Archbishop of Mitylene, Referendary of Both Signatures of Our Most Holy Lord the Pope, as well as Judge Auditor of the cases of the Apostolic Chamber and Ordinary Judge Lieutenant specially chosen and appointed by the same Most Holy Lord the Pope. To all and singular Reverend Lords Abbots, Priors, Provosts, Deans, Archdeacons, and other Presbyters, Clerics, Notaries, and public Tabellions wheresoever established, greetings. Be it known that they have appeared again before Us in the name and at the request of the Illustrious City of Lviv and its Councilors and Magistrate, carefully representing that although they, also by virtue of the public instrument of agreement and concord concluded in the year 1514 with the Reverend Chapter of the Metropolitan Church of the City of Lviv, as well as other laws to be executed in their place and time, as is their due, are in peaceful and quiet possession, or quasi-possession, of the administration of St. Anthony's Hospital founded outside the walls, and of appointing provisors, provosts, and other servants, as well as performing all other acts in any way concerning said administration. Nevertheless, the Most Reverend Lord Archbishop of Lviv and his Fiscal Promoter have boasted and do boast that they wish to disturb the said Representing Lords in their possession, and de facto have acted, filing an openly slanderous manifestation to the detriment of the honor and fame of the Lviv Magistrate and the Provisors, or Administrators of the said Hospital, who are chosen from the City [...], and the said manifestation was submitted to the Acts of the Chancellery of the Lviv Consistory and accepted by the Reverend Lord Wojciech Mirkiewicz, actuary of the same chancellery. Desiring therefore the said Representing parties to free themselves from those unlawful usurpations by way of law and to be maintained in their said possession or quasi-possession, and to have the said manifestation submitted to the Acts of the Consistorial Chancellery, as striking at the honor and fame of the said Representing parties, declared null and void, and to admonish its authors to refrain from such acts in the future; therefore they humbly begged Us that we might deign to provide them with a suitable legal remedy in the above matter and wish to issue and grant the Monition written below together with the Inhibition and Compulsorial Letters.
We therefore, acceding to these requests for the sake of peace, to all and singular above-mentioned and to each of you individually by virtue of this letter do entrust and by virtue of Holy Obedience command that you, immediately upon seeing and receiving this letter by the parties, on Our behalf, or rather by Apostolic authority, admonish and summon and cause to be admonished and summoned, just as We by these presents admonish and summon the above-mentioned Fiscal Promoter (and others to be mentioned by name and surname upon the execution of this act), that within six days – of which you are to designate and must designate two for the first, two for the second, and the remaining two for the third, final and peremptory term and canonical admonition, just as We designate – under penalty of 500 gold ducats to be turned against them from the Chamber and under penalty of an executive order, and in support of the law under penalty of excommunication and others at Our discretion, they were bound and each of them individually was bound to inviolably and to the letter preserve, respect, and fulfill the above-mentioned Instrument of Concord and Agreement concluded in the year 1514 between the City of Lviv and the Church Chapter, and all and singular things contained and expressed in that instrument, and to render them to due, full, and complete execution, so that they may fully achieve their effect; and as proof of their observance and execution, to maintain, defend, and preserve the alleged Representing parties in their peaceful and quiet possession of the administration of the Hospital, the appointment of provisors, provosts, and other servants, and the handling of all matters in any way concerning said administration, and to cause them to be maintained, defended, and preserved; and from all boasts and vexations in the above matters in any way inflicted, made, and submitted or threatened to the said Representing parties, as well as those that may occur in the future, to completely and entirely cease, desist, and refrain, and to consider the manifestation recently submitted to the Consistorial Chancellery Acts as null and void and cause it to be considered as such. [...]
Otherwise, on the same day of the admonished and summoned, if they consider themselves aggrieved in the above, peremptorily summon and cause them to be summoned, just as We by these presents summon, that on the sixtieth court day after delivery to the parties they appear before Us in court legally before Us in their case, for the purpose of presenting their grievances and receiving the fulfillment of justice. Assuring the same admonished and summoned party that regardless of whether they appear or not on the appointed term of admonition, We shall nevertheless proceed to the above and all other legal and factual measures, with the preservation of justice, despite the disobedience or absence of the summoned.
Furthermore, forbid, command, and order, just as We by these presents forbid, command, and order the said Promoter of the Affairs of the Archdiocese of Lviv and others who are to be mentioned by name and surname upon the execution of this, that under the above-mentioned penalties they do not dare or presume to disturb, vex, and disrupt the said Representing parties in that their above-mentioned peaceful possession, nor disturb them, and even less to prepare and submit to the acts any new manifestation to the detriment of the honor and fame of the said Representing parties, nor in any way disturb the Hospital Provisors, nor change or undertake anything else under any pretext; and if they should do so, all this [...].
Furthermore, to all and singular of you above-mentioned we entrust and command equally that you compel and oblige the said Reverend Wojciech Mirkiewicz, Notary of the Lviv Consistory, in whose possession is the instrument of the said manifestation, and all and singular other notaries and chancellors of the curia and any other persons in whose possession are all other rights, writings, documents, and any processes concerning directly or indirectly the rights of this case and relating to the said manifestation, to their release and delivery in authentic form to the parties or the parties' defender after payment of the due fee legally owed, by ecclesiastical sentences and censures, as well as monetary penalties, and cause them to be compelled and obliged until complete release and delivery.
In witness whereof these were given in Rome, from the Innocentian Curia on Monte Citorio, on the 11th day of February, 1764.
Donat, Archdeacon, Apostolic Chancellor, signed with his own hand.
