We make it known to all whom it may concern that the honorable Ignacy and Katarzyna née Niedźwiecki Gawlikowski, spouses, have petitioned us to grant them and their successors by emphyteutic right for thirty years, counting from April 1 of the current year, our hereditary land in the Saint John jurisdiction at [...] of the Zhovkva Suburb, located under no. 481, formerly possessed by the Wronkiewicz spouses, on which land the standing brick house was acquired by the aforementioned honorable Gawlikowskis from the same Wronkiewicz spouses. The front of this land by the public road leading to the High Castle has ten Viennese fathoms in length; the wall running on one side along the boundary by the wall of the land possessed by the carpenter Jan Godowski, as well as on the other side running along the boundary by the wall of the land possessed by Mr. Wrębski from the same public road up to the street running along the back walls of the monastery of the venerable Benedictine nuns has thirteen and 1/6 Viennese fathoms in length, and the back front by the street leading to the High Castle along the wall of the venerable Benedictine nuns has ten and 1/3 Viennese fathoms in length, in the same length and width, measured on our part on the sixth day of April of the current year; [and that we] allow on the same land to build stone houses and make all other necessary and useful structures and improvements to the same land, under the conditions: 1.° That they immediately pay and settle the usual laudemium for the granting of such a right in the amount of Polish zlotys [crossed out: twelve, determined on the part of our chapter due to the sacristan services provided by Ignacy Gawlikowski at the Jesuit church,] in cash to the treasury of our chapter; 2.° That they pay the ground rent from this land in the amount of Polish zlotys [crossed out: sixteen annually, determined and agreed upon for the aforementioned reasons,] punctually on April 1 of each year to the treasury of our chapter or to the then-serving honorable priest procurator of the chapter, against a receipt from the same or the then-serving honorable priest procurator; 3.° That they bear and pay all taxes, tributes, and other public burdens, both those currently imposed on this land by the national governments and those that may arise in the future, themselves and with their successors, and demand no help in this from our chapter; 4.° That they do not involve our chapter in legal disputes and quarrels arising from the appropriation of neighboring lands or the cession of any part of the granted land to neighbors – which is forbidden by this right – and do not require representation for themselves; 5.° Finally, if the buildings built and erected on this land [crossed out: the same honorable Jan and Katarzyna Gawlikowski] spouses or their successors wished to sell to someone else, in that case our chapter will always have the right of first refusal, and if the chapter had no need to acquire them, then they shall sell them to someone else with the preservation of the laudemium payable by the purchaser to the direct lord with our consent. And since the honorable spouses [crossed out: the same Jan] Ignacy and Katarzyna née Niedźwiecki Gawlikowski have accepted these obligations for themselves and their successors, therefore we, the prelates and canons of the Archcathedral Church of Lviv, have granted and do grant to the same honorable [crossed out: Gawlikowski spouses this emphyteutic right to the land mentioned above, provided with the impression of our chapter seal and signed by the hand of our most honorable priest president, for thirty years and allow it to be intabulated] with this irrevocable condition: 1.° that after the expiration of this right, our chapter shall be free, according to the circumstances of the time, to proportionally increase the ground rent for them or their successors or to keep and leave them or their successors at the same ground rent; 2.° that if they do not pay the annual ground rent punctually each year and fall into arrears for three years, or contract any debts on the mentioned land without the knowledge and consent of our chapter, or cede any part of it to someone else, or take and attach to themselves any part of the neighboring land – they shall lose this right, and the chapter in this case, having paid for the buildings or allowed them to be paid for by someone else, reserves and retains full freedom to dispose of this land.

Document on paper (not parchment, contrary to the name of the collection). Preserved in good condition, visible signs of folding. Contains deletions and corrections in the text as well as an interlinear modification of the date (from April 12, 1804, to November 10, 1814). The text originally mistakenly contained the name 'Jan', which was crossed out and replaced with the name 'Ignacy'. The seal under the paper wafer is preserved in its entirety.
