejm, on the 8th day of the month of April of the year of our Lord 1677, of Our reign the third year. John, King. Place of the hanging seal of the Lesser Crown Chancellery. Mikołaj Szulc, secretary of His Royal Majesty, by his own hand. On Monday, on the eve of the feast of the holy Apostles Peter and Paul, in the year of our Lord 1677, as a result of the oblation presented by the honest Jakub Jarącki, townsperson and merchant and writer of the Shooting Brotherhood of the City of Lwów, the Lwów Castle Office accepted this document, entered it into the current acts, and ordered it to be announced by the noble Jan Szagalski, general crown bailiff. Therefore WE, KING AUGUSTUS, moved by the request of those Shooters of the aforementioned City of Lwów, by the advice of Our officials then present with Us, that privilege of the Most Serene John III, Our Predecessor, granted to the Brotherhood of those Shooters, and approved and confirmed by the public sejm constitution of the year 1677 – We also with Our Royal authority in all and individual points, clauses, conditions, and conjunctions, just as it was faithfully transcribed word for word above in this Our document, approve, confirm, ratify and so that in all its articles and points, in accordance with their wording, as well as immunities, freedoms, prerogatives, customs, annual fees, and customs, in whose possession they have been and are, by all inhabitants of Our Kingdom,
[p. 14 / p. 15:]
castle starosts, customs officers, their deputies, and anyone else should be observed, we strictly command, announce, order, and want to be absolutely preserved. And because until now that shooting exercise, most necessary for the defense of this city and the entire Kingdom, was practiced due to the lack of funds and outlays only from larger handguns, otherwise from hook guns, with the abandonment of other weapons – therefore, relying on the above-cited rights and privileges, renewing them from the fullness of Our Royal Power, we command and order the Magistrate of the same city that from now on every year in that shooting exercise he should observe the following order: after the feast of the Resurrection of the Lord, having found a convenient time, let all citizens and inhabitants of Our City of Lwów first begin shooting from smaller weapons, that is, from muskets, to the performance of which they will be obliged by tens or hundreds; then at the designated time and according to the existing custom let them shoot from larger handguns, namely from hook guns. Finally, every three years, after the feast of Saint Michael the Archangel, they will be obliged to perform shooting from cannons, with proper ceremonies and requirements, starting this order without delay in the nearest year 1699. As for the places for conducting this shooting exercise from hand weapons, that is, from muskets, which are barricaded and occupied by the servants of the Crown Artillery, and until now have not been vacated even at the frequent requests of the townspeople, with a manifest violence done to the privilege of the Most Serene Our Predecessor – we command that the same Magistrate should insist with the Most Illustrious Elder over the Crown Cannon, that he should cause the vacation and return of those places necessary and essential for shooting. In witness whereof we have ordered this document signed by Our hand to be reinforced with the crown seal. Given in Warsaw on the 17th day of the month of October of the year of our Lord 1722, of Our reign the 26th year. Augustus, King. Place of the hanging seal of the Lesser Crown Chancellery. Adam Stanisław Grabowski, cathedral dean of Chełmno, secretary of His Royal Majesty. WE therefore, KING AUGUSTUS, graciously acceding to the request directed to US by the noble Mikołaj Sachagowicz, writer and current elder of the same Lwów Shooting Brotherhood, the aforementioned

document and everything contained in it, we have deemed worthy of approval and confirmation, and also: as far as they are based on law and are in use, we approve and confirm with this Our document, deciding that they are to possess the force and weight of due durability. In witness whereof we have ordered this document signed by Our hand to be reinforced with the crown seal. Given in Warsaw, on the fifth day of the month of April of the year of our Lord 1739, of Our reign the VI year.

Confirmation privilege of King Augustus III for the Shooting (Kurkowe) Brotherhood in Lwów, prepared in the form of a parchment book (codex) in a leather binding with embossing. It transumes documents of the kings: Augustus II (Warsaw, 1722-10-17), John III Sobieski (Warsaw, 1677-04-08), Michael Korybut Wiśniowiecki (Lwów, 1671-10-30), John Casimir (Lwów, 1651-08-11 and 1653), Henry Valois (Kraków, 1574-05-02), and Sigismund III (1600 and 1628). Contains the autograph of King Augustus III and secretary Teodor Klewel (Theodorus le Klevel). On subsequent pages, there are entries and intabulation decrees of the Lwów Magistrate from 1794 (with signatures of Kazimierz Medyński and Antoni Kaszuba) and a trace of a seal under a paper cover.
